Kyron Horman's stepmother was served with a restraining order and a petition for dissolution of marriage at 6 p.m. Monday, a law enforcement source confirmed.
The legal papers came as a complete surprise to Terri Moulton Horman, the source said.
Approached earlier in the day at her home in Northwest Portland, she had denied a report by Fox TV that her husband, Kaine Horman, and 18-month-old daughter, Kiara, had moved out.
"Everything's good," she said, giving a thumbs up. "We heard that rumor. It's just a rumor that needs to be squelched. Everything's fine."
However, the source said Kyron's father and sister indeed had left.

Why a restraining order? Has she been threatening to him or Kiara? Maybe it is just to keep her away from Kiara. And did he just go today and see a lawyer to have divorce papers drawn up? Maybe this was something that was already in the works when Kyron went missing...Maybe that's WHY he went missing...To get back at his Dad? This is just the weirdest case I've ever seen! There is just a lot that we don't know about in this case that LE does know...It seems that it cannot have a happy ending Kyron and his family.

Desiree Young, told "Good Morning America." "We've racked our brains trying to think of reasons why. We cannot come up with anything... It's like a portal opened up in the school and Kyron just vanished into it. It's a mystery."
I agree with those of you who hope that the school building was thoroughly searched.
I can't forget how Annie Lee was murdered and stuffed into that very small space behind the furnace in one of the Yale buildings. She was working on a science project too.
Also the dynamics between the Bio-Mom and the step-mon are weird to me. Terry seems more clinging and affectionate to her than she does to her husband. Sort of puppy dogish.
Compare those body building pics (full of self esteem) to the way she looks now and I'd never guess that was the same person.
Could she have postpartum depression?

I know for a fact that a judge will not even approve a temporary restraining order (normally 10 days so the person can be served) without probable cause. Not just anyone can go and get a restraining order on someone else. Therefore, the judge must have had a reason(s) to do this.
I have suspected the stepmother from the get go. Don't know why..she simply raised my hinky meter. She has a son (the 16 year old) then their is/was Korman (Kaine's son) then they have Kiara together. I think for whatever reason, the stepmom had major issues w/Korman. Just my gut feeling.

Was Terry the person who took those pictures of Kyron at the Science Fair?
Judging from the expression and smile on his face in that picture and others we've seen, he seems like a happy boy unafraid of the person snapping the photo.
Compared to the ones we've seen of Caylee Marie he's down right blissful looking!

Even as police focused attention on missing Oregon boy Kyron Horman's stepmother, the 7-year-old child's family maintained a united front – until now.
Within the last two days, Kyron's father, Kaine Horman, has moved out of the house he shared with wife Terri Moulton Horman, and he brought their 18-month-old daughter Kiara with him, a source tells PEOPLE.
On Monday night, Terri Horman was served with a restraining order and divorce papers, the Oregonian reports.
Meanwhile, Kyron's mother, Desiree Young, and her husband Tony, have joined Kaine Horman in releasing a cryptic statement saying they're pulling back from the public eye.
"We understand that we have free access to the media but are limiting statements to the media to keep the integrity of the investigation intact," the three stated. "Any actions taken by the investigation, or by us, are based on the best interests of Kyron and Kiara and comply with the law. Beyond this, we have no comment on the matter."
Terri Horman's name is not included in the statement, and a source tells PEOPLE she is no longer officially speaking for the family as she has in the past.
As recently as last Friday, Kyron's father said he believed his wife was "committed" to finding him.
Terri, who has helped raise Kyron since he was a baby, was the last person known to have seen him, telling police she dropped the second-grader off June 4 at a science fair at his Portland-area school.
Since then, she has taken two polygraphs and deputies sent out a questionnaire asking if anybody had seen Terri or her truck the day the boy disappeared.
Terri Horman's dad tells PEOPLE in the current issue she's been interviewed repeatedly, as long as six hours at a time, and that police have inspected her truck twice. Asked if he though authorities would arrest Terri, her father said it was "fifty-fifty."

I have honestly thought Post-partum depression in this case before, but then again, she must have to have it BAD. Maybe she agreed to take care of Kyron for her BF (Kyron's Mom) to get "closer" to Kaine, but never really developed the love for Kyron as a normal mother would have? IMO, then Kiara comes along and Mom gets a case of Post Partum, but it goes untreated?? IMO, and one day she snaps? IDK.. All I know is this poor Boy is missing at the hands of his step-mother

Thanks for the post, Nite. I get what you are saying and of course she could be depressed...but depressed enough to kill her step-son? Wouldn't she want to kill her own child that (in her mind) gave her the PP depression?
I actually think that after Kiara (what is w/all the "K"s?) she lost interest in Kyron and it sky rocketed.

