Exam will unveil Josh Powell’s sexual history, preferences

Josh Powell last week suffered a setback in his quest to regain custody of his two children from his in-laws, Chuck and Judy Cox.

A Washington state judge ruled the husband of missing West Valley City woman Susan Cox Powell must undergo a psychosexual evaluation by a court-appointed examiner in light of explicit images found on a computer taken from the Powells’ West Valley City home during a 2009 police search.

Pierce County Superior Court Judge Kathryn J. Nelson ruled Charlie, 7, and Braden, 5, should remain with their maternal grandparents until at least the end of July. But what is a psychosexual evaluation and how could its results shape Josh Powell’s future?

“It’s kind of like a sexual profile of the individual. It’s a risk-assessment tool,” explained Mary Fan, a law professor at the University of Washington. “In Washington state, you see it in a number of decision points in the court process.”

While more commonly used in criminal proceedings where judges must assess how likely a defendant is to reoffend or determine housing and treatment, the evaluations can also be ordered in civil matters.

In Washington, licensed evaluators may examine police reports, child protective services information, criminal correctional history, interviews with the client and his family, and other data. At a minimum, they must address a description of the allegations against a person; a person’s sexual history and preferences; previous attempts to remediate problem behavior; and risk factors that may lead them to repeat problem behavior.

Risk factors can include a person’s stress level, alcohol and drug use, mood, sexual patterns, use of pornography, social and environmental influences, medical history, relationships, employment, education and family history.

Besides undergoing a paper-and-pencil evaluation, Josh Powell may possibly be subjected to a penile plethysmograph — which measures the bloodflow to a penis. The plethysmograph is administered with a strain gauge, which measures an erection response while a person is shown slides and tapes of normal sexual behavior as well as deviant acts.

Utah police are now desperate to speak with Josh Powell's father because they believe he knows vital information about the disappearance the crazed man's wife, Susan Powell.

After Josh killed himself and his two sons in a gas explosion on Sunday, police are left with many questions and few answers about Susan's 2009 disappearance. At the time of the incident, Josh was the sole person-of-interest in the case, but now detectives in West Valley City, Utah, are trying to speak with his father Steven Powell in hopes of learning more about what Josh knew.

Steven Powell is currently in a Washington state jail on voyeurism and child pornography charges, and was put on suicide watch after the news about Sunday's explosion.

'He is a person we are definitely interested in speaking with,' Sargent Mike Powell (no relation) told MailOnline.

'We have investigators in Washington right now they’ve been there since Monday but we are not shying away from the fact that we want to speak with him,' he said.

Sgt. Powell said that they have long thought that the elder Powell would have some vital information about Susan's disappearance because he lived with Josh and his two sons Charlie and Braden for some time after they moved to Washington.

'Josh was not cooperative with us during the investigation,' Sgt. Powell said.

For the past two years, Josh had been the only true person-of-interest in the case.

He claimed he took his young sons, then four and two, camping on the freezing winter night around 12.30am. He says he believes his wife ran off with another man.

Missing: Susan Powell has been missing since December 2009 and now authorities think her father-in-law may know something about her disappearance

Authorities searched the desert for twelve days in the area where Josh Powell said he went camping that night. At one point, they said they found a 'shallow grave' after cadaver dogs alerted them to the spot. But they found no human remains.

In the wake of the gas explosion, Susan’s parents- Chuck and Judy Cox- have spoken out about the revelations that their grandparents had made in the months leading up to the explosion.

'Over the Christmas holidays, Chuck (Cox) sent me an email saying something like "Real important- one of the boys says if we go to the mine we will find mommy,"' Ann Bremner, one of the Cox's lawyers who was focusing on the disappearance of Susan, told MailOnline exclusively.

Ms Bremner said that Mr Cox immediately told police about the boy's admission, but nothing was done.
Sgt. Powell confirmed to MailOnline that they had done ‘numerous searches’ of the area in question, all of which he described as ‘open terrain’ which included mines and desert.

‘Any information that comes in that we deem serious is looked into,’ Sgt. Powell said.

Josh Powell ushered his boys in the house and blocked the social worker from entering. She then called her supervisor saying she smelled gas, and moments later the house went up in a fiery blaze
Now all eyes turn to Steven Powell.

After Josh and his sons Charlie and Braden moved away from Utah following Susan’s disappearance, they moved in with his father Steven.

The children were later removed last year after Powell's father, Steve, was arrested for investigation of voyeurism and possessing child pornography.

Authorities had searched the home looking for evidence in Susan's disappearance and found child pornography and other troubling videos in Steve Powell's bedroom.

Prosecutors said that for at least a decade, he had been secretly filming women, including Susan Powell, and that he shot footage of two young female neighbours as they took baths and sat on the toilet. He remains jailed on $200,000 bail.

Josh Powell denied having any knowledge of the pornography.

The Powell family tragedy that stunned the nation will be explored on “Dr. Phil” and ABC’s “20/20,” both airing Friday.
In an interview with Dr. Phil McGraw, Susan Powell’s parents talk about the loss of their grandsons.

Powell has been missing since 2009. Her sons, 5-year-old Braden and 7-year-old Charles, died Sunday in a house explosion in Graham, Wash.

Their father, Josh Powell, killed them and himself. He had been a person of interest in his wife’s disappearance from their home in Utah.

“We were concerned all the time that he could do something,” Chuck Cox says about his son-in-law Powell.

“Dr. Phil” airs at 3 p.m. weekdays on WOFL-Channel 35.

On “20/20,” anchor Chris Cuomo looks at the story in a report called “Sins of the Father.” The program airs at 10 p.m. Friday on WFTV-Channel 9.

