Michelle Parker's family announced they would resume a search for the missing mother-of-three based on recommendations the Federal Bureau of Investigation gave police, according to their website.
The family asked for volunteers through their Facebook page for the Nov. 4 search — nearly one year to the date she dropped off her two children at the house of their father, Dale Smith Jr., before vanishing.
Smith is considered a suspect in Parker's disappearance but Orlando Police have not brought charges. He has custody of the couple's twin children.
Parker, 34, went missing Nov. 17 after leaving Smith's South Semoran Boulevard home and her cellphone was found in the bottom of a lake in Belle Isle a few weeks later.
This latest search comes after Orlando Police asked the Federal Department of Law Enforcement to gather a panel of investigators to review the case in May in the hopes of generating new leads.
Parker's family did not elaborate on the new information or the location for the search.
On a Facebook page devoted to publishing information about the case, family members said they are working with police to identify "any possible areas that could re-searched or that were not searched."
Meanwhile, relatives have continued to canvas the area, spreading word of Parker's disappearance through various news outlets, social media and community events in the region.
Orlando Police said they did not order the search and would not comment on an active investigation.
"We are just supporting the family," said Sgt. Vincent Ogburn, a police spokesman.
Parker's mother, Yvonne Stewart, could not be reached for comment.
The day she disappeared, a pre-taped episode of The People's Court aired during which, Parker and Smith argued over a lost engagement ring.
Parker, who worked as a bar tender at The Barn in Sanford, was last seen wearing jeans, a Florida Gators hooded sweatshirt and a silver cross necklace.
Anyone with information about her disappearance can call Crimeline at 1-800-423-8477. Tipsters can remain anonymous and can earn a reward of up to $5,000.

Michelle Parker Case Nearing Year, 'Michelle's Law' Petitioned

Missing Orlando mother Michelle Parker vanished nearly a year ago and still hasn't been found. Meanwhile, her former fiance remains the only suspect in her disappearance, but has not been arrested. Also, he has custody of their two children and was even rewarded back child support from the state of Florida. The missing woman's mother has long been vocal against Dale Smith Jr. having custody of her grandchildren, and has even accused him of making the kids unhappy.
Now the mother of the missing woman is petitioning for a change in Florida state law to grant grandparents visitation rights of children. Called Michelle's Law, the petition stems from the woman's claims that she has been kept from the two children in the custody of Dale Smith Jr.
Do you support Michelle's Law? It's hard to say whether or not this proposed law is a good idea. On one hand it's understandable that the grandparents want rights of children that share their DNA. On the other hand, it seems that the mother of Michelle Parker may be easily able to negatively influence the children with how vocal she's been against their father. BS, Chelsea Hoffman!! Maybe when you're a grandmother, you will "get it" so STFU!!
As for Michelle, her case remains unsolved. It's obvious that police do not have enough evidence against Dale Smith Jr., or else they would have already arrested him. I disagree! After a year of this case falling out of the headlines and no arrests made, it's certainly becoming cold. That's a shame, because this beautiful missing mother deserves far more than that—and so do her kids and parents.

The mother of missing Orlando woman Michelle Parker has started a petition to change Florida law.
Parker's mother, Yvonne Stewart, worked with Rep. Darryl Rouson and attorney Matt Morgan to write up and launch the petition on Change.org.
Parker, a mother of three, disappeared on Nov. 17, 2011, the same day a videotaped showdown with Dale Smith Jr., the father of her children, aired on "The People's Court."
If passed, the petition could lead to the enactment of Michelle's Law, which will allow the family of a missing person to petition a court for visitation of his or her children.
According to the petition's website, Stewart and her family "are lucky at this point in time that we get to see (the children), however, it would help anyone in similar circumstances and quite possibly set an example for other states to follow and change their laws."
Family members are set to renew a search for Parker on Nov. 4. The family has asked for volunteers, but they have not said where the search will be conducted.
Smith is the only person of interest named in Parker's disappearance.

A new search for missing Orlando mother of three, Michelle Parker, has been planned for this weekend, according to the search's official Facebook page.
Volunteers are asked to meet at the Orlando Police Department Lake Nona on Narcoossee Road at 8 a.m. on Sunday.
"This will be one of many that we hope to organize. We will not let the evil that has taken her from us, her son's and daughter win," according to the Facebook page. "We will search how ever long and how ever far we have to. "
Parker, 34, was last seen in November 2011 dropping off two of her children at the Orlando home of their father, Dale Smith Jr., who has been named the prime suspect in her disappearance. Smith has not been charged, however.
Parker disappeared right around the time an episode of "The People's Court" aired featuring a dispute between Parker and Smith over an engagement ring.

