No deal was reached during Thursday's settlement conference for Jodi Arias, according to Maricopa County Attorney's Office spokesman Jerry Cobb.

The case is proceeding to the retrial penalty phase.

Lawyers on both sides of the Arias case were in court for the closed-door meeting as they tried to work out a settlement that could have put an end to one of the most-watched murder trials in history.

"She did the right thing from a legal standpoint," said defense attorney and legal analyst Ulises Ferragut who has closely followed the case. "I don't think this is necessarily, 'Jodi wants the spotlight.' I think this was a well-rehearsed and choreographed legal strategy."

Ferragut says as a result of her decision Thursday, she will retain all of her rights to appeal in the future. If she's sentenced to death, her case would automatically be reviewed by the Arizona Supreme Court, and could go all the way to the U.S. Supreme Court.

"Historically, the percentage of cases that get overturned on appeal for death row inmates is much greater, almost 50-percent conviction rate, that is overturned," Ferragut said. "Whereas, if she is not given death, her appeal chances are much lower."

No date has been set for a penalty phase retrial. A judge must first rule on a number of motions filed in the case. A new jury must then be seated.

After more than four months of testimony, a jury convicted Arias of first-degree murder in May. While they found her eligible for the death penalty, they could not unanimously agree to sentence her to it.

Since then, prosecutors and Arias' defense team have been preparing to retry the penalty phase. Arias' first-degree murder conviction is not at issue -- only her sentence.

A spokesman for the family of Travis Alexander told 3TV Thursday that they're pleased with prosecutor Juan Martinez and the county attorney's handling of the case. However, there will be no comment until the end of the sentencing phase.

Defense attorneys are accusing Juan Martinez, the lead prosecutor in the Jodi Arias case, of misconduct during her trial and the trials of other death penalty defendants. It is not an uncommon trick for defense attorneys to accuse opposing council of some sort of misdeed in order to get their client's conviction overturned or at least to get a judge to review the case. Juan Martinez has sent seven people to death row and has been accused of prosecutorial misconduct in all but one of these cases.

During the Jodi Arias trial, the defense took issue with Martinez's growing fame. The entire country was watching the Jodi Arias trial unfold as if it were the latest episode of "Keeping up with the Kardashians." Like most national trials there were spectators on both sides of the argument. A lot of people, including the prosecution, were not buying Arias' tale of killing her one time boyfriend Travis Alexander in self-defense. Martinez went after Arias day after day, causing her to break down on the stand a few times.

As a result of people wanting to see Arias go to jail, Martinez started becoming more and more popular. People would wait outside the Arizona courthouse for Martinez to emerge in order to get autographs and photos taken with the lawyer. In 2010, the Arizona Supreme Court was hearing arguments appealing the first-degree murder conviction of a man named Mike Gallardo. The defendant in that case was convicted and sentenced to death for killing a teen during a 2005 robbery. While it may be part of the game for defense attorneys to question the conduct of the prosecution it is almost unheard of for a Supreme Court Justice to do so.

During the 2010 appeals hearing Justice Andrew Hurwitz questioned the lawyer representing the Arizona Attorney's General's Office, the office that handles Arizona capital punishment appeals, about Martinez conduct at trial. The Justice accused Martinez of ignoring the trial judge's decision to sustain several of the defense's objections. "The conduct of the trial prosecutor. It seems to me at least on several occasions, and by and large the objections were sustained, that the trial prosecutor either ignored rulings by the trial judge or asked questions that the trial judge once ruled improper and the rephrased the question in another way."

Hurwitz continued saying, "short of reversing a conviction, how is it that we can...stop inappropriate conduct?" Details of Hurwitz questioning of the Attorney General came from a transcript of the hearing obtained by a reporter at azcentral.com. According to the transcript, another Justice, Michael Ryan, joined the discussion saying he remembered Martinez from past cases. "This same prosecutor has been accused of fairly serious misconduct...There's something about this prosecutor, Mr. Martinez." Past opponents of Juan Martinez describe him as "Teflon" and say as soon as you come up against him you are going to war.