ABC News said, “Cuomo explores the lingering questions in the case: Did Josh kill his wife Susan back in 2009? If so, where is she? And is Josh’s father, Steve Powell, the key to the case?”

In September, Steven Powell was arrested and charged with 14 counts of voyeurism and one count of child pornography. He has denied the charges.

The boys’ funeral will be Saturday in Washington state.

Police getting new tips in Susan Powell murder case

SALT LAKE CITY (ABC 4 News) - Steve Powell won't talk.

He's facing voyeurism charges in Washington state but refuses to meet with police who are continuing to investigate Susan Powell's murder.

Police say he is part of the ongoing investigation.

"Absolutely," West Valley police Chief Buzz Nielson told reporters in Washington. "He's part of the people we talk to that we had some interest in."

Police in both West Valley and Washington say this part of the investigation is necessary despite the fact that Josh Powell and his two boys are dead.

"Well some body's got to speak for the kids," says Sgt. Ed Troyer of the Pierce County sheriff's office. "I mean it's going to be in the memory of a lot of people for a long time and Susan's still missing."

In Utah, police say tips are coming in that could help with the investigaiton.

Robin Snyder claims she recently met with police. She claims she saw Josh Powell and his two sons the day after Susan went missing in 2009.

Back then, Snyder says she at a Sandy hotel where she was in charge of overseeing the free breakfast for guests.

At the time she had no idea who Powell was or that anyone was looking for him.

"I was standing right behind Charlie," Snyder says. "And Charlie looked right up at me and he says 'do you know what happened to my mom?' so I say 'no what happened to your mom?'"


Before getting an answer Snyder was called to the kitchen.

When she came back she says they were gone.

Snyder says she recognized Powell a couple of days later in the news and called police. She says they never returned her call.

But she admits when she left information on the tip line she didn't get into details about what she is now saying.

A spokesman for West Valley police, Sgt. Mike Powell says "they've done an incredible job" of returning calls. But could not go into detail about this particular person because of a court order that prevents them from talking openly about the investigation.

And now a Salt Lake woman is telling police she saw Steve and Josh in the Topaz Mountains three-months before Susan went missing in 2009.

It's where police conducted a massive search this summer. There, they uncovered a shallow grave. But police won't won't discuss their findings.

The woman who wants to remain anonymous told ABC 4 News: "they weren't out there looking for crystals. If they were looking for crystals, they left that area."

She says Steven and Josh were not dressed for the outdoors and were in a vehicle that didn't match anything she's seen them drive in news accounts.

"They were not friendly at all," the woman tells ABC 4 News. "It was obvious they had their agenda and everyone else be damned. Their behavior was so out of the ordinary."

Steve Powell won't help Utah cops with Susan Cox Powell case

West Valley City police have said Steve Powell, father-in law of missing Utah mother Susan Powell, won’t cooperate with their investigation.

But now, it’s official.

Powell on Tuesday filed a notice in Pierce County Superior Court saying he doesn’t want to speak with the FBI, Utah law enforcement, or West Valley police. Powell said in the one-page filing he is asserting his right to remain silent and "does not wish to discuss or make statements of any kind regarding any subject matter, including, but not limited to, statements pertaining to any alleged or suspected criminal activity."


Powell, father of Susan Powell’s husband, Josh, is jailed awaiting trial on voyeurism and child pornography charges.

Josh Powell earlier this month murdered the couple’s two young sons, ages 7 and 5, and killed himself in a gasoline-fueled blaze in his Washington rental home.

Washington child protection workers had placed the children in the temporary care of their maternal grandparents after Steve Powell’s arrest in September. The boys and Josh Powell had been living in the Puyallup, Wash., home of Steve Powell.

The case of Susan Powell, who went missing from in December 2009, remains open. Her husband told police she disappeared after he took their two sons on a late-night camping trip in the Utah desert in the family’s minivan.

He's not going to do anything to help LE with finding Susan...That's just the kind of dirtbag he is. I really hope that he gets lots of prison time and a wonderful "welcome" when he gets there.

I don't understand that either. I can recall two other cases where a person refuses to cooperate and give the information that they know about a case. One was a public defender and refused to give the information that was told to her by her deceased client, even though this client's husband had given his permission for the public defender to talk. confused

I understand why he won't talk, just like Evila Baker, but really what does it matter in her case anyways. I just don't understand why they cannot make him talk or keep him in prison for the rest of his life.

Josh Powell’s father claims in newly filed court documents that Pierce County authorities illegally searched his house last year.

Steven Powell, 62, wants evidence seized during that search, including photos he allegedly took of young girls and his daughter-in-law, Susan Cox Powell, thrown out of court.
The subjects were naked or semi-nude in many of the photos and likely did not know they were being photographed, prosecutors say in court papers.