Ha Wrap, I think we both have the same feelings about what happened with the SM
I have to admit, I had a bit of the PPD after my second child, but I like to refer to it as "I was in a FUNK" LOL. I was just overwhelmed being home alone with 2 YOUNG babies under 2 and the Hubby was working swing shift so we would save on Daycare.. I got myself out of my "FUNK" with the support of an AWESOME hubby and (a lil help from meds), But, OMG, With ALL the stress my kids have put me through I WOULD NEVER EVER think of harming them!!! I LOVE them with all my heart! This is what drives me crazy to hear/read these stories.. makes me sick that these NOT MOM's cant get a grip on reality and Harm their children. (IMO, as always.. LOL)

It seems the police have told Kyrons father to leave the house he shared with the stepmom and take the baby with him and he has done so. Why would the police suggest he do so?
PORTLAND, Ore. -- The father of missing 7-year-old boy Kyron Horman is staying elsewhere this week after taking the daughter he has raised with Kyron's stepmother out of their home.
Friends of the Horman family told FOX 12 that police encouraged Kaine Horman to take the couple's 18-month-old daughter and stay at a different location. Investigators would not confirm that information Monday.

I am so sorry you went through "The FUNK". Many mom's do..especially young ones. They feel they have not had the time to enjoy their life and are now saddled down. Trust me, I KNOW how much you love your children, who are just plain adorable!!!!!

Father of Missing Oregon Boy Files for Divorce
The father of a missing 7-year-old Oregon boy filed for divorce and took out a restraining order against his wife, the boy's stepmother and the last person to see him, according to reports.
Kaine Horman filed for divorce from Terri Moulton Horman on Monday in Multnomah County Circuit Court, The Associated Press and The Oregonian reported. Horman also got a restraining order, according to The Oregonian and KPTV, which cited unidentified sources, and moved out with their 18-month-old daughter.

Kyron Horman vanished June 4 from his school in Portland after Moulton Horman brought him to school and took his picture at a science fair before classes began. The sheriff's office recently said the search for Kyron had become a criminal investigation.
Moulton Horman isn't a person of interest or a suspect, sheriff's spokeswoman Lt. Mary Lindstrand told AP on Monday, adding that the department is "not talking about personal issues going on with the Hormans."
However, Moulton Horman, 40, has been a prominent figure in the investigation because she was the last to see her stepson. Her friend, Jaymie Finster, has said Horman has taken a polygraph test and planned on taking a second, according to a report.
Also Monday, the boy's father, his mother, Desiree Young, and her husband, Tony Young, released a statement through the sheriff's office supporting the investigation. Notably, Moulton Horman was not included.
"We have been fully briefed by law enforcement on the on-going criminal investigation," the statement read. "We are in complete support of that investigation."
The statement said the three were "limiting statements to the media to keep the integrity of the investigation intact."
It said they were acting in the best interest of Kyron and his 18-month-old sister, Kiara, and would not comment further.
Moulton Horman's father, Larry Moulton, told KPTV that her 18-month-old daughter wasn't living with her.
"It's a very difficult time, and I'm just here to support my daughter," said Moulton, who's staying with her. "We'll leave it at that."
People magazine reported today that Moulton said his daughter has been interviewed at length by police and that chances are "50-50" she will be arrested.
On Monday night, several friends arrived at Moulton Horman's home to console her after learning of the divorce filing, The Oregonian reported. At one point, Moulton Horman stuck her head out the door to call to a friend, but she did not otherwise comment, the paper said.
Kaine Horman's lawyer, Laura Rackner, a family law attorney, did not return messages left by several media outlets.

Could the divorce and restraining order really be a completely separate matter from Kyron's disappearance? I find that hard to believe...but the LE spokesman says above that Terri is not a POI or a suspect! If not officially, I believe that Kaine is suspicious of her...Or maybe the investigation has shown that she was having an affair and meeting someone on Sauvie Island. If she is not the one who harmed Kyron, I really feel sorry for her...But I still think that she had something to do with it, even if LE is not prepared to say so yet.