Martinez has been accused of misconduct during the Arias trial as well as two other trials he was prosecuting this year. The trial of Richard Chrisman ended with a hung jury for Juan Martinez. Defense in that case accused Martinez of withholding information about a possible witness in the case. The defense said Martinez would not allow the defense to interview the witness. In the end, a judge had to step in and order Martinez to disclose information regarding the witness. In a case similar to the Arias trial Martinez sent a woman who killed her husband to death row.

Wendi Andriano said her husband was abusive and she killed him in self-defense. The defense in the Andriano case said Martinez tainted the jury when he introduced "marginally relevant" information about Andriano being a partyer and a man-chaser. During the Andriano trial in 2005, the defense said Martinez introduced evidence of the defendant's past crimes despite the judge ruling they should be withheld from the case. Jodi Arias' fate is still up in the air. Martinez was able to get a first-degree murder conviction, but the jury was unable to make a death penalty decision. Arias sentencing trial has been rescheduled a number of times and there is talk of a deal to be struck in order to avoid the death sentence.

REMINDER:

The next hearing will be on Nov. 1 at 1:30 pm before Judge Stephens. She will hear oral arguments on a number of outstanding motions in anticipation of a retrial of the sentencing phase. These motions include:

- Whether or not the def. can access jurors' Twitter accounts.
- A potential change in venue for the sentencing phase.
- A def. request to sequester the jury during the sentencing phase.
- A request to limit media coverage of the sentencing phase.
- Motion to question potential jurors individually.

What we can expect:

Since no deal was reached during a settlement conference on October 24, the case will proceed to a retrial of the penalty phase. Arias' murder conviction still stands, but a new jury will decide her sentence.

If the jury in the retrial cannot reach an unanimous verdict, Arias will automatically get life in prison. The judge would ultimately decide whether Arias will get life without parole or life with the eligibility of parole after 25 years.

It really is stunning to me that people are sending her things, giving her money and visiting her in jail. These individuals must surely be as depraved as she is.

Judge Sherry Stephens of Maricopa County Superior Court issued a brief order saying she explained her reasons for the denial during a closed-door hearing Friday.
Arias had said in a 12-page handwritten document that she no longer trusts attorney Kirk Nurmi and that he hadn’t seen her since May 23. That’s when jurors reached an impasse on whether Arias should be sentenced to life in prison or death for the 2008 killing of boyfriend Travis Alexander.
Stephens previously denied a request by Arias to fire Nurmi in June.

The Jodi Arias saga has held the nation's attention since the charismatic young woman was first arrested for the 2008 murder of her one time boyfriend Travis Alexander. All eyes were glued to the goings on inside an Arizona courtroom and now an Arizona news agency has been granted exclusive access into the forensics lab that processed the evidence in the Travis Alexander murder case. The evidence examined by Mesa Forensic Services would ultimately lead to Jodi Arias being found guilty of the first degree murder of Travis Alexander.

Arizona news organization 3TV was granted exclusive access to the lab and spoke with Kimberly Fiorucci, the facility's administrator about the Arias case. The night Jodi Arias killed Alexander the pair had been spending an intimate evening together, having sex and taking photos of one another in erotic positions. At some point the night turned tragic and Alexander was stabbed more than 20 times, his throat was slashed and he was then shot in the head. Once the crime scene was processed forensic scientists began to piece the night back together.

"It came down to, at that crime scene, documenting that scene. You don't know what's important. But visually, it's your one chance to see what's in the scene," said Kimberly Fiorucci to 3TV. The lab techs working the Arias/Alexander case where given all of the evidence collected at the crime scene and began checking for DNA to see who they could place at the scene when Alexander was killed. Fiorucci told 3TV that the procedure in the Arias case was no different than any other murder scene the processed.

In an example of their procedures Fiorucci explained to 3TV: "If we are given a shoe in the lab and they asked for DNA, we would say do you want who wore the shoe, do you want the blood that's on the shoe, do you want the tread mark to see if that was the print left behind the bottom of the shoe?" When Arias was first questioned by police she told them she was nowhere near Alexander's home when he was killed. DNA evidence processed by the Mesa lab proved Arias was lying.