If Powell succeeds, prosecutors likely would be forced to dismiss the 14 counts of voyeurism and one count of possession of child pornography with which he’s charged. He’s pleaded not guilty and is to go to trial later this month.
Prosecutors intend to fight his suppression motion and are confident the evidence will remain admissible, Prosecutor Mark Lindquist said Tuesday.
“This is a case where law enforcement was especially meticulous,” Lindquist said. “They did things by the book.”
Lindquist said sheriff’s deputies searching for evidence in Susan Powell case – she disappeared from her Utah home in 2009 – found the photos and went back and got a second warrant to seize them.
Defense attorney Mark Quigley, who is representing Steve Powell, filed his suppression motion Monday. Quigley says police were on an unconstitutional “fishing expedition” when they searched Powell’s South Hill-area home in August.
Sheriff’s detectives wrote in a sworn affidavit seeking a search warrant that they were seeking seven journals written by Susan Cox Powell, who went missing under mysterious circumstances and is considered a homicide victim.
Josh Powell was considered a person of interest in his wife’s disappearance though he was never arrested or charged. Powell killed himself and the couple’s two young sons in Pierce County last month.
Detectives contended the journals are evidence in the woman’s disappearance, Quigley wrote in his pleading. The original warrants are under seal and not available for public inspection.
The detectives also requested permission to seize “any and all digital copies that would be stored on Joshua Powell’s computer(s) or digital storage devices, Steven Powell’s computer(s) or digital storage devices, and any other computer(s) or digital storage devices that Joshua or Steven Powell would have access to in any common part of the residence,” according to Quigley’s pleading.
The defense attorney argues in his motion that the detectives did not explain specifically “why these journals would have any evidence of criminal misconduct.”
Some of the journals apparently were written before Josh and Susan Powell were married, Quigley wrote.
“In sum, the affidavit fails to explain why the journals would lead to any evidence of criminal activity and what information they contain that could lead to that conclusion,” the attorney said.
Even if the journals were proper evidence, investigators had no cause to expand their search to digital files if the hardbound copies were available, Quigley added.
It was during their search for digital copies that they discovered the 2,000 images on which the charges against Steve Powell are based.
“The warrant sought seizure of the journals as its primary reason for execution, but the implicit reason was to conduct an exploratory, random, ‘fishing expedition’-style search of the Powell home seeking any evidence against Josh Powell,” Quigley wrote. “Such a search is the exact circumstance the Fourth Amendment was designed to protect against.”

Steve Powell’s attorneys ask judge to throw out evidence seized from his home

TACOMA, Washington (Isabelle Zehnder reporting) -- Attorneys for 61-year-old Steve Powell, father-in-law of missing Utah mom Susan Powell, filed a motion Monday to suppress evidence that authorities seized from his Puyallup home in September 2011.

The Motion to Suppress filed Monday claims the search was “overly broad” and violated Powell’s constitutional rights.

Authorities removed 15 computers from Steve's home and found thousands of voyeruistic and pornographic images taken "surreptitiously" - some were images of Susan. Some were little neighbor girls bathing and using the toilet which, police say, Steve apparently photographed through a telephoto lens from his window. He was arrested on Sept. 22 on charges of child pornography and voyeurism. His trial is scheduled later this month.

Fox13Now.com reports the latest move appears to be a last ditch legal attempt by Powell’s attorneys to avoid trial and a probable conviction.

Steve remains in jail on $200,000 bond. On Feb. 14, he filed a Notice to Law Enforcement Authorities exercising his fifth-amendment right to not speak to police in Washington State or Utah. He noted he was indigent, requested representation, and demanded legal counsel to be present during any contact by police.

Susan's husband, Josh Powell, was the only person of interest in Susan's disappearance before he murdered their sons and took his own life on Feb. 5, 2012. Following Josh's double-murder-suicide Steve Powell was named a person of interest in Susan's disappearance.

Just weeks after Susan's disapperance in Dec. 2009, Josh and his children, then ages two and four, moved into Steve's home until the time of Steve's arrest on Sept. 22, 2011. The children were then removed from their father's custody and placed into state custody until days later when they were moved to the care and custody of their maternal grandparents, Chuck and Judy Cox.

Police said the reason the children were removed from Josh's custody was because they could not rule out that Josh might have been involved in the child pornography found in Steve's home. Police said at the time of Steve's arrest they had found thousands of images and had only searched about five percent of images on the computers taken from the home.

Following Steve's arrest Josh fought to get his sons back. During a Feb. 1 custody hearing it is believed Josh expected to get his sons back.

Instead, Pierce County Judge Katherine Nelson ordered Josh undergo an extensive and intrusive psychosexual evaluation with polygraph. The recommendation for the test came from Dr. James Manley who had psychologically evaluated Josh. At the time of Dr. Manley's original psychological report he had not yet viewed some 400 images of sexual and incestuous cartoon images from Josh's computer seized by Utah police in 2009. Following his review of the images Dr. Manley recommended the psychosexual evaluation.

Days later Josh was scheduled for a supervised visit with his sons at his rental home in Graham. When social worker Elizabeth Griffin-Hall arrived at the home the children ran ahead of her to greet their father who said he "had a big surprise" for them inside. Griffin-Hall says he grabbed the children and locked the door. She knocked but was unable to get inside.

Within moments the house was in flames. Josh had doused the house with 10 gallons of gasoline, beat his children with a hatchet, and ignited a fire that killed him and the boys. He sent emails to family, friends, and his attorney. One of the emails said, "I can't live without my boys."

Susan's parents, Chuck and Judy Cox, are calling for changes in Washington State's DSHS and CPS systems.

Authorities removed 15 computers from Steve's home and found thousands of voyeruistic and pornographic images taken "surreptitiously" - some were images of Susan. Some were little neighbor girls bathing and using the toilet which, police say, Steve apparently photographed through a telephoto lens from his window. He was arrested on Sept. 22 on charges of child pornography and voyeurism. His trial is scheduled later this month.

No kidding who has that many computers in their home? No way will that evidence be thrown out.

The voyeurism and pornography trial for the father-in-law of missing West Valley City mother Susan Powell will not take place on March 20.

Sara Fleck, a criminal case manager for the Pierce County Superior Court in Tacoma, Wash., on Monday said the eight-day trial for 61-year-old Steve Powell will be continued to a later date because Powell’s attorneys are handling a homicide case that conflicts with Powell’s scheduled trial.

As the family of Steve Powell waits for the outcome of his pending trial on voyeurism and pornography charges, they have chosen to hold off on a funeral for Josh Powell, who killed himself and his two sons last month.

After the Powell family received criticism for trying to bury Josh Powell in a Puyallup, Wash. cemetery near the graves of the two boys he murdered,they decided to hold off on funeral arrangements until a later time, a Powell family cousin said.