Less than a mile away. Orlando Police Officers and search dogs scour the wooded area off Goldenrod Road in the Lee Vista area for any sign of the missing mom.
Blocks away, More volunteers wearing Michelle's face on their shirts headed into the woods by Lake Moss Park.
Through out the year, Michelle's parents have held on to hope.
Even though some of these areas have been searched before, police tell us the FBI has urged detectives to go back and comb the area again.

Michelle Parker case results in petition

When Justin Lee sees photos of the smiling faces of the children of missing mother, Michelle Parker, he thinks of his grandparents. And he is hoping others see grandparents in the same light that he does.
Nearly a year after Parker went missing under mysterious circumstances following a taped appearance on The People's Court, Lee made himself part of a movement to grant visitation rights to grandparents when a child's parent goes missing or is murdered. In the wake of Parker's disappearance, her ex-fiance, Dale Smith Jr., the prime suspect in the case, received custody of the couple's two preschool-age twins.
In an effort to protest the custody situation, Lee signed a petition titled, Michelle's Law, on www.change.org. The petition, established by Parker's mother, Yvonne Stewart, is asking for signatures supporting a request for Florida's state legislature to pass a law allowing the family of a missing person to be awarded legal visitation.
"We live in a time where grandparents are raising little kids," said Stewart, whose soulful, brown eyes reflect the pain of months of looking for her daughter. "We don't have any rights. I don't think it's fair that people can go missing and the other parent can go, ['Too bad']."
Stewart, who said that her minimal visitation rights with Parker's 4-year-old twins, Taylor and Dale III, are entirely up to Smith, is hoping that Michelle's Law will motivate Florida legislators to pass a law enabling legal visitation rights for grandparents. She said the petition, which has been earmarked for Florida House Rep. Darryl Rouson, is set to go to the floor this month.
"Right now, Dale has all the say," Stewart, 58, said.
If the petition does enact legislation, Taylor and Dale III may return to Stewart's home in Geneva, where they lived with their mother and Stewart for the past three years. Parker, who was 33 when she went missing, is a Winter Park High School graduate.
"I want to be the voice for her," Stewart said.
The petition already has made an impression on many, including Lee, a Chuluota resident who knew Michelle from her job at The Barn entertainment venue in Sanford.
"I personally believe that this petition is a great idea," said Lee, who is studying criminal justice at Brevard Community College. "When I was [in Orlando], my parents divorced and my dad received custody. Due to the fact that my dad worked overnights, my brother and I lived at my grandmother's [home] and my dad would come over in the afternoon. If something had happened to my father, my mom would have received custody and my grandmother who helped raise me would have had no say as to visitation of me or my brother. I don't believe this is right.
"In today's society, many grandparents are helping raise their grandchildren and should be able to receive legal visitation," Lee said. "From what I understand, the law that they are trying to get passed is for grandparents to be able to see their grandchildren in cases where the parent has gone missing or murdered."
Lee is one of many who share the same belief. More than 3,000 people, thus far, have signed the petition. Lee discovered the petition after browsing the Michelle Parker Missing Person Facebook page.
"I think it's a great idea, so I have been passing it on," said Lee, who also knows Michelle's brother, Dustin.

"I believe the law enforcement agencies are doing all that they can to diligently work this case," Lee said. "I think the greatest thing is that the family and law enforcement continue to have searches for anything to do with her and the case. The only thing that I can say I believe would help this case is to continue to promote awareness. Knowledge is power, and I believe someone out there knows the truth about what truly happened. All anyone can hope is that they will come forward and tell what they know."

Parker was last seen on Nov. 17, 2011, after dropping off her children at Smith's home off Goldenrod Road. To date, nothing has been found.
Although he has been the prime suspect in the case for a year, Smith has yet to be charged.
"I believe the law enforcement agencies are doing all that they can to diligently work this case," Lee said. "I think the greatest thing is that the family and law enforcement continue to have searches for anything to do with her and the case. The only thing that I can say I believe would help this case is to continue to promote awareness. Knowledge is power, and I believe someone out there knows the truth about what truly happened. All anyone can hope is that they will come forward and tell what they know."