When 3TV asked Fiorucci what the odds were the DNA evidence was wrong or flawed somehow she responded "We're talking in the quintillions. Over a million times the Earth's population." DNA was not the only link connecting Arias to Alexander's home on the night of the murder. Arias' bloody hand print was discovered on a wall of the house as well as strands of her hair. When presented with this evidence Arias changed her story saying she was at the house when the murder occurred but did not do it.

Arias invented a story about masked intruders killing Alexander but sparing her life. The DNA evidence was once again presented to Arias who admitted she killed Alexander, but in self-defense not cold blood. The DNA, photos and other things taken from the crime scene convinced the jury Arias was guilty and they pronounced the verdict as such. The same jury could not decide if Arias should be sentenced to life in prison or be given the death penalty. A new jury is going to be sworn in to determine her fate. No trial date has been announced.

PHOENIX -- A bloody crime scene. A murdered man. And a mystery that caught the nation’s attention.

The pictures told the story of Travis Alexander’s final hours after he was stabbed and shot by Jodi Arias.

“It came down to, at that crime scene, documenting that scene. You don’t know what’s important. But visually, it’s your one chance to see what’s in the scene,” said Kimberly Fiorucci, Administrator of Mesa Forensic Services.

The crime scene investigators who documented – in graphic detail – what happened inside Alexander’s home back in June of 2008 work at the Mesa crime lab that Fiorucci is in charge of.

There is an increased focus on what happens inside the lab, and labs like this across the country. 3TV was given exclusive access.

All of the evidence that helped convict Jodi Arias was analyzed in this lab.

As they do in every case, the techs scan each item looking for DNA.

When we sat down with Fiorucci, she gave us this example.
“If we were given a shoe in the lab and they asked for DNA, we would say do you want who wore the shoe, do you want the blood that’s on the shoe, do you want the tread mark to see if that was the print left behind the bottom of the shoe.”

Fiorucci fell in love with the idea of solving mysteries back in high school while reading Patricia Cornwell novels.
“Back then crime labs weren’t very publicized” she said.

Now, there is increasing demand for DNA evidence because, unlike eyewitness testimony, it is hard to refute.

First they look for DNA. Then they work to create a profile.

In this lab alone there are 350 cases pending.

But Fiorucci points out, their job is not to solve the case for police or prosecutors. Their job is to find what the science shows.

“So if it’s not beneficial to the prosecution and it’s beneficial to the defense, that’s okay,” Fiorucci told 3TV. “We don’t go into it with the mentality that we are trying to solve a case for one side or the other.”

In the case of Jodi Arias, despite her repeated denials, DNA discovered in this crime lab told the story of what happened in June of 2008.

When asked what the odds are that DNA could be off, Fiorucci said, “We’re talking in the quintillions. Over a million times the Earth’s population.”

Because of that DNA evidence, and the extensive photos taken at the crime scene, Jodi Arias eventually changed her story and admitted that she killed Travis Alexander.

While she was convicted of first degree murder, she’s about to get another trial to decide whether she should live or die.

And once again, the work being done in this quiet lab in Mesa will be on display for all the world to see.

Live television coverage of Jodi Arias' penalty phase retrial will be banned and the case will remain in Phoenix despite defense arguments that intense publicity will make it difficult to find impartial jurors, a judge ruled this week.

Arias was convicted of first-degree murder in May in the 2008 stabbing and shooting death of boyfriend Travis Alexander in his suburban Phoenix home. The same jury failed to reach a decision on whether she should get the death penalty, setting the stage for a second penalty phase.

Under Arizona law, while Arias' murder conviction stands, prosecutors have the option of pursuing another penalty phase with a new jury in an effort to get a death sentence. If the second jury fails to reach a verdict, the death penalty would be removed as an option, and the judge would sentence Arias to either spend her entire life behind bars or be eligible for release after 25 years.

Arias' first trial garnered worldwide attention with every minute of the case broadcast live. Judge Sherry Stephens is hoping to minimize the spectacle this time by banning live television coverage.

"The court expects there will be significantly less media coverage of the case during the retrial of the penalty phase," Stephens wrote in a ruling published Friday.