Nicki Cardenas, a cousin of Josh Powell, said in a statement to The Salt Lake Tribune that the family has been subjected to anger from the public while trying to grieve for Josh Powell.

“There has been no funeral for Josh and I don’t know of any plans yet. We are waiting to see what happens with Steve’s trial,” Cardenas wrote. “It’s just too much for the family to handle all of this stuff at once.”

Cardenas wrote that some of Steve Powell’s extended family would like to attend his trial, but likely won’t be able to attend.

“ We are a family of very limited means, financially and we would love to rally around Steve, but he understands that none of us can afford to do it. I have spoken with Steve personally and told him I love him and he knows I am hoping for the best outcome so he can get back to his life, whatever is left of it,” Cardenas said.

A formal motion to continue has not yet been filed in court, but Fleck said the motion is expected in coming days. A judge will then reset the trial date.

Powell is charged with 14 counts of voyeurism and one count of possessing an image of minors engaged in sexually explicit conduct.

Trial continuances are not uncommon in the court system. Powell had previously been scheduled to start trial on Nov. 16, but that date was continued to March 20 to give attorneys in the case more time to prepare.

The Washington attorneys representing Powell earlier this month filed a motion to suppress evidence at the trial, arguing some evidence obtained by law enforcement — including a CD containing photos from a locked compartment in Powell’s bedroom — was gathered through an "overly broad" search warrant that violated his constitutional rights.

Powell’s attorneys, Mark T. Quigley and Travis Currie, who both work for the Pierce County Department of Assigned Counsel, wrote that the images at issue were found in Powell’s bedroom during an Aug. 25 search of his Puyallup, Wash., home. The search was conducted after Pierce County Detective Gary Sanders obtained a search warrant allowing him to seize journals belonging to missing woman Susan Powell, digital media that contained copies of Susan Powell’s journals, as well as "any other fruits or instrumentalities determined to be evidence of kidnapping, homicide and obstruction of justice."

While Sanders sought Susan Powell’s journals, he seized several CDs in Steve Powell’s bedroom in a locked compartment, Quigley and Currie wrote. They argue that taking the CDs violated Steve Powell’s Fourth Amendment rights.

"Nowhere in Detective Sanders’ affidavit are facts articulated why these journals would have any evidence of criminal conduct," Quigley and Currie wrote. "The affidavit does not describe what type of information may be in the journals, or how that information may be evidence of a crime. The affidavit provides no facts explaining how the journals could provide further intelligence of investigative leads. The affidavit fails to state facts which explain how the journals would preserve or safeguard the investigation."

Quigley and Currie argued law enforcement had already obtained Susan Powell’s journal written from January 2002 to October 2009, which included entries during the time she was married to Josh Powell — the only publicly named person of interest in the case before he killed himself and his two sons last month in a blaze set at his Graham, Wash., rental home.

The voyeurism and pornography trial for the father-in-law of missing West Valley City mother Susan Powell is now scheduled to take place May 7.

A Pierce County Superior Court Judge in Tacoma, Wash. on Friday granted a motion to continue the scheduled eight-day trial for 61-year-old Steve Powell. His defense attorneys are handling a homicide case that conflicted with Powell’s previous March 20 trial date.

Powell is charged with 14 counts of voyeurism and one count of possessing an image of minors engaged in sexually explicit conduct. He has requested a jury trial, slated to be heard by Judge Ronald Culpepper.

Trial continuances are not uncommon in the court system. Powell had previously been scheduled to start trial on Nov. 16, but that date was continued to March 20 to give attorneys in the case more time to prepare.

The Washington attorneys representing Powell earlier this month filed a motion to suppress evidence at the trial, arguing some evidence obtained by law enforcement — including a CD containing photos from a locked compartment in Powell’s bedroom — was gathered through an "overly broad" search warrant that violated his constitutional rights. An April 23 hearing has been scheduled on the motion.

The two attorneys also dispute Sanders’ allegation that Josh Powell and his father were uncooperative with police investigating Susan Powell’s December 2007 disappearance from the couple’s West Valley City home.

Steve Powell consented to two searches of his home, which he had been sharing with his sons and grandsons, before the August search warrant was issued, Quigley and Currie argued. He also was interviewed "multiple times" by the West Valley City Police Department, FBI and U.S. Marshal’s Office. Powell himself informed West Valley police about Susan Powell’s journals in a November 16, 2010 e-mail, Quigley and Currie argued.

Steve Powell also went on national television and posted contents of the journals on a website, [You must be registered and logged in to see this link.] to share the information, the defense attorneys state. Those actions "do not constitute criminally obstructive behavior," Quigley and Currie argued.

The two attorneys want the judge in Powell’s case to suppress the evidence on the CDs. Prosecutor Grant Blinn, who will file his response to the motion in the coming days, has said he believes the search was not illegal.

"The detectives were meticulous in their investigation, and I’m confident that the warrant will be upheld," Blinn said.

During an initial court hearing for Steve Powell last fall, Blinn said Powell took images over a 10-year span, although the court case focuses on voyeurism episodes from 2006 and 2007. Powell, who has pleaded not guilty, is being held in the Pierce County jail on a $200,000 bail.

Sheriff’s deputies from Tacoma, Wash., arrested Powell on Sept. 22 after detectives from West Valley City returned to search the home Powell shared with his son, Josh; his grandsons; and his adult children Alina Powell and John Powell. Detectives were looking for potential evidence in the case of Susan Powell, who disappeared from her West Valley City home on Dec. 6, 2009, and found images of the woman taken surreptitiously by Steve Powell, prosecutors have alleged.