The mother of missing Orlando woman Michelle Parker has started a petition to change Florida law.
Parker's mother, Yvonne Stewart, worked with Rep. Darryl Rouson and attorney Matt Morgan to write up and launch the petition on Change.org.
Parker, a mother of three, disappeared on Nov. 17, 2011, the same day a videotaped showdown with Dale Smith Jr., the father of her children, aired on "The People's Court."
If passed, the petition could lead to the enactment of Michelle's Law, which will allow the family of a missing person to petition a court for visitation of his or her children.
According to the petition's website, Stewart and her family "are lucky at this point in time that we get to see (the children), however, it would help anyone in similar circumstances and quite possibly set an example for other states to follow and change their laws."
Family members are set to renew a search for Parker on Nov. 4. The family has asked for volunteers, but they have not said where the search will be conducted.
Smith is the only person of interest named in Parker's disappearance.

Orlando police say they are still conducting a missing person investigation, not a homicide investigation.
But, less than two weeks after Parker vanished, Orlando Police Chief Paul Rooney announced Dale Smith, Parker's ex-fiancé who fathered her young twins, was the prime suspect in her disappearance. Smith, 41, has never been charged in this case.
Despite the lack of criminal charges, Smith hired Mark NeJame — one of Orlando's most expensive criminal defense lawyers — to represent him. Smith, a twice-married, once-widowed construction worker, has never commented publicly about Parker's disappearance.
Detective Michael Moreschi, the lead investigator on the case, said police have followed hundreds of leads. Two panels of investigators from around the region have also dissected the case to offer suggestions and brainstorm.
"It's been the most intense investigation that I've ever been involved in," Moreschi said. "A lot of hours have been spent looking and searching for her, to get her and her family answers."
About two weeks ago, police and volunteers performed another search for Parker, but nothing turned up.
"It's hard to say if we are any closer, but a lot of work has been done," Moreschi said. "We can exclude a lot of possibilities."
For weeks after Parker disappeared, her friends and family worked around the clock at a makeshift command center near South Orange Avenue and Oak Ridge Road. Stewart said she knew immediately that her daughter was a victim of foul play.

The Michelle Parker disappearance officially reached its one-year anniversary today with no positive updates in sight. It's a somber event for the family of the missing Florida mother, who've referred to this long wait as being like a never ending funeral that comes with no closure. In fact, Michelle's mother and other close loved ones have clearly expressed that they believe she was murdered--and the truth will come out in time.
It's not hidden secret that Michelle's family suspects her estranged fiance Dale Smith Jr., for he had the motive, was among the last people to had seen her and had a known explosive temper. However, even though this man is the prime suspect in Michelle's disappearance there must be no evidence tying him to the case because he still hasn't been arrested--and he was even granted custody of the children he shares with the missing woman.
Over the course of the past year there have been but very few bits of evidence uncovered. A phone belonging to the woman was salvaged from beneath a bridge as if it had been thrown from a vehicle, but officials still haven't located the cross necklace that she may have been wearing the afternoon she vanished.

Sometimes, I wonder..did Dale really do this? She was captured on video at a KFC drive thru the day The People's Court show was aired (NOT the day she actually went to court - tape delayed). Evidently, whoever saw that had it in for her. Why, if this were Dale, wait until it aired to "oust" her? Could someone that knew her have seen it and for whatever reasons, decided to follow her and take her life and then take her to another county? But then, her cell phone was found close to Dale's house. I am not 100% confident he did this, nor am I 100% that he didn't. I do not think she will ever be found and we will never know what happened to this beautiful young mother. My heart goes out to her family.

A new bill in the Florida House that would give grandparents more rights in Florida is based on the Michelle Parker case.
The bill is sponsored by FL Rep. Darryl Rouson, D-St.Petersburg, FL Rep. Matt Gaetz, R-Niceville and FL Rep. John Tobia R-Brevard County.
The bill, HB 19, would give grandparents the right to petition the courts for visitation under certain circumstances, and also rights for great-grandparents.

