Police arrested a woman in connection with a child abduction case even though she is not a suspect in the child's disappearance.
Instead, Tammi Smith of Scottsdale, Ariz., faces custodial interference charges for her lengthy and repeated pressure to adopt the 8-month-old baby. The legally and emotionally complex world of adoption and parental custody is further complicated by custodial interference and parental alienation.
Courts grant various levels of custody to birth parents, adoptive parents and guardians. Physical custody means the child lives with the custodian at least part of the time, who is responsible for the child's well-being. Legal custody allows rights to decide on schooling, religion and other major factors in a child's life. It may or may not coincide with physical custody. Both types of custody also can be split in joint custody cases.
Parents or other individuals can be charged with custodial interference if they refuse to return a child to the custodian after visitation or otherwise try to deny the right to established custody.
Custodial interference laws vary widely between states. Under Arizona state law, a person who is not the parent or legal custodian can face a Class 3 felony for keeping a child from their legal custodian. This may bring a sentence of up to 8.75 years in prison.
Smith had brief guardianship over Gabriel Johnson, the 8-month-old baby she wants to adopt. After this 10-day period, she allegedly bullied Gabriel's father, forged court documents and tried to have the custody case moved to Tennessee, where the laws might be more favorable to her adoption case. These extreme measures led to a charge of conspiracy to commit custodial interference. A second charge of custodial interference was dropped.
The more common type of custodial interference is one parent keeping the child away from another parent in a joint custody situation. Under Arizona state law, this type of custodial interference is a Class 6 felony, bringing sentences ranging from probation to years in prison.
In such cases, judges may also take parental alienation syndrome (PAS) into consideration. Parental alienation is when one parent repeatedly criticizes and disparages the other parent in an attempt to alienate the child from the other parent. Often the result is that the child no longer wants to have contact with the alienated parent. The degree of parental alienation may differ in severity (mild, moderate, severe) based on the circumstances, and the effects may vary ranging from the child acting out when in the alienated parents care to permanent damage to the parent/child relationship.

Phase two of the search got under way last week at the Tessman Road landfill.

PHOENIX -- The San Antonio landfill search for missing baby Gabriel Johnson was temporarily halted Tuesday after snow started falling.
On Thursday, the search entered Phase No. 2, and authorities brought in cadaver dogs from across Texas to search for the baby, who was last seen with his mother, Elizabeth Johnson, the day after Christmas.
Gabriel's father, Logan McQueary, was also in San Antonio on Tuesday to continue his own search for his son. While in town, he met with Travis Andrews Warford, the former son-in-law of the couple -- Jack and Tammi Smith -- who wanted to adopt Gabriel.
Warford has said the Smiths "stole" his daughter, Hannah, from him by going to court and gaining custody without his knowledge.

Its obvious if Gabriel were illegally adopted that no one is going to turn him in. If they find no remains,then the state should go forward and charge EJ with murder and lay out a circumstantial case, with her own words to Logan coming back to damn her that she killed the child.

I'm hopeful that the PI working the case will be able to locate and return baby Gabriel. I think that's the only way he'll be seen again. I haven't heard anything aout how that search is going, but then, I wouldn't expect to hear anything about it. They can't be in the spotlight if they expect anyone with information to provide it.

I couldn't agree more Artgal, *if* that poor beautiful baby boy was illegally adopted (hoping!), I don't think the *parents* are going to come forward at this point - they surely realize they would lose the baby & they would face criminal charges at the very least. If baby Gabriel is not found in the landfill then LE should charge EJ with murder, maybe then she might be sufficiently scared and tell what she knows to (hopefully) provide LE with info that will lead to finding him alive, if not, she deserves to rot where she is.

I say charge her with murder and see if she squirms then. She knows damned good and well just what happened to her own son.