Steve Powell has said his daughter-in-law made sexual advances toward him -- allegations disputed by Susan Powell’s friends and family. Steve Powell made national television appearances where he stated that he had romantic feelings for his daughter-in-law and that he wished their relationship had been more intimate than it was.

Susan Powell had reportedly told her husband’s sister, Jennifer Graves, of West Jordan, that Powell made her uncomfortable and sent her inappropriate nude photos of men in a package containing photos of her favorite movie star. Graves has said her sister-in-law also said that Steve Powell made remarks about Susan Powell "sharing" herself with him and his son.

Steve Powell has declined multiple jailhouse interview requests from The Salt Lake Tribune. He is currently in the county’s main jail and, with the exception of his attorney, is allowed to meet with visitors for only one hour a week.

With the exception Jennifer Graves, several of Powell family members have defended their father.

"The arrest comes as a surprise to all individuals I have talked to, especially those closest to my father," wrote Michael C. Powell, 29, who is a student living in Minneapolis, in court documents. "Everyone is of course saddened by it. The charges are not consistent with the way I know my father to behave."

Michael Powell wrote that he and his siblings do not intend to post bail for their father.

On a website created in January called "4thekidzz", which has since been taken down, Michael Powell wrote that he didn’t believe law enforcement has evidence to support the charges against his father.

"Laws in the state of Washington are very lax, such that there is no requirement to present evidence for an arrest until months into a criminal proceeding. This is why they have been able to keep my father jailed for months now without evidence," Michael Powell wrote. He claimed law enforcement fabricated charges to "inflict maximum damage to the Powell family’s reputation and long-term financial situation."

Graves, who is estranged from her father and siblings, has said that she was relieved her father was arrested so he could not victimize other people. She said Powell has a pornography addiction and she and her husband made it a point to never leave their children alone with Powell because of his history of questionable behavior.

She wrote in a declaration in support of having her nephews live with the Coxes that as a 12-year-old, she went on a work trip with Steve Powell and that he watched a television show involving naked women while she was in the room.

"Pornography has been an issue in this family for three decades. When my parents divorced, pornography was an issue during the proceeding," Graves wrote. "Joshua knew about the pornography then and his statements presently that he knows nothing of our father’s pornographic inclinations and material is untruthful."

An impending continuation of Powell’s trial raises the question of whether he may consider a potential plea agreement offered by prosecutors before he heads to trial.

Quigley has said he expects his client would not take a plea deal.

An attorney for Chuck and Judy Cox, Susan Powell’s parents, said the Cox family is hopeful Steve Powell’s trial may possible bring forth answers in the case of their missing daughter.

Steve Downing said that Chuck and Judy Cox are planning to attend part of Steve Powell’s trial. Powell’s attorneys filed a court document stating that Powell will not provide any information to law enforcement related to Susan Powell. But the Coxes are holding out hope, Downing said.

"They do hope that somehow, someway, information is obtained from or through that process that will lead them to the whereabouts of Susan," Downing said.

But he said it’s unlikely Susan Powell could be brought up at trial, since the charges Powell will be going to trial on are not related to her. Downing said a potential plea agreement could bring information about Susan Powell into the mix, however.

"If anything, any knowledge he may have, may impact any plea agreement that might be entered," Downing said. "I’m just hoping, and that’s all it is, that ... there will be enough pressure applied or there would be something that played on his conscience to disclose what he knows.

"I can assure you, my clients are never going to stop looking for her," Downing said.

Steve Powell Not Talking, Prosecutors Say No Deal Planned

(KUTV) WASHINGTON – The chief prosecutor handling the Josh Powell case says no deals are in the works or on the table with Josh's dad.

Steven Powell remains behind bars in a Washington jail on charges of voyeurism and child pornography.

Dan Rascon is in Washington and sat down with the county attorney about the Powell case.

This is a case that even top prosecutors who have dealt with all kinds of awful crimes can't believe.

With the death of Josh and his two sons, the one man left who may know something is Josh Powell’s father Steven.

But he's not talking.

Mark Lindquist is the Pierce County Chief prosecutor – the man who is overseeing the investigation into the horrific murder here at the home of Josh Powell.

Lindquist is also handling the disturbing case against Josh Powell’s father Steven.

Steven's is behind bars here at the Pierce County Jail on charges of voyeurism and child pornography.

Steven is the one man Utah investigators want to talk to.

But sheriff’s deputies say he's on suicide watch and saying nothing.

Lindquist says he wants to make one thing very clear about Steven Powell.

"No deal has been proposed to us by Steven Powell or his attorney. Absolutely no deals have been offered by us. If Steven Powell wants to start talking we’ll listen,” he said.

Steve Powell’s arrest last year is the reason Josh Powell lost custody of his children.

Josh is the only person of interest in his wife Susan Cox Powell’s disappearance back in December 2009 in West Valley City, Utah.

Attorneys in the Steven Powell porn case due back in court Friday

TACOMA, Wash — Attorneys involved in the voyeurism and child pornography case of Steven Powell are scheduled to be back in a Washington courtroom Friday.

A Pierce County Superior Court judge is expected to consider a motion to unseal a search warrant served on the Puyallup home of Steven Powell and his son, Josh Powell, in August of 2011. Prosecutors said they didn't intend to contest the motion and expected the documents would likely be unsealed.

Steven Powell, 61, has been in jail since September when he was charged with with 14 counts of voyeurism and one count of possession of materials of minors engaged in explicit conduct. He is accused of taking pictures of two neighbor girls, then ages 8 and 10, through an open window into their bathroom without their knowledge in 2006 and 2007.

The pictures were discovered during West Valley police's search of the Powells' home as they looked for evidence in connection with the disappearance of Josh Powell's wife, Susan Cox Powell. Susan Powell has been missing from Utah since 2009. Josh Powell murdered his two young sons and then killed himself by setting his rental home in Graham, Wash., on fire earlier this year.