The judge also banned the use of all electronic devices inside the courtroom, meaning reporters won't be able to use Twitter, as occurred during the first trial, to deliver the public real-time updates.

Arias' lawyers wanted the retrial moved out of the Phoenix metropolitan area because of excessive publicity, but Stephens ruled the move wasn't necessary as she plans to summon 400 prospective jurors.

"Jurors with preconceived notions about the appropriate sentence will be excused," Stephens wrote.

She also denied a defense motion to sequester the jury for the duration of what is expected to be a two-month trial.

No retrial date has been set.

Arias, 33, admitted she killed Alexander but claimed it was self-defense after he attacked her. Prosecutors argued it was premeditated murder carried out in a jealous rage after the victim wanted to end their affair and planned a trip to Mexico with another woman.

Jodi Arias was back in court today for a hearing. The hearing comes before the penalty phase of the Jodi Arias retrial.

In May a jury convicted Jodi Arias of the 2008 murder of her Travis Alexander. The Jodi Arias jury couldn’t agree on whether to sentence the former waitress to death of life in prison. A second penalty phase of the trial will determine her fate, but the retrial hasn't been scheduled. Prosecutors want the death penalty.

Jodi Arias Judge Sherry Stephens ruled that live television coverage of the sentencing phase of the retrial will be barred.

Jodi Arias' prison cellmate says the convicted murderer threatened to have people "on the outside" kill prosecutor Juan Martinez and seriously questioned why he didn't love her.

Cassandra Collins, who shared a two-bunk cell with Arias before her murder trial told MyFoxPhoenix.com that if she got the death penalty, she would take revenge against Martinez.

"He need(s) to get good security staff around him to make sure she can't get anybody on the outs(ide) to solicit something -- to harm him or to hurt him. She's very dangerous -- very dangerous," Collins said.  

Arias was convicted of murder in May in the 2008 death of boyfriend Travis Alexander in his suburban Phoenix home. Jurors failed to agree on her sentence, setting the stage for a second penalty phase.  

Collins told the station Arias tried to "manipulate" other inmates into believing her side of the story. When she visited her jail area in January, all of her cellmates reportedly had signs reading, "Jodi is innocent" and "Free Jodi."  

The Maricopa County Attorney's Office told MyFoxPhoenix.com it was looking into Collins' claims.

Meanwhile, Arias' attorneys said Tuesday want a judge to compel jurors in her penalty phase retrial to reveal their Twitter user names so the accounts can be monitored to ensure they aren't communicating about the case.

During a hearing, defense attorney Kirk Nurmi argued that Arias needs juror Twitter accounts to ensure they are not being influenced by outside elements. Martinez has called it an invasion of juror privacy. The judge hasn't ruled.  

Judge Sherry Stephens is banning live television coverage of Arias' sentencing phase retrial as prosecutors again seek the death penalty.

An Arizona judge is refusing to require jurors in the next phase of the Jodi Arias trial to reveal their Twitter usernames so their accounts can be monitored for communications about the case.

They are maybe the two highest profile female criminals in Arizona. One of them has been on death row. One of them may soon be going there -- and both of them are going to be in court Friday.

Debra Milke was convicted of taking part in the murder of her young son more than 20 years ago.  She was recently released from prison and may be re-tried.

Jodi Arias is facing a re-trial in the sentencing phase of her murder case and could take Milke's place on death row.

And there's another connection between the two women.

For a short time earlier this year, Milke was moved from Perryville Prison to the Maricopa County Jail so she could attend court hearings in her case.

Arias found out about that and made efforts to get Milke in the cell right next to her.


Milke was on Arizona's death row for over two decades.  Arias may soon be headed there, so maybe it's not that surprising to learn that when Milke was going through new court hearings this year and was briefly put in the Maricopa County Jail, Arias sent a request to jail administrators, according to the sheriff's office.  That request: Would they put Milke in the cell right next to her?

It's as close as you can get in this unit where women are housed one to a cell and the only way to speak is through a small metal grate in the door.

The request was refused.  A sheriff's office spokesperson releasing a statement saying simply, "We don't allow inmates to pick their cellies.. this isn't a hotel."
We all know if it were a hotel  STABBY would be tweeting for room service!

