COMES NOW, Ms. Arias, by and through undersigned counsel to request that a
mistrial be declared based on the prosecutorial misconduct that has infested these
proceedings with a level of unfairness that cannot be cured by any other means. Ms.
Arias bases this assertion on the fact that the circus like atmosphere inside the courtroom
that to date has included counsel for the State yelling at witnesses, attacking witnesses on a personal level and throwing evidence. Not content with confining his misconduct to
inside the courtroom counsel for the State, pursuant to his own admissions, chose to
release evidence that was not coming into evidence at trial to the media and to pose for
pictures with his so called fans on the courthouse steps has turned what is supposed to be
a trial that comports with the rights due Ms. Arias pursuant to the 5th, 6th and 14th
Amendments to the United States Constitution and Art. 2, §§ 4, 15, 23, and 24 of the
Arizona Constitution into something that more closely resembles a modern day
equivalent to the Salem Witch Trials which ended in 1693. This State of affairs has
placed counsel for Ms. Arias in a position that they cannot fulfill the duties they owe Ms.
Arias, pursuant Arizona Rules of Criminal Procedure, Rule 6.8. Counsel’s inability to
fulfill these duties would thus result in Ms. Arias not having the benefit of the rights she
is due pursuant to the 5th, 6th and 14th Amendments to the United States Constitution.
Support for this Motion can be found in the attached Memorandum of Points and
Authorities that is incorporated herein by reference.
MEMORANDUM OF POINTS AND AUTHORITIES
I. RELEVANT FACTS
Opening statements in this matter were made on January 2, 2013. Since that time the
State has thrown evidence and his pen, yelled at nearly every witness who took the stand
in support of Ms. Arias and has hurled personal insults at defense counsel. In response to
this behavior Ms. Arias has had to make several oral motions for mistrial that have been summarily denied by this court. More recently Ms. Arias has had to make mistrial
motions because the State has not confined its misconduct to inside the courtroom. Most
prominent amongst this extra-curricular misconduct is his decision to pose for
photographs with his “fans” outside the courthouse steps where jurors could potentially
see him so doing. In further efforts to prove his case in the court of public opinion rather
than a court of law on April 4, 2013, the State unapologetically admitted that it had
released a plethora of damming evidence that would not otherwise come into trial to the
media. Pending before this court is a motion for mistrial based on the former, Ms. Arias’
motion for mistrial based on the latter was summarily denied.
Note should also be made of the fact that the conduct described above has
ramifications that effect the ability of Ms. Arias to present her defense as the public
response to this unprofessional conduct has involved berating witnesses via e-mail,
telephone and in various internet forums. Said action has not only caused personal
distress to these witnesses but has made it difficult for them to provide effective
testimony for Ms. Arias.
II. LAW AND ARGUMENT
In 2003 the American Bar Association created the standard that defense counsel
must meet in order to be effective, when the State seeks to impose death on an accused,
these standards are entitled Guidelines for the Appointment and Performance of Defense
Counsel in Death Penalty Cases. (henceforth ABA Guidelines) Wiggins v. Smith 539
U.S. 510, 123 S. Ct. 2527(2003). Of further note is the fact that, Arizona has also imposed the guidelines upon counsel as well through the dictates of Arizona Rules of
Criminal Procedure, Rule 6.8(b)(1)(iii). Thus, consideration of this motion means
considering whether or not, as it now stands, counsel can meet these standards. In this
regard a few guidelines standout; Guideline 2.1(C) which mandates that counsel be able
to operate in an environment that allows them to provide zealous advocacy, Guideline 4.1
B(1) and B (2) which mandates that Ms. Arias receive the effective assistance of experts.
As the facts above indicate, counsel for Ms. Arias cannot meet the dictates of these
guidelines when defense experts are being harassed inside the courtroom by the
prosecutor and outside the courtroom by those who chose to mimic his behavior in other
public forums.
In considering this motion, Ms. Arias also asks the Court to consider the
constitutional ramifications that arise when her attorneys cannot provide her with a full
and complete defense to which she is entitled during the guilt phase, California v.
Trombetta 467 U.S. 479 (1984) and cannot present any and all mitigation evidence
which could mean the difference between life or death such a state of affairs is not
constitutionally permissible Eddings v. Oklahoma 436 U.S. 921 (1978). Ultimately
then, counsel for Ms. Arias cannot provide her with effective assistance of counsel, to
which she is due pursuant to Strickland v. Washington 466 U.S. 668 (1984).
Furthermore, "[A] trial is unfair if the accused is denied counsel at a critical stage of his
trial." United States v. Cronic,466 U.S. 648, 659, 104 S.Ct. 2039, 80 L.Ed.2d 657 (1984).