Steven Powell's defense attorneys say the evidence collected from the Powell house should be thrown out because the search was unconstitutional. A hearing on that matter is scheduled for April 23. Powell's trial is scheduled to begin May 7.

Steve Powell consented to two searches of his home, which he had been sharing with his sons and grandsons, before the August search warrant was issued, Quigley and Currie argued. He also was interviewed "multiple times" by the West Valley City Police Department, FBI and U.S. Marshal’s Office. Powell himself informed West Valley police about Susan Powell’s journals in a November 16, 2010 e-mail, Quigley and Currie argued.

Those actions "do not constitute criminally obstructive behavior," Quigley and Currie argued.

Prosecutor Grant Blinn has said he believes the search was not illegal and is confident the warrant will be upheld. During an initial court hearing for Steve Powell last fall, Blinn said Powell took images over a 10-year span, although the court case focuses on voyeurism episodes from 2006 and 2007 involving two young girls who were his neighbors. Powell, who has pleaded not guilty, is being held in the Pierce County jail on a $200,000 bail.

Steve Powell is currently in the county’s main jail and, with the exception of his attorney, is allowed to meet with visitors for only one hour a week.

TACOMA, Wash. — A search warrant unsealed this afternoon has provided a series of revelations about Josh Powell's apparent involvement in his wife's disappearance, including that blood was found at the couple's Utah home after Susan Cox Powell disappeared.

Also revealed for the first time today:

--A witness told police that Josh Powell spoke of killing someone and disposing of a body, according to the search warrant.

--Charlie Powell, the couple's son, said "my mom is dead" as early as January 3, 2009, shortly after Susan Cox Powell disappeared.

--Susan Cox Powell's cell phone was found in Josh's car after she disappeared, and he couldn't explain why.

--Seven days after she disappeared, Josh Powell told their kids' day care center that the boys would not be coming back.

--Detectives investigating her disappearance found blood on the floor in the couple's Utah home and a tarp, shovel and gas can were found in Josh Powell's car, according to the warrant.

The new information came to light after a judge ruled that a search warrant that led to Steven Powell's arrest be unsealed.

Earlier, sources told KIRO 7 South Sound reporter Kevin McCarty the warrant would contain significant information relating to the disappearance of Susan Cox Powell, as well as Steven Powell's criminal case. Follow his updates @KevinKIRO on twitter.com.

Steven Powell, 62, was arrested in September on 14 counts of voyeurism and a single count of possessing child pornography. Investigators claimed they found thousands of hours of secretly recorded video Powell had taken of neighbors, including children. They allege Powell also had explicit photos of his missing daughter-in-law, Susan Cox Powell, which were taken without her knowledge.

The evidence was found after a search of Powell's home in Graham last summer by police from West Valley City, Utah. Detectives from that department notified Pierce County Sheriff's investigators that they had found the images and video while searching computers taken from Powell's home as part of their investigation into the disappearance of Susan Cox Powell in December 2009. Joshua Powell is now considered a suspect in that case. He died February 5 along with the couple's two sons, Charlie and Braden, after he assaulted the boys with a hatchet and set fire to a home in Graham during what was supposed to be supervised visitation.

Steven Powell's attorneys wanted the warrant unsealed as part of their motion to suppress the evidence used to charge him.

She even wrote that if she ends up dead, it is probably not an accident, even if it looks like one.

The sim card was Removed from her cell which was found in the off position in JP's car.

His cell was in his car and he lied and told officers he had it in the off position because he didn't have a car charger..yet, It Was Plugged In to the cigarette charger!

When he turned his cell into the police, there was no sim card in it.

Susan's blood was found in the kitchen.

He lied to his SIL and told her he was 'at work' and then re-canted and said he'd "gone camping".

There is SO much MORE!!

What were the cops and the FBI waiting for, a signed confession? This doesn't even include the porn that was found!!

I blame LE and the FBI for JP taking his children's lives. He should have been arrested as soon as they discovered the blood and the fact he was NOT cooperating. This makes me Livid!!

Authorities investigating the 2009 disappearance of a Utah woman found her blood in the family home and a hand-written note in which she expressed fear about her husband and her potential demise, according to documents unsealed Friday.

The files raise further questions about why Susan Powell's husband was never charged in her disappearance before he killed himself and their two young sons in a gas-fueled inferno in Washington state earlier this year. Investigators in West Valley City, Utah, never arrested Josh Powell or even publicly labeled him as a suspect in Susan Powell's disappearance.

A prosecutor in Washington state who was getting a first look at the files Friday said if it was his case, he would have charged Josh Powell with murder.

"There is direct evidence. There is circumstantial evidence. There is motive," said Pierce County prosecutor Mark Lindquist. "There is everything but the body."

The documents, used as justification to search the home where Josh Powell was staying last year, detail a widespread case that investigators had built against him.

Shortly after Susan Powell disappeared, authorities found blood evidence on a floor next to a sofa and determined that it was Susan Powell's. They found several life insurance policies on Susan Powell that totaled $1.5 million. The documents describe Josh Powell as unwilling to help in the investigation.

A safety deposit box used by Susan Powell had a hand-written letter titled "Last will & testament for Susan Powell," according to the documents. She wrote in that letter that she did not trust her husband and that they'd been having marital troubles for four years.

The letter also said that "if Susan Powell dies it may not be an accident, even if it looks like one," according to the documents.

Josh Powell always maintained his innocence and said he had taken their boys, then 2 and 4, on a midnight camping trip in freezing temperatures the night she disappeared.

One of the children, Charlie, told investigators in an interview shortly after Susan Powell disappeared that she had gone on the camping trip with them but did not come back home and did not know why, according to the files. A few weeks later, he told a church teacher with no emotion: "My mom is dead."