In my experience with adolescents and adults that have had a life of one home to the next, especially those that have grown up in one foster home after another, they tend to become very stoic. If they show happiness, then they're afraid they are getting too close and don't want to be hurt when rejected again. If they show sadness or fear, then they are letting others control their emotional state. Typically, the only real emotion I've seen from individuals that have grown up like EJ has, is anger. If she appears to be cool, I think it may be likely that she is disassociating herself from the situation--she's probably done that in many situations throughout the years. I may be way off base, but I just don't see EJ in the same "emotional" category as Casey. Not that one is better than the other-just different. JMO

I think With Purpose's analysis is very accurate re
foster children in general. It cannot be a great experience to be shuttled from home to home. Ive been in some foster homes and they can be actually very scary. I did a project for my club a year ago.
We used a pillow case and inside I put a pair of pajamas, a small pillow and other small items like
a toothbrush and tied it with a ribbon and donated
these to several agencies for foster children. Some foster children never get a new pair of pajamas to sleep in. It breaks my heart when I think of many of these children, but I dont know what else can be done for them. Casey Anthony is in no way the same as EJ
but interestingly enough both have, even though

I totally agree with your analysis of EJ and you have so brilliantly explained it! This is how I view her too, which is light years apart from my view of KC.

PHOENIX -- Baby Gabriel will be found, says renowned medium Allison DuBois.

DuBois, whose psychic gifts form the basis for the hit CBS television series "Medium," sat down with CBS 5 News to share her impressions of the case surrounding missing baby Gabriel Johnson, who was last seen with his mother, Elizabeth Johnson, the day after Christmas in San Antonio, Texas.
Johnson sits in a Maricopa County jail on kidnapping charges relating to the case.
"I feel like (Gabriel will) be found," DuBois said. "It does feel like helicopters are already overhead; it's a place where they're looking."
In the 90-minute interview, DuBois called Johnson's trip to San Antonio a "power play."
"I think she did it because she wanted to hurt the father, like she said," DuBois said. "It's almost like Gabriel was a pawn … It makes me sick to look at him and feel that because kids can't defend themselves, especially babies like this."
DuBois said she used several methods to gain an understanding of the case.
"For instance, if I look at a picture of Gabriel, (the) first thing I look at is his eyes," she said. "That's my window into him. But because he's so young and can't communicate, it's very difficult for me to pull information from him."
What she couldn't read from Gabriel's picture, she read from a video of Johnson in court and the sound of her voice on tape, DuBois said.
DuBois also looked at the text messages Johnson sent to Gabriel's father, Logan McQueary, the day after the baby was last seen.
"I'm already boarding a plane out of the country," Johnson wrote in one of the messages. "When I'm safe, I'll e-mail you the exact location of dead Gabriel's little blue body, if the garbage don't come first."
"I just feel like when she said that, she was sending (McQueary) off on a wild goose chase and trying to hurt the father," DuBois said.
DuBois said she also believes McQueary played no part in what may have happened to his son.
"(Johnson is) trying to make her ex seem like he's a bad person -- which he is not," DuBois said. "The little boy's father was telling the truth and loved the son. I want to reiterate that … So I really feel for him."
Additionally, DuBois said she's convinced that Tammi Smith, the woman charged with custodial interference who claims she was going to adopt Gabriel, is enjoying the limelight and attention from the national exposure this case is getting.
Nevertheless, DuBois said she believes that Gabriel will be found "within the year."
"I really feel like the people working the case are going to make sure he's found," she said.

SAN ANTONIO, Texas -- Twelve days into the hand search of a San Antonio landfill, investigators have found nothing.

San Antonio police have discovered no evidence of missing baby Gabriel and no sign of where he might be.
But where authorities have failed, Gabriel's father is given more hope that his boy is out there alive.
Logan McQueary continues to find witnesses that neither the police nor the FBI have questioned.
And while he says his ex-girlfriend, Elizabeth Johnson, was capable of murder, everything he discovers tells him that Gabriel is out there.
"Gabriel really was handed off to somebody," said McQueary.
Gabriel was last seen with Johnson the day after Christmas in San Antonio, Texas. Johnson sits in a Maricopa County jail on kidnapping charges.
One would expect the father of a missing child to have faith even facing the darkest odds, but McQueary is not grasping at straws.
"We found out that Elizabeth was at a Laundromat, and it was kind of weird the way she was there the first time," McQueary said. "Just kind of wandered around, didn't wash anything. She might have been meeting somebody, or might have been waiting for somebody to get there."
McQueary has talked to several witnesses who spotted and even talked to Johnson when she was in San Antonio; however, in most of those sightings, Gabriel wasn't with her.