Why did Jodi want her so close?

"Maybe to get advice.. Debra has been through this before... What am I facing.. what are the lawyers going to do for me? Do I have any hope?" said Paul Huebel.

Huebel, a private investigator and former reporter who is set to testify in Milke's case.  Like Arias, Milke gave a controversial interview just after her conviction.

"The day before she was sentenced to death, she gave me an exclusive interview for Channel 10 right here, against her attorney's advice," he said.

But while Milke basically stayed silent in the decades since that interview, Jodi continues to share her feelings, sell her artwork and respond to media reports through her Twitter account.

Milke is now a free woman awaiting a new trial after a confession in her case was thrown into doubt.  The only way we've seen her is in this video on her Facebook page, reuniting with her mother -- the two sharing a long embrace and then posing for photos and a still picture inside the same house, holding a flower.

She is not speaking publicly at all, but is happy she is free for now.

"She's enjoying her freedom.. she's enjoying learning about technology.. just the changes that have happened in the last two decades since she's been locked up," said Huebel.

And she's staying quiet until her case is settled.  And even though she didn't get to ask her in person, maybe it's advice Jodi might still take as she faces the possibility of her own time on death row.

Both Arias and Milke will appear in court Friday.  And both are crucial hearings.  We may find out if that questionable confession of Milke's will come into a new trial and we may finally have a trial date for Arias' penalty phase.

An Arizona court has scheduled a date for convicted murderer Jodi Arias' sentencing, in spite of her legal team's efforts to push back the ruling.

Arias' sentencing has reportedly been scheduled for February 2014, according to a Facebook post written by the deceased's brother.

Arias was found guilty of stabbing ex-boyfriend Travis Alexander 30 times, slitting his throat and shooting him in the face earlier this year, but a Maricopa County Court Jury couldn't decide on a sentencing - the prosecution was pushing for the death penalty while Arias' defense team tried for life in prison.

But now, it seems that the heavily-covered murder trial might soon come to a close - Alexander's brother Steven released the date for her sentencing on the Facebook page, "Justice for Travis."

"Letting everybody know the trial isn't due to start until mid-February," Steven wrote online. "We believe this is a tactic to try and get us to throw in the towel. We will not! I say it again, it won't happen."

Steven then went on to say that the Alexander family would maintain their call for the death penalty for Arias.

"Our family will come together and see it through until it is finished," he wrote. "There is a monster that haunts us, but once the correct sentence is given, it's her who will be haunted until the most humane punishment comes to her. Nothing compared to the sentence she gave to a good man."


Jodi Arias' defense team most recently tried to get the location of the trial moved out of Phoenix due to the heavy media and public attention, but the motion was denied twice by Maricopa County Superior Court Judge Sherry Stephens.

Does anyone know how to report a fb group to get it removed from fb? This group showed up on the side of my fb page and I went to check it out, because it said something about "open Jodi group" and it's actually called "Free Jodi" and I'd like to see it removed. A whole lot of delusional people posting there about how poor Stabby was so innocent.

Jodi Arias wanted to kill prosecutor Juan Martinez if she got the death penalty in her trial, her former cell mate says.

The first phase of the trial ended without a definite sentence, prompting a second phase that begins on Friday. Arias could still get sentenced to death.

Arias “is very dangerous,” Cassandra Collins, the former cell mate, told Fox News.

Collins said that Arias vowed revenge if Martinez succeeded in getting the death sentence.

“She said that if she was given the death sentence, she wanted to get her revenge,” Collins said. “She knows inmates on the outs to do a mafia bow tie, cut his throat.”

Collins said that Arias underwent a prison-wide campaign to convince the other inmates of her innocence. “She’ll try to suffocate you with her version and her side,” Collins said, adding that it was a form of manipulation.


In addition, Arias seemed to have a strange fascination with Martinez.

“She asked me questions like ‘why doesn’t Juan Martinez love me?’ And I’m like, love you? He’s your prosecutor.. he’s there to prosecute you for a crime.. and I’m like why doesn’t he love you?”

Collins said tha tArias appeared to be “out of her freakin’ mind.”


