Mental Health Experts Deposed Thursday In Case

ORLANDO, Fla. -- Prosecutors in the case against Casey Anthony questioned two mental health experts under oath Thursday...
In court filings, her defense said they want the two to testify to rebut allegations about Anthony's so-called "consciousness of guilt."
The defense claims the psychiatrists will help them explain Anthony's behavior during the time when prosecutors claim she lied to her families and investigators...

Sounds like a way to explain KC's behavior without her having to get on the stand and be cross-examined...Letting the psychiatrists explain it. Doubt if JA and LDB are going to let this happen without a fight.

In the months since Casey has been in jail, her hair has grown much longer and her clothes have run the gamut, from slim and trim to baggy and disheveled.

But WFTV learned that could all change. Casey could look very different next month.
WFTV legal analyst Bill Sheaffer says the defense is probably spending hours crafting an image for Casey to present to the jury from day one, and it might be a whole, new Casey.

Casey Anthony has looked drawn and disheveled in court, like she did at Wednesday's hearing; she's been in a red v-neck sweater and a pastel turtleneck; she's donned the librarian look, topped off with a tightly wound bun; and she's had matching outfits with her attorney.

Casey's demeanor Thursday seemed as gray and drab as her outfit, but her lawyers bring her clothes to court every day.

"She could've had an off day or it could have been orchestrated, where Mr. Baez was trying to underscore a theme," Sheaffer said (watch full interview). "This is a young woman whose life is hanging in the balance. He could've attempted to subtly influence the judge."

Sheaffer expects the defense is floating different images and that the public could see a reinvented Casey at trial, a young mother, conservative in dress and manner, bereaved, worried.

"You ain't goin' to a party. You ain't goin' to the prom. You are on trial for the first-degree murder of your child," Sheaffer explained.

The state commission that oversees the tax money paying Casey's legal expenses has not received any bills for image consulting and would object if it did. Sheaffer says she should appear interested, which might be why she takes so many notes. They could be working with her for hours on controlling her reactions, including laughing too much.

"Every movement, every facial gesture is going to be studied by that jury," Sheaffer said.

Sheaffer says the image Casey presents will have to be a consistent one, otherwise the jury might see it as nothing more than an act to portray herself as something she should be, but isn't.

Meanwhile, prosecutors deposed two defense doctors Thursday.

Dr. Jeffrey Danziger, a psychiatrist, was recently listed by the defense, along with another Florida doctor, who specializes in post traumatic stress disorder, to testify about Casey's state of mind.

Prosecutors will tell the judge Friday whether they object to the new witnesses and whether they want their own experts to examine Casey.

Also Friday, Casey and her defense team will be back in court at 9:00am to fight to throw more critical evidence out of the case. That includes the heart sticker found with Caylee's remains and a stain in Casey's trunk. Casey walked into the courtroom around 8:55am (see images | raw video), wearing a plaid shirt with a grey sweater over it, a pair of khakis, and socks with flats. Her hair was pulled into a very long pony tail, that she began twirling after sitting down at the defense table.

Things, though, got off on the wrong foot for the defense, and Judge Belvin Perry fought to keep lawyers on track.

No one from the defense team informed the court they would need a video conference set up for a defense witness. So, Judge Belvin Perry put the court in a 30-minute recess to set up the equipment. The court resumed at 9:30am.

Both sides debated all day about Casey's car that her mother, Cindy Anthony, said during a 911 call, smelled like there had been a dead body in it.

"And it smells like there's been a dead body in the damn car," Cindy said during the 911 call.

But Cindy's story would soon change outside the courthouse after Casey became a murder suspect.

"There was a bag of pizza for what, 12 days in the back of the car full of maggots. It stunk so bad you know how hot it's been," Cindy said while talking to reporters outside the courthouse.

Casey's lawyers tried to convince Judge Perry that the air tests done from the trunk of her car, which prosecutors want to use as evidence that Caylee's dead body was inside, are scientifically unreliable.

"My opinion is that it's impossible to say, at this point, whether it's valid or not," said defense expert Barry Logan.

But during the prosecutor's cross examination, Logan admitted to never having done that type of air testing himself and that he was basing his opinion on things he had read.