Michelle Parker: Estate files wrongful death suit against ex-fiancé

The estate of Michelle Parker, the Central Florida mother who vanished in 2011, has filed a wrongful death suit against the only suspect in her disappearance — her ex-fiancé.
Attorney John Morgan confirmed Thursday morning his firm filed the suit against Dale Smith in Orange County Circuit Court.
"…We believe that some of the evidence that we have may prove that there was a wrongful death here," Morgan said.
Parker, a mother of three, vanished Nov. 17, 2011 after she dropped her two youngest children off with Smith.
That day, an episode of "The People's Court" featuring a dispute between Parker and Smith over a lost engagement ring aired on television.
Police found Parker's Hummer the day after she disappeared in an apartment complex parking lot several miles from where she was last seen.
Not long after, the Orange County Sheriff's Office dive team found Parker's cell phone submerged in water near a bridge in Belle Isle.
Orlando police have said Smith is the prime suspect in her disappearance, but he has never been charged in the case.

There are updates in the woman's case, but the new details are rather startling. It appears that the parents of the missing Florida mother have decided to file a wrongful death suit against Dale Smith Jr., her former fiance.
It's hard to determine if this is a good thing or if it's a bad thing. Considering Dale Smith hasn't yet been arrested on any murder charges, it's hard to really entertain the idea that he caused someone's death without adequate proof. Remember, had there been anything more than circumstantial suspicion, Dale would be in jail right now with or without Michelle still missing.
It's not a little known fact that civil suits are easier to win than criminal cases, so curiosity is certainly heightened at these latest reports. In the right climate with the right judge and savvy enough attorneys, Dale Smith really does have the potential of facing a negative judgment regarding the presumed death of the woman he once wanted to marry.
Hopefully the evidence against him doesn't result in any false negatives or the like, if you catch the drift. While circumstantial evidence may be enough to some people, in the court of law it absolutely is not enough. So if he were to have a judgment against him pertaining to a wrongful death, and he was still found not guilty of said death in the actual criminal system, then what would that mean?
This indeed seems like a big can of worms and Michelle Parker remains missing, hanging in the balance as perhaps the final piece to the puzzle. Hopefully Dale Smith had nothing to do with this, but what would the other options be?

Yvonne Stewart, the missing woman's mother, filed the lawsuit last week and is scheduled to make a public statement this afternoon. Parker is being represented by the high-profile Orlando law firm Morgan & Morgan.
Parker went missing in November 2011 after dropping of her young twins with Smith, their father. Orlando police labeled Smith the only suspect in the case, but he has never been charged in connection to the crime.
Family, friends and strangers aided police in the search for Parker for more than a month after she vanished from southeast Orlando. Volunteers set up a makeshift base camp in the parking lot of a shuttered business off Oak Ridge Road near Orange Avenue, the location near where her cellphone last pinged.
Police cobbled together a rough timeline of Parker's activities on Nov. 17, the day she went missing.
Surveillance video captured Parker in her Hummer SUV at a drive-through window ordering food shortly before she dropped off her two youngest children. She then drove to Smith's condo on South Semoran Boulevard and was never seen again.
Family members reported receiving a short text message from the missing woman that afternoon indicating that she was in the Waterford Lakes area.
Police found her SUV abandoned at an apartment complex just west of the Mall at Milennia a few days later. The unique stickers advertising her spray tanning business had been removed.
The afternoon she disappeared, Parker and Smith appeared on a pre-recorded episode of The People's Court where the couple argued over a lost engagement ring. The public fight offered a glimpse into the couple's tumultuous relationship which was also recorded in court documents.
Divers searching for clues found Parker's iPhone under water near a Belle Isle bridge on Nela Avenue, a few miles east of the base camp, a few weeks after her disappearance.
Shortly after Parker vanished, the Department of Children and Families took custody of the couple's two children from Smith. The agency argued that the children were in danger due to Smith's status as a prime suspect and his history of violence against women.
A judge ordered that the children be returned to Smith.
Smith agreed to allow the children to visit with Stewart, whom they had lived with during their short lives, but Parker said the visitations became less and less frequent. Despite helping raise her grandchildren, she had no legal right to their custody, she said in earlier interviews.
While her family believes she is no longer alive, Parker is still considered by police a missing person and not a homicide victim.
Anyone with information about Michelle Parker's disappearance is asked by police to call Crimeline at 1-80-423-8477. Tipsters can remain anonymous and could be eligible for a monetary reward.