Powell moved with the boys to his father Steve's home in Puyallup, Wash., but Steve Powell was arrested and charged with voyeurism and child pornography last September. The boys were placed with Susan Powell's parents for their safety.

On Feb. 5 _ a few days after incestuous images found on his computer prompted a judge to order him to undergo a psycho-sexual evaluation _ Josh Powell locked a social worker out of his rental house, attacked the boys with a hatchet and then ignited the home in an explosive, gas-fueled inferno. The social worker was not injured.

Pierce County Sheriff’s Department spokesman Ed Troyer said his detectives would have arrested Powell “a long time ago” if this had been their case. He said a detective in Washington state was aware of the details gathered and that authorities here had been anticipating that Utah investigators would pursue an arrest.

“Obviously, it’s frustrating,” Troyer said. “We were always waiting for the phone call to go arrest him.”

Also the day LE went into Susan and Josh's home, besides SUSAN's blood found on the floor next to the sofa, there were fans on and aimed at the sofa which Josh said he had cleaned Sunday, the last day Susan was seem by anyone!!!!
How in the world can West Valley PD live with themselves? They should have arrested that POS long prior and they have the blood on their hands from the boys murder!!!!! MOO.

You all have Every Right to Rant!! I can't imagine what the WVPD was thinking. What were they waiting for?????

The Cox's Deserve an explanation from this group of good old boys! Nothing w/bring the boys back but I agree..they should sue them. I can't imagine how they are dealing with these newly released documents.

It gives anyone w/a deranged mind in Utah thinking they can kill someone and get away with it..and on that note, JP (Refuse to type his Name!) Said it was possible to put someone in the mine shafts in Utah and that's Exactly what he did. She will Never be found.

We all knew if they released the documents, there would be info that would shock us, but the part that gets me the most is that Susan herself wrote a "last will" saying if she died, it was at the hands of her husband. And, they did nothing!!

About the only good thing here is that Josh Powell didn't have a chance to reap what he thought was going to be his reward when he got rid of Susan. He thought he was going to just get on with his life and it didn't work that way. His father is in jail, his entire family will have to live with the memories of this nightmare that he created , but Josh isn't living and breathing anymore and I guess that's his Karma. It's the only real reward in this mess that he made.

I think the search warrant clearly allows LE to search all areas of Powell's home for the materials that were located...I don't think he has a case at all for the evidence being disallowed because it was illegally obtained.

If there's no recourse for the Cox's then that prosecutor should step down, immediately.
I'm still horrified at all LE did have that so incriminates Josh and they still made no moves to ensure that those two precious little boys were not in harm's way.

Within hours of Susan Powell’s disappearance in Utah in 2009, police began focusing their suspicion on her husband, Josh Powell. But the power of their case didn't become clear until Friday, with the release of search warrants that detail the astonishing fabric of deception Powell weaved in the hours after his wife went missing.

The documents, unsealed in Pierce County, Wash., reveal that police found Susan Powell’s blood on the floor of the home she shared with Powell, not far from a wet, freshly cleaned sofa. Her purse was undisturbed in the couple’s bedroom and her cellphone was in her husband’s car — a fact, one of many, he couldn’t explain.

Indeed, the documents are replete with evidence that Powell lied to nearly everyone around him about his whereabouts, secretly took the SIM card out of his wife's cellphone, canceled all her future chiropractor appointments and withdrew the money from her retirement account.

Meanwhile, Susan Powell had placed a will and a note in a safe deposit box, stapled along the edges with instructions that it not be shown to her husband. In it, she said her husband had threatened to “destroy” her if they got divorced and that, if she died, “it may not be an accident.”

The new revelations, contained in warrants obtained to search the house in which Powell was living in Puyallup, Wash., are again raising questions about why police in Utah never filed charges against Powell, who died Feb. 5 after attacking his two young sons with a hatchet and setting his home ablaze.

“Based on the facts we know, we would have charged Josh Powell with Susan Powell’s murder if it had occurred in Pierce County, but it didn’t,” said Mark Lindquist, prosecutor in Pierce County. Powell had returned there after his wife’s disappearance to live with his father, Steven Powell.

Police chief Thayle "Buzz" Nielsen in West Valley City, Utah, where the couple lived, said at a news conference Friday that the investigation remains open. “My department is committed to finding Susan and figuring out what happened to her," Nielsen said, according to the Salt Lake Tribune.

Lohra Miller, who was the prosecutor in Salt Lake County at the time of Susan Powell’s disappearance, told the Tribune that police never presented the case for full consideration. In any event, she said, the facts laid out in the search warrants were insufficient -- in her mind -- to bring a case without risk of reasonable doubt.

The documents also contain abundant new details about the apparent infatuation Powell’s father had for Susan — a fact he reportedly admitted to police following his arrest in Pierce County on charges of voyeurism and child pornography.

The elder Powell had photos of himself masturbating in front of a video image of Susan Powell, a photo of her in the bathroom in her underwear, apparently taken surreptitiously, and also several images of nude female bodies, their heads replaced with the face of Susan Powell.

Though Steven Powell has said he and his daughter-in-law had a flirtatious relationship, her journals show she thought he was a pedophile and a “negative influence” on her husband. She wrote of how she wished her husband would eliminate his father from his life.

The most compelling revelations center around the days after Susan Powell failed to show up for work on Monday, Dec. 7, 2009 — prompting friends and family members to try to figure out where she was.

Family friend Jovanna Owings, who had visited the couple the evening before, reached Josh Powell on his cellphone at 3:03 p.m. that Monday. He told her he was driving around town with his boys and was not aware that his wife had not shown up for work — though since the couple had only one car, he normally drove his wife to and from work.

