If I change her setting she can't get in to the accused forum at all. Neoflander please don't post on a thread that is hitting so close to home for you. We have plenty of threads for you to blog on. You were told that you could hurt his case by doing that. I know you don't want to hurt his case do you?

The thread is about a census worker that had a terminal illness, hung himself and tried to make it look like a murder.

No, not that thread. LM has already merged the right thread into the page that it would have been posted upon probably a week or so ago. The problem is that I don't know if he was part of this 50. He was in a nearby county jail, Ashtabula, but not the county of Cuyahoga. In searching for that thread, I came upon a thread from another poster about a sting in another part of the country. Do you think we could make a new Title that would encompass all of these cases from coast to coast on this one main thread?

Of interest in the article about his suicide is the letter he wrote and what he says about himself in it. It proves the point what a slippery slope that can be if one even allows it into one's life in the first place. He was facing 20 years for simply passing it around and possession of it and saved the taxpayers supporting him by ending it all now, but, because of his child porn habit he lost his family and freedom and ended it all because there was nothing left to his life including any value as a man..

I hope there are random LE Agencies, DA's offices across the states, Attorneys, non attorneys and members of the media visiting our site. If they take what they have read here and use it to convict those who have committed crimes, then we are successfully doing what we intend to do.
I applaud you all for the dignified and intelligent way in which you've stood your ground.

You are exactly correct, I pray all the above agencies are coming here and reading what has been written. This site is for the murdered, missing, abused, exploited.

Personally, I don't particularly care if an adult has been charged with the kiddee porn crime as much as I care about the poor child that has suffered. This particular thread and all of the threads on VH are NOT about saving or rehabilitating the adults who allegedly commit these crimes. They are about the children.

I received a FB from Neoaflander saying I slammed her and now we can all come on here and pick her apart and she cannot defend herself because I banned her from this thread. Guess what?? THIS THREAD IS NOT ABOUT YOU, NEOAFLANDER. IT'S NOT ABOUT YOUR SON. It never was. YOU tried to make it so. YOU have been told by higher up's in Ohio to stay off the web. I have been accused of taking Neoaflander's statements out of context. Therefore, I am posting this email from her to me verbatim.

How odd to meet in this day and age, a few people, certainly not all in this forum, who act like the bad guys in a b movie, who are for the establishment no matter what evil the establishment perpetrates on others, that is until they become the "others" themselves.

I take note that when I asked about

I am a little tougher than that little girl who committed suicide when someone pretending to be her friend turned on her on the internet.
I think they charged that woman.

Flamers beware: Representative Linda Sanchez (D) has re-introduced a bill to Congress that--if approved--could make internet flaming and harassment a felony. Called the Megan Meier Cyberbullying Prevention Act, Sanchez created and named the bill after the teenager who killed herself in 2007 over "bullying" comments made by a Missouri woman on MySpace. Sanchez said that the bill is not out to stifle or censor free speech, but to determine "cyberbullyism" in court.

Some people have been pretty vicious with their posts.

I only want justice for my son. Publishing his picture, aka spreading vicious and unproved information and rumors, about him brought your site to my attention. I realize now that at least some of your members do not want any part of my campaign for justice for my son, or any suggestion that LE might not have the full gospel on his guilt or innocence. I think that is a dangerous thing for thing for the poor children who are victims. The real bad guys will sometimes get away because LE has some sacrificial lambs or easy targets to parade around for the people who believe everything they hear. I cannot see how anyone else cannot see how , in this case, presumption of innocence has gone out the window, the punishment has begun before any conviction and that no children will be be helped or rescued.


Please dont take my remarks our of context anymore. That is demeaning to anyones command of the language. I figure you are smart enough to turn this letter to a harmful bashing if that is what you choose to do. I promise there is no malice or hate in it for you or for any member of any forum on this site. I am hurt at peoples attitudes. And I marvel at some peoples willingness to discount the constitution with regard to jurisprudence and the presumed innocence of a defendant till proven guilty.

Thanks for sharing that with us Wrap. I could have much rebuttal to it but I just want to get back to following the cases for which the thread originally was opened. Only one thing, if someone has evidence that anyone in LE or the DA's office is corrupt or denying proper justice to the accused, they should be involved in seeing to it that those people are brought to justice also. If there is no evidence to bring against them, then they just need to stop making accusations or they can be accused of the cyber-bullying that she has written about. In the cases before us on this thread, LE and the DA have the evidence to proceed with their arrests and charges and that is all that matters legally as of now.

I ask again if it would be possible to expand the title of this thread to include all the states in which this sting took place, there were over 800 persons arrested in this sting nationwide I think, and perhaps some members would come forward with news of the others and maybe in one of the states LE may have made publicly known the rescue of some of the children.

Sorry I missed this before. I meant to reply to you and got sidetracked.

Of course we can expand the title to this thread if we have links from the other states. I do not know anything about this. TR, if you or any other member has links from other states, please post here and I will be happy to change the title. I hope that answers your question.

I am going to change the title to read "Alleged Child Pornographers Targeted Around the World." If we keep the "alleged" in the title, until they are proven guilty, we are safe. If they are proven guilty, we move them to "Convicted".

Eventually, I will move this thread back to the Lounge under the Accused. I just want things to die down for a few weeks, if possible, with some that saw fit to continue on their rant about their accused family member.