SAN ANTONIO, Texas -- Twelve days into the hand search of a San Antonio landfill, investigators have found nothing.

San Antonio police have discovered no evidence of missing baby Gabriel and no sign of where he might be.
But where authorities have failed, Gabriel's father is given more hope that his boy is out there alive.
Logan McQueary continues to find witnesses that neither the police nor the FBI have questioned.
And while he says his ex-girlfriend, Elizabeth Johnson, was capable of murder, everything he discovers tells him that Gabriel is out there.
"Gabriel really was handed off to somebody," said McQueary.
Gabriel was last seen with Johnson the day after Christmas in San Antonio, Texas. Johnson sits in a Maricopa County jail on kidnapping charges.
One would expect the father of a missing child to have faith even facing the darkest odds, but McQueary is not grasping at straws.
"We found out that Elizabeth was at a Laundromat, and it was kind of weird the way she was there the first time," McQueary said. "Just kind of wandered around, didn't wash anything. She might have been meeting somebody, or might have been waiting for somebody to get there."
McQueary has talked to several witnesses who spotted and even talked to Johnson when she was in San Antonio; however, in most of those sightings, Gabriel wasn't with her.

The psychic is interesting, but is she really that bold in what she says? She says he will be found, but I note that she doesn't say whether he will be alive or dead when found. Interesting about the helicopters though.

Yeah, that's what I kind of thought. It didn't really clear anything up for me--other than I'm glad she expects that he will be found. Other than the helicopters, I don't think she was able to offer to much help.

I doubt the witnesses that he talked to are credible.
People insert themselves into these cases all the time.
I think hes on a wild-goose chase. They ought to charge her with homicide and then once this fact sinks in, maybe she will tell the truth. If she talks, then they will find the baby, if she doesnt she killed the child for sure.

I have reason to believe that some people are indeed psychic and have had that fact proven to me a few times in my life, and so I always give the benefit of the doubt, but most self-proclaimed psychics really aren't all that good at it, or those who do it for money and personal fame. It was said by one who was excellent at this talent that, the minute you start to use your gift for personal gain, it is taken away from you.
Regarding Houdini, they actually had an agreement that he would try to come through and give her the pre-agreed upon message, but he never did. I guess she would find out why he couldn't when she joined him on the other side. When it comes to husband and wife, who knows if they really want to be together on the other side? Or who knows if some don't get mixed up in the afterlife and forget their promises to make contact like he did? Who really knows but God himself?----I certainly am not smart enough to figure it out.

What if I told you that a little girl was home sick with the flu at 8 years old. she was suffering with a very high fever and talking out loud. She woke up screaming for her mommy because she saw her daddy and brother in a car wreck hanging from a bridge. Her mother did her best to calm her down, telling her that it was just a bad dream. Well about that same the the state police was knocking at their front door and the grandmother answered and screamed for the little girls mother. They were there to let her know the her husband and son were in a car wreck with an 18 wheeler and the car was hanging off of the mississippi bridge. They asked her to come with them, while the little girls grandmother stayed with her. The grandmother asked the little girl to tell her about her dream so she did, forbatim because everything she told her grandmother right down to her father trying to throw her brother to safety before the car fell into the mississppi river. The 18 wheeler managed to get a chain around the car just enough to steady it so that her father could be rescued. Then burning car fell into the river. She told her grandmother that her brother was burned and that daddy doesn't have a ear anymore. Which was both true the had to reattch the father left ear back on and both of them suffered with 1st and 2nd degree burns from the car being on fire.
So was it just a dream or did she forsee what was happeneing to her father and brother?
It might surprise you but the little girl had several visions through out her childhood and even into her adulthood. when she was 13 years her grandmother took aside and told her that they bother shared a very special gift. She explained to her in a way that only she could understand. They had a remarkable bond through out their life until the day she died. 4 years ago she was on vacation with her husband and children when she awoke from a dream where her grandmother came to her and told her she would always love her and they would be together someday beyond the clouds. She immediately called home and her mother told her that her grandmother had indeed passed away in her sleep. Her mom asked how did you know, she simply said that grandma told........