Police cobbled together a rough timeline of Parker's activities on Nov. 17, the day she went missing.
Surveillance video captured Parker in her Hummer SUV at a drive-through window ordering food shortly before she dropped off her two youngest children. She then drove to Smith's condo on South Semoran Boulevard and was never seen again.
Family members reported receiving a short text message from the missing woman that afternoon indicating that she was in the Waterford Lakes area.
Police found her SUV abandoned at an apartment complex just west of the Mall at Milennia a few days later. The unique stickers advertising her spray tanning business had been removed.
The afternoon she disappeared, Parker and Smith appeared on a pre-recorded episode of The People's Court where the couple argued over a lost engagement ring. The public fight offered a glimpse into the couple's tumultuous relationship which was also recorded in court documents.
Divers searching for clues found Parker's iPhone under water near a Belle Isle bridge on Nela Avenue, a few miles east of the base camp, a few weeks after her disappearance.
Shortly after Parker vanished, the Department of Children and Families took custody of the couple's two children from Smith. The agency argued that the children were in danger due to Smith's status as a prime suspect and his history of violence against women.
A judge ordered that the children be returned to Smith.
Smith agreed to allow the children to visit with Stewart, whom they had lived with during their short lives, but Parker said the visitations became less and less frequent. Despite helping raise her grandchildren, she had no legal right to their custody, she said in earlier interviews.
While her family believes she is no longer alive, Parker is still considered by police a missing person and not a homicide victim.

Channel 9 learned the lawsuit was filed as police said they're still trying to figure out what happened to Parker.
"The loss of a child is the most painful thing any parent can go through," said Stewart.
Stewart went on to say every day is like a funeral.
"I'm mad and Michelle deserves this and her children deserve this," she said.
Smith recently moved out of Florida with his and Parker's 4-year-old children, and Stewart said she hasn't seen the children in months.
"They ask me all the time, 'Where's my mommy?'" Stewart said. “I’m very concerned about them being away from the family they knew.”
Orlando detectives have not given up but they have run out of leads in the search for Parker's body and how she was killed.
The lawsuit claims Parker died "as a direct and proximate result of the negligence of the defendant" and goes on to say had Smith not been "negligent or otherwise committed a wrongful act, there would not have been any injuries or damages sustained by Parker.
The lawsuit said Parker died on or about Nov. 17, 2011, the day the "People's Court" episode aired.
Police found her cellphone in Lake Conway near the Nela Avenue Bridge, and they searched Smith's father's Orange County home, but no charges have been filed and no arrest has been made.
Channel 9 learned on Thursday lawyers representing Parker's family have their own evidence against Smith that they plan to use in court.
"This civil action will allow us to get (depositions) and discovery the police don't have and force people to be accountable," said Morgan.
Attorney John Morgan said he has phone records, like texts between Parker and Smith.
"There's some text messages and just the whole timing of the disappearance with the text messages and the relationship," said Morgan.
Morgan said he doesn't expect to be able to access whatever evidence police might have against Smith, and he's not fazed by the possibility that Smith could take the Fifth in a civil case to prevent incriminating himself in any future criminal case.
"It's been my experience and my view that most guilty people take the Fifth. John Gotti took the Fifth," said Morgan.
Smith's attorney, Mark Nejame, insists there is no evidence linking Smith to Parker's disappearance or death.
"They had wiretaps in his house and nothing came up. They followed him," said Nejame.
Morgan admits the absence of a body is a hurdle in the case, but it's not insurmountable.