I find this very strange indeed. When have you found the parents of a missing child file divorce papers on each other two weeks into the investigation?
Usually they have the decency to wait til they find the child or have more to go on than we know.
There has to be a whole lot more to this story. Things brewing in the family for a long, long time.

Willamette Week (Portland newspaper) has learned from a source at the Multnomah County Corrections Division that there’s been a plan circulating for about two weeks among corrections staff in case Terri Moulton Horman is arrested in connection with the disappearance of her 7-year-old stepson Kyron Horman.
The source says the plan —in the event of the stepmother’s arrest— is for staff to notify immediately Corrections Health Director Gayle Burrow as well as mental health staff. The idea, the source says, of notifying mental health staff is so they could perform an evaluation of Terri Moulton Horman and put her on a suicide watch, if she is taken into custody.

I just can't wrap my mind around what is going on here...I was thinking about Kaine...He's certainly been the one getting more sympathy, but I wonder what kind of man he really is...I mean, why did Desiree feel compelled to divorce him even before Kyron was born? and why did she take out a restraining order at that time? I'm not saying that he did anything to Kyron, but something is just not adding up here...Was this divorce in the works already? Did Terri decide to get back at him by harming Kyron? Or is the divorce a result of his suspicions of her, something that LE has told him about her? If so, and she really didn't have anything to do with Kyron's disappearance, it is just a tragic situation and I feel sorry for her...This case is just mind-boggling :scratch:

B.S. She IS a POI, they just don't want her to know that. They did the same thing with Chris Coleman if you remember while they were tying up loose ends as they thought he was a flight risk. In this case, I think Terri may be a mental case risk.

I agree with Lisette - what is going on here? I have read over on blink something about an affair that possibly Terri was having - and that is why she said she was home when she might have been somewhere else. All of it unconfirmed. There are a lot of unanswered questions here - Kaines brother is a convicted sexual predator, Terri's son no longer lives with them, Desiree's actions during her divorce were

The parents have had their lives ripped apart and have had no desire to market or exploit this tragedy. I would not be surprised to hear the father begin to use past tense language (Morgan Harrington's dad) as he may accept this first, to be strong for the family, but I expect Mom to slip between past and present tense, as she struggles to accept what it is that the police have shared with them.
If sharing information with a family corrupts an investigation, it makes sense not to. But to keep a family "in the dark" (I hope to write about Dr. and Mrs Harrington's loss of their daughter, Morgan), is cruel and unfair.
I get a sense from the tone of the statement that they know. In the above article he described Kyrons behavior and intimates he had attention deficit disorder. Has anyone else heard this? Also I find especially interesting the comparison to the Anthonys "marketing" of Caylees

Wow I just caught up on this thread. Nitespinr for posting that information on postpartum depression. If a Mother kills it goes way beyond postpartum depression. That is a serious mental illness complicated by postpartum depression. I am shocked at the turn of events. A divorce? Wow. Something is so wrong with this whole thing. ADHD children need care and loving Parents. Again I am how this is playing out.

Watching Nancy Grace - she is on the stepmom's case big time. However, I still have reservations here. Something is still "off" about this case. Lots of statements turned out not to be true such as it was reported a couple of teachers said they saw stepmom

I have read hints that Kyron had some type of learning disability or ADHD, but no concrete statements...I do know, as a former teacher, that the teachers are often given paperwork to complete for the parents to take with them to the doctor when a child is being evaluated for ADD/ADHD or a learning disability...Maybe someone took the statement that Terri had given Mrs. Porter paperwork to complete for Kyron's doctor appt. as an indication that he was being evaluated for a disorder...IDK

I was just reading over on Hinky Meter and someone said that the father of James (Terri's 16-yr-old bio son that her second husband adopted) said that James left his mother's home in March because he was not doing well in school there and "butted heads with Kaine." I can imagine the tension all of this must have brought to that household. That made me wonder if this affected Terri to such an extent that she thought, "If I can't have MY son with me, then you won't have YOUR son either." Especially if Kaine started talking about divorce. Wild speculation, I guess, but it is something to think about...

lisette, what you just posted makes the most sense I have heard yet. She may not be that mentally stable for whatever reasons..who knows, she could have endured a lot from Kaine. One thing though, if this is the case, I do believe it was pre-meditated if this is the case to begin with.