Forensic work showed that Powell next drove 20 miles south out of West Valley City and called his own voicemail, followed by a call to his wife’s mobile phone, during which he left a message saying he and their two boys had just returned from a middle-of-the-night camping trip he’d taken them on the night before, and asking if she needed a ride home from work.

The problem with that story, according to the affidavit, is that Susan Powell’s phone was in her husband’s car on the center console, switched off (a fact he couldn’t explain when police asked him about it).

At 5:27 p.m., Josh Powell’s sister, Jennifer Graves, called her brother, asking him where he’d been. When he said he was at work, she accused him of lying, at which point he said he was camping and, not long after, hung up.

When he returned home about an hour later, a police detective asked why he hadn’t answered his phone all day, and Powell answered that he had had to keep the phone off to conserve the battery because he didn’t have a phone charger. “Det. Maxwell clearly saw Joshua Powell’s mobile phone sitting on the center console plugged into a cigarette lighter phone charger,” the affidavit said.

Asked why he hadn’t called in to report he would not be at work that day, Powell told police he had gone on the sudden camping trip to check out his new generator and had thought the next day was Sunday, not Monday. When he realized the mistake, he said, he figured he was going to be fired and so never called his employer.

When police searched Powell’s car, they found a generator, blankets, a gas can, tarps and a shovel, along with his wife’s cellphone — minus the SIM card.

Court documents related to the disappearance of Susan Powell show police had "everything but a body" to build a case against Powell's husband, leaving the woman's father to question why Josh Powell was still free last month, when he killed himself and his two sons.

"When I heard them [the new evidence], it was like, well, why didn't you arrest him already?" said Chuck Cox, Susan Powell's father. "Had he been to jail, my grandchildren would still be alive."

Josh Powell, who had been the primary person of interest in the case almost from the time his wife went missing in December 2009, set off an explosion in his Graham, Wash., rental home last month, moments after a Child Protective Services worker had dropped off his sons, Braden, 5, and Charles, 7, for a supervised visit.

The explosion, seconds after Powell pulled the boys inside the house and locked out the social worker, killed him and his boys.

Powell had moved back to Washington from Utah after his wife's disappearance, initially to live with his father, Steven Powell. He moved out of his father's house after the older man was charged with voyeurism and child pornography.

The newly released documents show that investigators had a lot of evidence linking Josh Powell to his wife's disappearance, according to a Washington State prosecutor who handled the charges against Steven Powell.

"There is direct evidence. There is circumstantial evidence. There is motive," Pierce County prosecutor Mark Lindquist told ABC News Seattle affiliate KOMO-TV. "There is everything but the body."

He said that had the Susan Powell case happened in his jurisdiction, he would have charged her husband with murder.

"The West Valley [Utah police] had a lot more evidence than we were ever led to believe," said Greg Skordas, Josh Powell's defense attorney and a former prosecutor in Salt Lake City, Utah. "We had a lot of statements, for example, from Josh that were clearly lies."

According to the documents, the last time Susan Powell was seen alive, a friend had been at her house, and told police that Susan suddenly "became tired after eating a meal that was prepared by her husband."

Susan then went to bed, and was never seen again.

The documents reveal that Susan's blood had been found on what had appeared to be a spot on the floor next to a sofa where Josh Powell had set up two fans.

Detectives also found a letter Susan had left in a secret safety deposit box in which she said her husband had "threatened to destroy her if they get divorced" and that if she were to die, "it may not be accident, even if it looks like one," KOMO-TV and The Associated Press reported.

After Susan Powell disappeared, her husband emptied her IRA accounts, KOMO reported.

The new documents say that Josh once bragged to a friend about "how to kill someone, dispose of a body and not get caught."

The documents opened Friday pertained to a case against Steven Powell, who last September was arrested and charged with using a telephoto lens to take photos of two young girls in the bathroom of a neighboring house. There reportedly were thousands of photos, and Powell was charged with 14 counts of voyeurism and one count of child pornography.

Jurisdiction for the case against Steven Powell falls within Pierce County.

According to the new documents, Steve Powell had taken photos of Susan Powell in secret, some in which she was fully clothed, others in which she wore only her underwear, one in which her legs were "slightly open, exposing her underwear."

His apparent attraction to his daughter-in-law has been raised before. In a 2011 interview with "Good Morning America," he said he had a flirtatious relationship with her that went "a little beyond the pale."

He described the relationship as "father-in-law-daughter-in-law flirting with each other, maybe some sexual touching or whatever."

"There's no question in my mind that the feelings were mutual," he said.

Cox, Susan Powell's father, said that he had wanted to protect his grandchildren, but now that they're gone, he just wants to find his daughter.

"We let the police do their investigation and hope that sometime we'll be able to talk to Steve Powell and he'll be able to tell her where she is if he knows."

Josh Powell has long been a suspect in his wife's disappearance, beginning with the police's initial search of the West Valley City, Utah, home the two shared with their boys. There, investigators found two fans drying a wet area on the rug where a red stain had been removed.

Josh Powell said that his wife had been cleaning the rug before she disappeared. He also told authorities that he had decided take an impromptu midnight camping trip with the boys in the midst of a blizzard, the night his wife vanished. Powell said he returned home to find his wife gone.

Later, he would blame his wife's mental state -- "extremely unstable" -- for her disappearance, while his father maintained she had skipped town with a man who disappeared from a Christmas party the night she vanished.

I wonder if Steven Powell is pissed at Josh. Steve would probably still be peeking in the bedroom and bathroom windows of his neighbor's homes, taking photos of young girls and getting away with it if it wasn't for Susan going missing and Josh being a person of interest in her disappearance. He can thank Josh for the fact that he's getting three hots and a cot!