On the other hand, Arias later told Fox News that the claims were not true. She tweeted that ”to comment on the babblings of a lunatic is lunacy itself. (oops).”

And her defense team asked for a change of venue because of what Collins said. However, that request was not given.

The next hearing in the trial is scheduled for January 3, according to Steven Alexander, the brother of Travis Alexander, who Arias murdered.

However, the actual trial isn’t due to start until mid-February, he said.

“We believe this is a tactic to try and get us to throw in the towel. We will not! I say again it won’t happen,” he said via the “Justice for Travis Alexander” Facebook page. “Our family will come together and see it through until it is finished. A hearing in the Jodi Arias trial on Friday, January 3 yielded no re-trial date.

The closed door hearing–the public and media have been barred from the trial since late last year–did not end in a set date for which to re-start the trial.

The next oral argument regarding the set date is scheduled for January 13 at 9:30 a.m., according to the blog Court Chatter.

“As parties emerged from the courtroom, prosecutor Juan Martinez looked pleased while [Arias attorneys] Kirk Nurmi and Jennifer Wilmott did not,” the blog said.

Troy Harden of Fox 10 in Phoenix commented via Twitter on not being allowed into the court room again, a recurrence that has frustrated reporters and some members of the public.

Judge Sherry Stephens has held hearing after hearing behind closed doors as the next steps of the case unfold almost entirely under a shroud of secrecy after the trial began with complete transparency and easy access, reported AP.

“Over the last several months, she has heard arguments over sequestering the new jury, moving the case out of Phoenix, Arias’ desire to fire her lead attorney and allowing live television coverage of the retrial, among other issues,” it reported in December. “She has denied each request, but quietly with orders released days after the secret hearings as the case languishes without public scrutiny even as Arias’ legal tab is being picked up by taxpayers at a cost exceeding $1.7 million.”

“The trial court has gone from transparency to blackout and bewilderment,” said attorney David Bodney, who represents several media outlets, including the Arizona Republic, fighting for transparency. “There have been repeated flagrant violations of the public’s constitutional right to attend proceedings.”

But Phoenix defense lawyer Mel McDonald, a former Maricopa County judge and federal prosecutor, said that Stephens likely didn’t expect the nationwide publicity and coverage that the trial garnered, and is trying to maintain a court room that can find “an impartial jury” and not risk “prejudice and error.”

Arias was convicted of killing her boyfriend Travis Alexander in 2008, but the first phase of the trial ended without a definite sentence, prompting the second phase that is in the scheduling process right now. Arias said she killed Alexander but in self-defense.

Prosecutors wanted another phase to try to get the death penalty for the 33-year-old.

She often uses the social media platform to solicit donations and promote her original drawings. However, a few days after Christmas, she tweeted what seems to be her frustration with not being able to directly control her blogs from her jail cell.

"The problem w/ blogging from jail is that I am completely reliant upon the person whom I've entrusted to post my entries," wrote the 33-year-old on Dec. 29.

"So when that person takes liberties w/ my blog and posts things I didn't authorize (or author), there's not much I can do about it other than hope the one pulling the strings removes it--then blame self 4 lacking discernment w/ whom I entrusted control over my blog," she continued.

Arias was convicted of first-degree murder on May 8 in the ghastly 2008 death of her ex-boyfriend Travis Alexander in his suburban Phoenix, Ariz. home. However, the same jury that found her guilty failed to reach a unanimous decision on her sentencing. As a result, her retrial will be held to determine whether she should be sentenced to death, life in prison or life with a chance of release after serving 25 years.

According to the Epoch Times, the next hearing date is scheduled for January 3, while the trial is set to start in mid-February.

Alexander's family accused Arias of trying to push the date back for her next trial in order to thwart their efforts. However, Alexander's brother, Steven, declared that they have not been deterred. On Facebook, he revealed that the sentencing trial for the "monster that haunts" his family will begin in February of next year.

Jodi Arias: Judge sets date for retrial of penalty phase

PHOENIX -- After months of legal wrangling, a judge has finally set a date to retry the penalty phase in the ongoing legal drama that is the Jodi Arias murder trial. It will begin March 17, a little more than two months from now.