I think its unfair that the police dont say if she is a POI. People have already decided shes guilty without all the facts. If she wanted to get rid of the child,

Friends urge Terri Horman to speak
Close friends of Terri Horman, the stepmother of missing 7-year-old Kyron Horman, say they wish she would speak out so people can hear her side of the story, and they’ve also advised her to hire an attorney.
Those friends, who have declined to speak on camera, said her husband’s motion to divorce is leaving her without the funds to afford a quality lawyer.
Kaine Horman has filed for divorce and was granted a restraining order against Terri that barred her from their 18-month-old daughter, Kiara.
The court records for the divorce were released Tuesday but only the cover letter of the restraining order was released. A judge said he was concerned that releasing the entire document could jeopardize the investigation into the disappearance of Kyron.

Wow! I finally got through the entire thread!! I don't know how I missed this thread all month (I've been following the story on Nancy Grace & HLN)... but it's been interesting to read all your theories & comments. Now for my two cents:
The stepmother definitely seems guilty (IMO)! There is something about her demeanour at the news conference that seems "off" (IMO). The pictures of her as a bodybuilder are quite scary! (Then again, I'm not a big fan of female bodybuilders) She has a "toughness" about her... I could picture her hurting a young boy. Also, her cell phone "pings" on Sauvie Island around the time of Kyron's disappearance are suspicious.
Now, with the restraining order against her, and her husband filing for divorce - she definitely looks gulity! I do agree with those who are cautioning on a "rush to judgement" before she is officially declared a POI or a suspect. But... for some reason, I think that will be happening very soon!

I think lots of fathers think that the school thing is a mom's duty, not the dad's. Before my daughter got her divorce, her husband never attended any school function, not even the kids ball games. But you can rest assured Nicole, Aunt Kelli and I went to all of them.

I am having a hard time with everybody ready to crucify Terri.
If she was soooo bad others had to see that. Especially the biomom, biodad and detective stepfather.
Biomom even left biodad in her 8th month of pregnancy and got a restraining order against him.
But she let him raise her precious son?
I see they released some pictures and the ones of bio mom are old ones. When he was younger maybe a year or more ago. No recent ones.
But I see recent ones Terri took of Kyron. They were at the zoo and when they were a family.

maybe its a ruse and they are after Kaine. Its very strange. If she was a body builder, they take steroids - and those are not good for you mentally - however, this was not a crime committed in a rage -it was calmly planned out. There are also rumous that these people might have been swingers - I read that at blink but nothing really such rumors.

PORTLAND -- A threat related 9-1-1 call was made from the home of missing Portland boy Kyron Horman Saturday night, two days before the father filed for divorce and obtained a restraining order against his wife.
Kaine Horman recently moved out of the family home with the young daughter he shared with Terri Moulton-Horman.
The two 9-1-1 calls from the Horman home on NW Sheltered Nook Road were made Saturday evening. The first came at 5:17 p.m. and was a "threat" priority two call, meaning officers were sent in person, according to an emergency dispatch supervisor. They arrived at 5:25 p.m.
It was not clear whether the calls were placed by a woman or a man.
Later, a "custody" related call was made at 11:39 p.m. It was a priority four call, meaning officers did not respond in person, but a call back to the home was placed at 11:46 and the situation was resolved over the phone.
Dispatchers said Multnomah County placed a hold on both of the 9-1-1 calls made to the Horman’s address.

A call to 911 from the home of Kyron Horman's father and stepmother has been added to the police investigation of the 7-year-old boy's disappearance.
Caine Horman cited "irreconcilable differences" in his divorce petition.
Sheriff's officials would confirm only that someone had called 911 from Kaine and Terri Horman's home late Saturday, the same day that Kaine Horman reportedly moved out, taking the couple's young daughter with him.
The reason for the call has not been released, and police said the call is now part of their case into Kyron's disappearance. Two days later, Kaine Horman filed for divorce and a restraining order against Terri Horman, the last person known to have seen Kyron alive nearly a month ago.
A records search of Terri Horman under her current, maiden and previous married names turned up a DUI conviction in 2005 in which she pleaded guilty not only to driving under the influence, but also to "reckless endangerment of another."
Oregon State Police Lt. Gregg Hastings told ABCNews.com that the endangerment charge stemmed from the fact that her son, who was 11 at the time, was in the vehicle when she was stopped.
A spokeswoman for the court in Marion County, Ore., said Horman was sentenced to 12 months probation, a 90-day suspension of her driver's license and she had to attend alcohol counseling programs and attend a victim impact statement.
In addition, she wracked up nine traffic infractions, including several for speeding and one for driving with an expired license, between 1988 and 2004.
In the weeks that Kyron has been missing, his family seems to have crumbled, and experts said his parents' actions speak volumes, even as the two remain silent.