I most definitely do not discount some form of psychic ability. I think we all have it but some of us ignore it. I've had several incidences with premonitions.
I think that true psychic ability is something that just comes to you. It is not something you try to do by reading tarot cards or doing psychic readings.

A news article I found about the search for baby Gabriel..... the psychic mentioned above Allison Dubois stated she saw helicopters overhead in her visions about finding Gabriel. helicopter---chopper The article isn't clear if they are using this dog for the search, but I thought it was worth pointing out, maybe what her vision meant. This week, dog handlers from across the country were in San Antonio to get their dogs certified.
News 4 WOAI's Kristina De Leon found out that some of the dogs are helping out in San Antonio's most high profile cases. The training is all fun for the dogs. But it is important work for the humans that handle them as well as for the public.
Experts say a dog's nose is much more sensitive than a human's and and does most of the job.
"That allows them to search things that we would be able to search with their eyes," Christy Bormann.
Christy was on standby with her dog "Cody" for a trip to Haiti, but wasn't needed afterall. Dog "Remi" has been at the Tessman landfill for days helping to search for missing baby Gabriel Johnson.
"It's tough on the dogs. It's a lot of sensory overload for them. Uh, the trash smells and the gases that are coming from that trash is a lot for them to take in," explained canine search speciailist Erin Gillenwaters. "But they've been doing really well. We've been able to work through it."
Gillenwaters said the dogs will stay out until something is found.
"We just, you know, that we're able to find the missing person and bring closure to the family," added Gillenwaters.
Dog "Chopper" helped in the search last week at Canyon Lake, when the body of missing boater Scott Freund was found.
News 4 WOAI wanted to see how the dogs worked, so we put "Cody" to the test. Within 16 seconds, Cody found Kristina De Leon's hiding in a closet and alerted the trainer right away.
The training lasts through Thursday is conducted by the Bexar County Sheriff's Office.

I still remember when Princess Diana & Dodi were killed back in 1997. I read somewhere that she & Dodi had visited a psychic earlier in the day... so why didn't the psychic warn them about their impending doom?

SAN ANTONIO, Texas -- On Wednesday, Gabriel Johnson, who was last seen with his mother, Elizabeth Johnson, the day after Christmas in San Antonio, would be 10 months old.

There is no marking of this special date by his father, who is searching for the baby in Texas. There is no celebration -- only more searching and hoping.
But also on Wednesday, San Antonio Police Chief William McManus tried to assure Gabriel's father, Logan McQueary, and the public that the search for Gabriel is still a very high priority.
"We have not, for a minute, pulled any resources from this investigation," said McManus.
McManus is well aware of how the nation has gravitated to the search for baby Gabriel.
He admitted he's fixated on it too, both as a father and as an officer of the law.
"Some people say the longer you are in law enforcement, the more callous you become and the less these cases affect you," McManus said. "I'm here to tell you, I've been in this business for 35 years and the more I'm in it, the more it affects me."
That's why it was important for him to stress that his department has not wavered in its dedication to the case.
"The San Antonio Police Department considers this case a high priority," he said. "We have not pulled any resources from it and we still hope that we will find baby Gabriel alive. We will pursue this case until, you know, it comes to a conclusion one way or another."
Unfortunately, that dedication has not led to tangible results.
His team at the Tessman Road landfill has combed through 1,200 tons of debris by hand, but still has nearly 3,000 tons to go, and so far they have found no evidence of Gabriel or Johnson.
That failure only bolsters McQueary's belief that Gabriel is still alive.