The trial began more than a year ago, ending four months later with the conviction of Arias on first-degree murder.

While the jury found that Arias is eligible for the death penalty, they were not able to sentence her to it.

The past several months have been filled with motions, mostly from Arias' lawyers.

The defense wanted the trial moved out of Phoenix, citing intense media coverage. Judge Sherry Stephens denied two separate motions.
The defense also wanted to monitor the Twitter handles of the new jurors. Stephens denied that motion, as well, saying she was not going to assume that there will be juror misconduct.

In November, Stephens banned live television coverage of the new trial. The guilt phase of Arias' trial, with its graphic photos and testimony, was broadcast in its entirety -- all four months of it.

In her decision, Stephens said she expected "significantly less coverage of the case during the retrial of the penalty phase."
In addition to motions filed by attorneys for both sides, Arias herself made a request of the judge. She said she no longer trusts Kirk Nurmi and asked to fire him. Stephens denied the motion. She denied a similar motion Arias made in June.  karma 
A settlement conference could have put an end to the legal maneuvering and the need for retrial. No deal, however, could be reached. With no settlement, Arias retains her right to appeal her first-degree murder conviction down the road.
Through all of these motions and decisions, Stephens held off on scheduling the retrial of the penalty phase.

On Monday, she finally set a date.
This retrial deals with just the sentencing of Arias. Her conviction on first-degree murder is not in question.

A new jury will be seated and can choose to hand down the death penalty or sentence her to life in prison. If they, like their predecessors, cannot reach a unanimous decision, Arias automatically will be sentenced to life and it will be up to the judge to decide if Arias will be eligible for parole in 25 years.
In Arizona, only a jury can sentence a convicted killer to death. If that is their decision, the case will automatically be reviewed by the Arizona Supreme Court.
It's not clear how long it will take to seat a jury, nor is it known how long the retrial will last. Because the jury will be new to the case, it's expected that prosecutors and defense attorneys will need to go back over evidence presented in the original trial in order to lay the groundwork for their arguments regarding Arias' sentence.

Cannot imagine a seated jury at this point in time. One would have to live under a rock not to know about this case..especially in Maricopa County, AZ.

Hmm, I'll believe it when it actually happens. They've been pushing it back forever. I'm at a point now where I don't care anymore if she gets death or life in prison. As long as she's never released. Stephens also needs to stop her from tweeting during the retrial - or having her "friend" do it for her. So sick of her.

Sam I could not agree more. I'm sick of  STABBY I feel so sorry for Travis' family because she truly is the ultimate example of a reoccurring nightmare!
I think it's ironic the Defense is so concerned about the Social Media Accounts of the Jurors when their ignorant client (or whoever it is) is tweeting about selling wristbands to help pay for her appeal.

Although the convicted murderer is forbidden from accessing cell phones or computers while she sits behind bars awaiting her sentencing trial, she often uses Twitter to declare her innocence and solicit donations. However, that may soon come to a halt. On Wednesday she tweeted "I'm going radio-silent soon," adding, "but first a few things" followed by information and an article regarding a recent study that discovered varying levels of arsenic in over 60 rices and rice products.

"Stop eating brown rice. It has toxic levels of arsenic. Ditto 4 brown rice syrup & brown rice powder. Check cereal, energy bars...BABY FOOD," tweeted the 33-year-old boyfriend killer.

A sentencing retrial to decide whether convicted murderer Jodi Arias will get life in prison or the death penalty has been pushed back from March 17 because of a prosecutor's scheduling conflict.

The Arizona Republic reports prosecutor Juan Martinez is supposed to begin another potential death penalty trial on May 12.

In a hearing Tuesday in Maricopa County Superior Court, Presiding Criminal Judge Joseph Welty ruled the trial of a man accused of killing a Phoenix-area police officer in 2007 will go first. It's the oldest capital murder case in the county awaiting trial.

Welty left the rescheduling of Arias' penalty phase retrial to Judge Sherry Stephens.

The 33-year-old Arias was convicted last May of killing her boyfriend, Travis Alexander, at his suburban Phoenix home in 2008, but the jury couldn't reach a verdict on her sentence.