III. CONCLUSION
Based on the facts and law cited above it is beyond legitimate dispute that the conduct
of the Prosecutor has placed counsel for Ms. Arias in a position where she cannot present
a complete defense and where she cannot receive effective assistance of counsel during
the trial and any potential sentencing phases. Thus, the trial at issue does not comport
with the dictates of the 5th, 6th and 14th Amendments to the United States Constitution and
Art. 2, §§ 4, 15, 23, and 24 of the Arizona Constitution meaning that at this point in time
that the only constitutional course is to declare a mistrial.

A key expert witness for murder defendant Jodi Arias admitted Monday under cross examination that she wrote a manifesto behind bars.

Prosecutor Juan Martinez mentioned the alleged manifesto for the first time Monday, stunning a packed courtroom audience.

"Do you remember when the defendant was in jail up in Yreka, [California] and the defendant’s manifesto ... Do you remember that was in your notes?" Martinez asked Psychotherapist Alyce LaViolette.

"I remember hearing about it [but] I've never seen it," she replied.

"Isn't it true that the defendant was signing or autographing copies of the manifesto?" asked Martinez.

"I believe those were my notes," LaViolette said.

Martinez interjected that Arias' writing of a manifesto appears to go against the idea that she lacks self-esteem – something LaViolette previously testified to. The domestic violence expert disagreed with his assumption.

"No, I don't think it does at all ... She may think she's a good writer ... but it doesn't mean [she has] high self-esteem," LaViolette said.

Martinez pointed out that Arias had asked someone to print out copies of the manifesto because she wanted them signed "in case ... she became famous."

The manifesto attributed to Arias was not entered into evidence Monday. The contents of it remain unclear. The Huffington Post has filed an official request with the prosecutor's office for a copy of the manifesto, but an official there said it could take some time for the request to be approved.

"In light of the prosecutor's ethical duties under ER 3.6, the State is seeking guidance from the Court on the nature and degree to which future public records requests could or should be fulfilled for the duration of the trial. Accordingly, the County Attorney's Office will cease fulfilling public records requests for materials in this case until such determination is made. While County Attorney Bill Montgomery fully respects the fundamental rights of a free press in our community, he is equally compelled to ensure a fair trial for Ms. Arias and any other defendant in similar circumstances. We'll follow up with you when we get a ruling and let you know what we’re able to release," Maricopa County Attorney's Office spokesman Jerry Cobb told HuffPost.