Michelle Parker's mother seeks visitation rights
TALLAHASSEE -- Yvonne Stewart burst into tears Monday after the House Civil Justice committee unanimously passed a bill that would allow her to go to court for the right to visit her missing daughter's twins.
Rep. Darryl Rouson, D-St. Petersburg, is sponsoring the bill (HB 19) that would allow grandparents like Stewart to ask a court for the right to visit their grandchildren if one parent is missing, in a vegetative state or has died.
"This bill is about love. It's about children being able to continue in the good and healthy relationships with the missing parent's parents," Rouson said.
Stewart's four-year-old twin grandchildren lived in her Orlando home with their mother, 33-year-old Michelle Parker, who was last seen on Nov. 17, 2011 when she dropped the twins at the home of their father and her ex-fiance, Dale Smith.
Smith, the prime and only suspect in Parker's disappearance, has custody of the twins and has refused to let Stewart visit, she said.
"I don't get to see my grandchildren at all. At all. I don't know if they're okay. I don't know if they're healthy, if they're happy. I don't know if they're being treated well. They're four years old, I don't get phone calls I don't get anything," said Stewart, who also has filed a wrongful-death suit against Smith.
The Legislature's previous efforts to create a so-called "Grandparents' Bill of Rights" were ruled unconstitutional for conflicting with parents' rights to decide who sees their children. Rouson's bill is more restrictive, allowing legal petitions by grandparents and great-grandparents only if one parent is missing, dead or in a vegetative state.
"We've restricted it to parents who almost uniquely fit the Yvonne Stewart type situation, so it is not as expansive as other attempts," said Rouson.
The bill has two more committee stops in the House, and identical legislation (SB 384) has yet to be heard in Senate committee.

Two years after her disappearance, Orlando police release video of Michelle Parker's Hummer stopping at a red light less than one mile from where the vehicle was later found.

Orlando police on Monday released new surveillance video in the case of Michelle Parker, a mother of three who vanished two years ago just hours after she and her ex-fiance appeared in a pre-taped episode of "The People's Court."
The footage shows Parker's Hummer SUV stopped at a red light at around 8:55 p.m. on Nov. 17, 2011, less than one mile away from where the vehicle was discovered the next day, according to police spokesman Sgt. Jim Young. He said authorities "don't know who was behind" the wheel at the time.
Police in Florida are still baffled by the mysterious disappearance of a Florida mom who disappeared the day her pre-taped appearance on "The People's Court" aired. NBC's Mark Potter reports on the search for Michelle Park.
Parker was last seen at 3:30 p.m., just after she dropped off her two youngest children with their father, Dale Smith, Jr., 41, who is considered a prime suspect in the case but has not been charged in Parker's mysterious disappearance, Young said.

The afternoon Parker went missing, she and Smith were featured on a pre-recorded installment of the syndicated television series "The People's Court," in which the two settled a dispute over a $5,000 engagement ring.
“(Smith) gets pretty malicious and vindictive,” Parker told the court that day. “He said that he wanted his ring, so I took it off, and I threw it at him.”
Decals on the car advertising Parker's airbrush-tanning business had been removed by the time the Hummer was found abandoned at a mall a day after her appearance. Authorities also found her iPhone under a bridge.
He characterized the video evidence as a "significant" part of the timeline of the disappearance, adding that police did not release the video footage until now in order to "protect the integrity of the investigation" and "protect against false tips."
Orlando detective Mike Moreschi also said for the first time publicly Monday that police don't believe the perpetrator acted alone.
"This was a two-person situation," Moreschi said at police headquarters Monday, according to the Orlando Sentinel.
Meanwhile on Monday, Parker's mother, Yvonne Stewart, called on Smith's mother to come forward with information, according to NBC affiliate WESH in Orlando.
In an emotional plea to Tamara Smith, Stewart said: "You know where your children are. And we don't know where ours are."
Dale Smith has denied involvement in Parker's disappearance, but Stewart has filed a civil wrongful-death lawsuit against Smith in her daughter's disappearance, according to WESH.

“They lived with me until the day she disappeared. We lost four family members that day,” said Stewart as she made her plea in a hearing in Tallahassee.
The bill would allow grandparents and great-grandparents petition courts for visitation rights for their grandchildren in cases where a parent is missing, dead or in a vegetative state. Last year a similar bill failed to become law. Stewart hopes this year will be different.
“These kids are important. I want them to know how much we love them and we need a chance to watch them grow,” said Stewart.
Sylvonia Banks said she’s rarely been able to see her granddaughter since her daughter, Kiera Banks, was murdered in Seminole County back in 2007. She said the girl’s father has sole custody, and rarely allows visits between her and her granddaughter.
“To be able to sit there and hug her, and love her, and be able to tell her stories about her mother, and to be able to express how much her mother cared for her,” said Banks.
The bill has passed committee hearings in both the state house and senate. It’s still unclear if it will make it to a full vote.