Jeanne, I am with you on the K's. I have called the little guy Korman, Kyron and Kyle.
If two 911 calls were placed over the weekend, could Kaine have been threatening Terri to tell the truth, or the other way around? Whatever it was, it was enough for a judge to agree to a restraining order on Terri and to top it off, she has no contact with Kailyn.

But to file the type of emergency restraining order that he did, Kaine Horman would have had to made the case that his wife posed an immediate threat to him or their 18-month old daughter, according to former FBI special agent Brad Garrett.
The restraining order prohibits Terri Horman from having contact with her other children, an older son and the toddler daughter. Kaine Horman is asking Oregon courts for sole custody of the little girl.
The order also prohibits Terri Horman from possessing any guns, according to The Associated Press.
The restraining order has been sealed by a judge who said he was concerned that releasing the entire document could jeopardize the investigation into the disappearance of Kyron.
Under Oregon law, the type of emergency restraining order granted to Kaine Horman would require some specific example of why there was an immediate threat of danger, Garrett said. So far, there's no word on what Kaine Horman could have told the judge.
"There's something under the surface here that we don't know about," Garrett told "Good Morning America" today. "There's got to be some pattern of abuse here. It's not something that all of a sudden happened and he decided to go to court."
Terri Horman, who has raised Kyron since infancy, has said virtually nothing in public about the June 4 disapperance of the little boy, appearing twice in solidarity with her husband and Kyron's mother and stepfather.
Terri Horman's name, however, was not on in a statement issued Monday night by Kyron's mother, father and stepfather.
"We have been fully briefed by law enforcement on the ongoing criminal investigation," the statement read, adding that the family was "in complete support of that investigation."
Mounting Suspicion, Few Answers in Kryon's Disappearance
Police have not named her or anyone else as a suspect or person of interest. Kyron disappeared from his elementary school after an early-morning science fair, where he was photographed smiling near his presentation on frogs.
Terri Horman told police that after touring the fair with Kyron, she last saw him walking down the hallway to his classroom. He never made it. Garrett noted that whoever took Horman likely planned the abduction as such decisions are rarely made spur of the moment.
Garrett questions whether police actions, including a reported six-hour interview with Terri Horman and the search of her home and car, and those of her husband could be part of a larger plan to get her to open up about the day Kyron vanished.
"It's almost like a psychological noose that they're pulling around," he said. "If we push her a little bit further, maybe she'll tell the truth."
A website devoted to the search for Kyron posted a message today that the site would be taken down at the end of the week, and that no more bracelets or buttons would be distributed unless through Kaine Horman.
The whole chain of explosive events, Garrett said, is unusual when there was no previous indication, at least publicly, that anything was amiss in the Horman family.
"It's very hard because with no history of any issues in this family and then Kyron disappears," he said.
Kaine and Terri Horman married in 2007. Their blended family included Kyron and Terri's older son and the couple's daughter.
Though police have told the public that Kyron's disappearance is an isolated incident, parents remain very on edge.
"For me it is still a daily worry," parent Coert Vonk said. "He's still in our thoughts and we all hope that he comes back really soon because everybodys scared."
Speculation has mounted in recent weeks that Kyron's stepmother might know more about the second-grader's disappearance than she had initially let on.
Her husband's decision to file for divorce Monday comes on the heels of an interview Terri Horman's father gave to People magazine, in which he was quoted saying there's a "50-50" chance his daughter would be arrested.
He now says his statements were twisted around and is staying with his daughter to support her.

I think that all was not good in that house before little Kyron's disappearance...I don't mean to offend anyone, but what kind of woman wants to go into female body-building? I don't like to look at them...Sorry, that's just me. Also, Kaine and Desiree divorcing before Kyron was born...Then, Terri moving in...Wonder was it to take care of Kyron, or to get close to Kaine? And the thing with her teen son moving out in March...Seems like a family that had a good facade, but had secrets, maybe secrets that were in danger of being exposed? I am very sorry for Terri if she is innocent...Her life has been destroyed, but LE must have something on her...or do they? What a mystery!