"Your lab does not perform that type of analysis on air samples does it?" asked prosecutor Jeff Ashton.

"No," Logan replied.

The question for Judge Belvin Perry is whether a machine can essentially smell where a dead body has been.

While the gas chromatograph has been used to detect plenty of airborne evidence in the past, this case would be the first time evidence of human decomposition would be gleaned from air.
Defense attorneys argue it's too new to used in a death penalty case.

"Although the gas chromatograph is well characterized and is used in a lot of different tests, in thousands of laboratories, when we set up a test for a new substance, we're changing the conditions we're changing the way in which the sample is prepared.

We're changing the way the results are interpreted," Logan said.

Casey is accused of murdering her daughter, Caylee Anthony, hiding her body in her trunk and then dumping it in the woods near their house on Suburban Drive.

WFTV legal analyst Bill Sheaffer said that after listening to all the testimony and cross examination, he believes prosecutors now have the edge in convincing Judge Perry to allow the ground-breaking air test evidence, which comes from research scientist Dr. Arpad Vass, from the Oak Ridge Laboratories.

"The prosecutor will show there's no debate in the scientific community that Dr. Vass's methodology and findings are not generally accepted," Sheaffer said.

Sheaffer said the evidence also has a better chance of coming in because it's not the only evidence that Caylee's body was in the trunk. Casey's family and cadaver dogs also indicated that there may have been a body in the trunk.

Also on Wednesday, there was a major concern that the case against Casey could be delayed because the courts are out of money.

However, an emergency loan that was ordered by Governor Rick Scott, will keep them open.

Wednesday's hearing was underway in courtroom 19 D when Judge Perry got the news that an emergency loan was on its way from Tallahassee; $19.5 million to keep the courts running through the end of May.

"I'm very happy to report the people of Florida will have a functioning court system," Perry stated in a news conference.

On Tuesday, Perry warned the courts would have had to shut down for several days in April and possibly two weeks in May, when the most high-profile case in the county's history is expected to start.

"It's tough. But there is light at the end of the tunnel," Perry said.

Judge Perry is expected to make a written ruling sometime later this week or next week.

Casey's trial starts on May 9.

Status hearing Friday, Apr. 8, at 9:00 a.m. They will be dealing with the motions about the stain in the trunk and the heart sticker. Also, may finish up business from the Frye hearing on Apr. 6. There may be some discussion of the two mental health witnesses that the state deposed today (Thurs.)

I haven't been following this thread too closely but on this video at about the 3;15 mark look at Caseys left hand. Imagine that. Also watch Baez stick his tongue out at the camera.

These two deserve each other. Imagine this in a murder one murder case.

I honestly believe if one potential jury member see that little clip all of the money and all of the experts will be down the toilet.

Just got here...Sims is arguing the motion on the unreliability of the death band on the hair testimony, saying that Karen Lowe from the FBI was not qualified to make that determination.

JA looks like he is getting very irritated...

Bozo is not there...just Sims and CM that I can see. KC has on her conservative plaid shirt today, but no sweater over it.

JA's response was brief and to-the-point. Sims is responding, trying to use a case that does not apply..CM is trying to help, JA interrupted, JP said, "One lawyer at a time!"

Bozo is here now...JP cut Sims off and said "Let's move to the next motion."

They are disputing the stain evidence in the trunk now.

JP is telling them that he doesn't want any editorializing or interruptions...All he wants to hear are arguments. He cut Bozo off when he started to laughingly comment on something. JP is seriously down to business today!
Bozo is arguing the motion about the stain in the trunk of the car. He is saying that the stain very well could have come from the "very wet" garbage or even from the gas cans. He says that there is NO proof that the stain had biological components.

Bozo says that the stain does not resemble a child in the fetal position and that allegation has caused hysteria...

JP is asking questions about the stain...Bozo is attempting to answer, stumbling around as usual.

From JP's questions, I'm thinking that he might exclude the stain...Thinking that it could have been caused by other things.

NO proof that the stain had biological components.

Per Baez. The State has evidence from an expert declaring that the blue light only picks up biological components. The stain was negative for DNA etc.