VICTIMS FAMILIES HAVE RIGHTS....and I would just say that move by Ms Lioviolette is one of the lowest things I've ever seen by an "expert" witness. YOU NEVER APPROACH THE VICTIM'S FAMILY if you are on the DEFENSE trying to get the murderer off!! I do not know how much more of this trial I can take!! Yes I do believe and I said yesterday that Alyce was admonished by the Judge and perhaps the mitigating attorney was questioned in chambers as well. BUT A MESSAGE TO JUDGE STEPHENS....I WILL ACCEPT NO MORE THAN AN OPEN COURT PUBLIC ADMONISHMENT FOR THIS WITNESS...maybe not in front of the jury but certainly to the public gallery so they can see what kind of woman she really is! To those who have worried about Alyce's career being affected by people outraged by her lies on the stand, I will say to you SHE HAS IT COMING!! If she's as experienced as she claims, she should certainly KNOW BETTER....and that she has her own CHEERING SECTION brought to this court to coach her on and nod and laugh and smile....makes me ill! For Sherry Perras Weinstien: Sherry, good question. You, as a trained Nurse have different instincts than a Police Detective. Generally speaking your instincts have to kick in faster and your actions must reflect this. In your case, Life or Death. A first responder, Police Officer, he/she must have sharp instincts attending a call, or better yet witnessing a crime in progress. They can get themselves killed, by not being intuitive, or for ignoring their instincts. A Detective, on the other hand comes after the crime. The Detective, now must start to figure things out, gut feelings, thoughts and possibilities, are flowing through his mind, the second he gets the call. Your question Sherry, was about Detective Flores, instinct's and patience with Jodi Arius, when he questioned her. Detective Flores, instinctive behaviour would kick in the moment he sat down in front of her. Now, remember he has done his homework on Jodi and is ready for her. Oh, shoot, she is a psychopathic/sociopath liar, go figure, now what. Nothing. He is a great interviewer and or interrogator. Rule #1. Everybody is going to lie to you, especially at first. He knew this, so he let her talk. The more she talks the more information he is processing about her. There were two occasions, he moved in for the kill [confession ]. I could see what he was doing and the moment he thought he had her he moved closer to her, to hear the confession, that never came. He then listened to his instincts at the end of the second interview, realized what he was dealing with and at no other time did he try for a confession. Had he continued, she would have made a fool of him. Detective Flores, is no fool. He knew 90% of what she was saying was untrue. He let her talk, then used her own story, to prove she is a liar, plus the physical evidence, to arrest her. Interviewing and interrogating, is an art form at first, then becomes a science as it moves along. Some Detectives are very good, a lot are not. Detective Flores, who was embellishing some of his questions for Jodi, was trying for the confession at that time. He knew she would lie, but he needed her to talk and say anything she wants. Then he himself, investigates her story. Detective Flores, is a tremendous asset to the Mesa Police.

Here is the second question answered by Boot Hill Loft, retired policeman, Sargeant, Detective, investigator plus private body guard. The question was asked about why Jodi would drag Travis' body back to the shower. Here is his take on that.

'The second question I recieved had to do with dragging Travis's body, the use of water and the clean up. First, you must understand that we are speculating, but we are using forensics, to help us. Jodi, planned the perfect murder. But unlike the Movies and TV, this one got away from our little psycopath. Started off great. Kill in the shower, easy to wash the DNA and or fibre evidence off the body. Clean up the place wash the sheets and leave.

Imagine her surprise, when Travis stepped out of the shower, not dead yet. Now she has a body 12' from the shower and what a bloody mess, the house is. Calm Jodi, now panics. Under the circumstances, time constraints and the huge undertaking before her. She throws buckets of water down the tiled hallway. This makes it easy to drag the body back into the shower. She then, showers standing over his body, that way she can clean herself up and wash any evidence from Travis's body, at the same time. The plastic cup, found under the body, just did no do the job. Jodi, then tries to clean the house, impossible, so she picks her time and leaves.

She did however, stay long enough to clean the bed sheets and some other items, she tried to clean up the blood, but gave up. The heavy use of water, only happened because; Travis did not die the way she invisioned it. Everything went well until the actual killing, from then on, her plan fell apart. In actuality, she almost got away with it. The camera and her bloody palm print, did her in. I must add, I believe, in spite of the evidence at the scene, she eventually would have still been arrested and charged with 1st degree murder.'

My question for you is....have you ever seen anything like the giggling, inappropriate courtroom behavior we've seen in this trial. laughing, snickering, etc from the gallery? Judge Stephens sets the tone and since she's continually allowed it....remember the saying, if you give someone an inch they will take a mile. She's lost control Boot. To answer your question; No, I have not experienced a trial, that has legs of its own. But I have seen it twice before. The O.J. Simpson trial and the Casey Anthony trial. The common denominators, massive TV and Media coverage, the tremendous ability to make money from this trial, plus all the distractions, that include the defendant,#1. Defense Council #2. Everone coming out of the wood work, either for fame and or money #3. A trial, that takes on a life of its own, almost every week, the actions of Jodi, her defence team and her family and witnesses.

Judge Stevens, for whatever reason, has made a tremendous error in judgement. I only hope she can last, without a mistrial. The trial is entertaining, only because of Juan Martinez.