SAN ANTONIO, Texas -- On Wednesday, Gabriel Johnson, who was last seen with his mother, Elizabeth Johnson, the day after Christmas in San Antonio, would be 10 months old.

There is no marking of this special date by his father, who is searching for the baby in Texas. There is no celebration -- only more searching and hoping.
But also on Wednesday, San Antonio Police Chief William McManus tried to assure Gabriel's father, Logan McQueary, and the public that the search for Gabriel is still a very high priority.
"We have not, for a minute, pulled any resources from this investigation," said McManus.
McManus is well aware of how the nation has gravitated to the search for baby Gabriel.
He admitted he's fixated on it too, both as a father and as an officer of the law.
"Some people say the longer you are in law enforcement, the more callous you become and the less these cases affect you," McManus said. "I'm here to tell you, I've been in this business for 35 years and the more I'm in it, the more it affects me."
That's why it was important for him to stress that his department has not wavered in its dedication to the case.
"The San Antonio Police Department considers this case a high priority," he said. "We have not pulled any resources from it and we still hope that we will find baby Gabriel alive. We will pursue this case until, you know, it comes to a conclusion one way or another."
Unfortunately, that dedication has not led to tangible results.
His team at the Tessman Road landfill has combed through 1,200 tons of debris by hand, but still has nearly 3,000 tons to go, and so far they have found no evidence of Gabriel or Johnson.
That failure only bolsters McQueary's belief that Gabriel is still alive.

I think we need a separate thread to discuss our experiences and stories of "psychicness" because everyone seems to have something to say about it. I would enjoy reading everyone's stories, but on this thread it gets to be too far off the topic of Baby Gabriel.

A witness came forward Wednesday night saying Johnson spent several days alone, visibly troubled, and away from her vulnerable child.
CBS 5 News has tracked several locations where Johnson was spotted while in Texas and most of them make sense.
There was the Homegate hotel, a Subway restaurant and a gas station, but a Laundromat called Easy Wash is not so easily explained.
Manuel De Leon, a maintenance worker at Laundromat, said for four days straight, Johnson came in and paced by the bank of dryers. She did not do any laundry until the fourth day.
"At first I thought she was in to drugs and trying to get together with a buyer. She kept going back and forth like she was waiting for somebody or trying to meet with somebody," said De Leon.
But De Leon never saw Johnson meet up with anyone, and although she came in multiple times a day, he never saw her with Gabriel. He only spotted Gabriel's car seat and Johnson's white sedan parked outside.
"She was like stressed out, like she had something on her mind," De Leon said. "When you have something on your mind, your face shows it. The way you look at people and things. That's why I kept away from her because I thought maybe she's upset about something."
On Dec. 26, Manuel finally tried to talk to Johnson.
"It was short, because I told her 'Are you from San Antonio?' and she said, 'No, I'm headed to Florida.' And that was it," he said. "I couldn't really make any conversation with her because she cut it off."
Johnson fled to Miami Beach the next day, where she was later captured.
But what was she doing at the Laundromat? And where was Gabriel all that time?
"I think she really met with somebody and we're just trying to track that down," McQueary said. "We just haven't been able to figure out who she met with. If we could get one name of somebody she met with, that would be a huge lead."
McQueary passed Manuel's tips along to the San Antonio Police Department, and officers did follow up.
Manuel said he's 100 percent sure he saw Johnson, and also feels confident Gabriel is alive and close.
"I think the baby's still around, in this area somewhere," said De Leon.

I agree with you all. Why would he just be coming forward with this now? And why would he just allow someone to be pacing in the laundromat day after day? IMO, he has provided no helpful information and has only created more drama in this case--unnecessary.

This reminds me of the man that came forward a year later and said he saw Casey and Caylee in WalMart and Caylee (I believe) was walking way behind Casey.