Judge asks family to re-file wrongful death lawsuit in Michelle Parker case

ORANGE COUNTY, Fla. — A judge told the family of Michelle Parker that they would need to re-file a wrongful death lawsuit in the case of the missing woman.
The family filed the suit against Parker's ex-fiancé, Dale Smith.
Parker disappeared in November 2011 after dropping her twins off at Smith's Orlando apartment.
Police named Smith, the twins' father, as the only suspect, but never brought charges against him. Smith and the children now live out of the state.
The suit was filed by Parker's mother, Yvonne Stewart, who said she filed the suit in an effort to find out what happened to her daughter.
"Whatever tactic they want to take legally, I'm just looking for the truth," said Stewart in a previous interview with Channel 9. "I want to know where my daughter is, and I want to know what happened to her."
During the hearing the judge told both sides that he needs to see more facts in the lawsuit against Dale Smith, including exactly how her family alleges Smith caused Parker's death.
Following Wednesday's hearing, Smith's attorney said that the judge dismissed the civil suit against his client as it currently stands. He said the judge told Parker's family they have 10 days to amend the suit.
Parker's family said Wednesday's ruling does not mean the civil suit is over. The family attorney said the suit will be amended and re-filed.
"Sometimes you have to face the facts in the sense we might never see her again, and I hate that I am able to even say that. Now we have her children that I'm fighting for we need to make sure they grow up knowing their mother, that one day we can explain what happened, not 'Sorry, we don't know,'" said Parker's sister, Lauren Erickson, following the hearing.

Dale Smith Jr. is correct about that. There is no proof that Michelle is dead. But the fact that she left her children behind and vanished without a trace indicates that she did not leave on her own free will. Furthermore, the fact that her SUV was abandoned just hours after she disappeared, and her cellphone thrown into a body of water, also indicates that foul play is a definite element in her case.
So should the wrongful death suit against Dale Smith Jr. be dismissed or not? Personally, I don't believe he had anything to do with Michelle's disappearance, and frankly, I don't think the police in that area are convinced either. They rushed hastily to call him a prime suspect and then fell flat on lack of evidence. He's never been arrested, and he's always been as cooperative as any hotheaded guy being accused of murder can be -- which isn't much, but put yourself in this man's shoes. He had just been blasted in a nationally viewed episode of The People's Court with all of his dirty laundry aired, now he's being accused of kidnapping/murdering the woman who mothered his twins.
The fact of the matter is that investigators have never publicized any reason that would lead them to suspect Dale Smith Jr. If they do have this evidence, it would be great if they shared it, but with around three years coming to pass it seems as though they have nothing -- and a real perpetrator could be getting away with far more than Michelle's disappearance, for all we know.
As for Michelle Parker: She is probably dead. People don't commonly disappear like she has, under similar circumstances, only to be safe and alive somewhere. Someone took her and killed her, and if it was Dale Smith Jr., he will eventually be caught, but something tells me that someone else entirely is responsible in Michelle's case -- and investigators have tunnel vision.

Gov. Rick Scott signs grandparents' rights bill into law

TALLAHASSEE, Fla. -
Gov. Rick Scott signed a bill into law Thursday night, that authorizes the grandparent of a minor child to petition a court for visitation under certain circumstances.
Some of those circumstances include when a parent has been killed, is in a vegetative state, or is missing. It also includes when the other parent has been convicted of a felony or an offense of violence evincing behavior that poses a substantial threat of harm to the minor child's health or welfare.
The bill states, "Upon the filing of a petition by a grandparent for visitation, the court shall hold a preliminary hearing ... the court may award reasonable visitation to the grandparent ... if the court finds by clear and convincing evidence that a parent is unfit or that there is significant harm to the child, that visitation is in the best interest of the minor child, and that the visitation will not materially harm the parent-child relationship."
The signing of the law was good news for Michelle Parker's parents, who have fought for the bill since their daughter disappeared three years ago.
Parker was reported missing after the airing of a pre-recorded episode of the TV show "The People's Court," that featured the her and her ex-fiance, Dale Smith, in a dispute over her engagement ring. She dropped off their two kids at Smith's house and hasn't been seen since.
Parker's mom, Yvonne Stewart, said that since then, Smith has not her and her husband see their grandkids.
Stewart filed a wrongful-death lawsuit against Smith, who remains a prime suspect in the disappearance, in early 2013, but that case was dismissed in 2014.
Parker's body has never been found. In February, Orlando police were still conducting searches for something vital to the investigation.
The new law will take effect July 1.