JMO.....it would make no sense for member's of a blog to join a family member in a "campaign for justice" for a person none of us know. We aren't trying to help Cindy and George in their "campaign for justice" for Casey, either. We just report the facts, on VH, that we are given by the media and hope that LE and our court system will convict the guilty and free the innocent........and while waiting for that to happen we voice our opinions, based on what we have learned for the media, about the cases.

Yes, BJ, in in this case, what strikes me about the whole issue is that the old adage that says something like "possession is nine-tenths of the law" rings very true. I have warned the young in the family to make sure, as they fileshare or download off the internet legal things, that they are not downloading illegal things such as this by accident. They have all assured me that it is not possible for them to do this because of precautions they have in their computer systems. Further, I feel the reporting and discussion of these cases will lead to formerly clueless people, who might just download and store these files, opening their eyes about their actions and what they can face if they are tracked by law enforcement. I am convinced that many do not realize the gravity of what they are doing.

I do hope that now we will be able to catch up on the news that was blocked for awhile. I hope members will post the articles and reports that they have refrained from posting during this time. These child victims need the support of the populace to encourage law enforcement agencies to prosecute these crimes and the task seems daunting. I hope members post what they know in their local states and communities so that we can find out more about the plight of these children.

I understand exactly what you are saying here. If there is ever a next time where I block or lock a thread and members disagree with me, please PM me and tell me why you disagree. Were the Children in the Pictures Girls or Boys?
More girls than boys were pictured. Sixty-two percent of arrested CP possessors
had pictures of mostly girls. Fourteen percent had pictures of mostly boys, and
15% had pictures showing girls and boys in about equal numbers.
How Graphic Were the Pictures?
Most arrested CP possessors had graphic images explicitly showing sexual acts
performed by or on children.

92% had images of minors focusing on genitals or showing explicit
sexual activity

80% had pictures showing the sexual penetration of a child, including
oral sex.
Most (71%) possessed images showing sexual contact between an adult
and a minor, defined as an adult touching the genitals or breasts of a minor
or vice-versa.

About one-fifth (21%) had child pornography depicting violence such as
bondage, rape, or torture. Most of these involved images of children who were
gagged, bound, blindfolded, or otherwise enduring sadistic sex.
Most arrested CP possessors (79%) also had what might be termed “softcore”
images of nude or semi-nude minors, but only 1% possessed such images alone.
Further some of those with softcore images only also had sexually victimized
children. Overall the images the arrested offenders possessed were very graphic.

Innocent Images National Initiative

Online Child Pornography/Child Sexual Exploitation Investigations

The Innocent Images National Initiative (IINI), a component of FBI's Cyber Crimes Program, is an intelligence driven, proactive, multi-agency investigative operation to combat the proliferation of child pornography/child sexual exploitation (CP/CSE) facilitated by an online computer. The IINI provides centralized coordination and analysis of case information that by its very nature is national and international in scope, requiring unprecedented coordination with state, local, and international governments and among FBI field offices and Legal Attachés.

Today, computer telecommunications have become one of the most prevalent techniques used by pedophiles to share illegal photographic images of minors and to lure children into illicit sexual relationships. The Internet has dramatically increased the access of the preferential sex offenders to the population they seek to victimize and provides them greater access to a community of people who validate their sexual preferences.

The mission of the IINI is to reduce the vulnerability of children to acts of sexual exploitation and abuse which are facilitated through the use of computers; to identify and rescue child victims; to investigate and prosecute sexual predators who use the Internet and other online services to sexually exploit children for personal or financial gain; and to strengthen the capabilities of federal, state, local, and international law enforcement through training programs and investigative assistance.

The History of the Innocent Images National Initiative

While investigating the disappearance of a juvenile in May 1993, FBI special agents and Prince George’s County, Maryland, police detectives identified two suspects who had sexually exploited numerous juveniles over a 25-year period. Investigation into these activities determined that adults were routinely utilizing computers to transmit sexually explicit images to minors and in some instances to lure minors into engaging in illicit sexual activity. Further investigation and discussions with experts, both within the FBI and in the private sector, revealed that the utilization of computer telecommunications was rapidly becoming one of the most prevalent techniques by which some sex offenders shared pornographic images of minors and identified and recruited children into sexually illicit relationships. In 1995, based on information developed during this investigation, the Innocent Images National Initiative was started to address the illicit activities conducted by users of commercial and private online services and the Internet.

The IINI is managed by the Innocent Images Unit within the FBI’s Cyber Division at FBI Headquarters in Washington, DC. Innocent Images field supervisors and investigative personnel work closely with the Innocent Images Unit regarding all IINI investigative, administrative, policy, and training matters. The IINI provides a coordinated FBI response to this nationwide crime problem by collating and analyzing information obtained from all available sources.

Today the FBI’s Innocent Images National Initiative focuses on:

Online organizations, enterprises, and communities that exploit children for profit or personal gain.
*
Major distributors of child pornography, such as those who appear to have transmitted a large volume of child pornography via an online computer on several occasions to several other people.
*
Producers of child pornography.
*
Individuals who travel, or indicate a willingness to travel, for the purpose of engaging in sexual activity with a minor.
*
Possessors of child pornography.

The FBI and the Department of Justice review all files and select the most egregious subjects for prosecution. In addition, the IINI works to identify child victims and obtain appropriate services/assistance for them and to establish a law enforcement presence on the Internet that will act as a deterrent to those who seek to sexually exploit children.

The Growth of the Innocent Images National Initiative

Over the last several years, the FBI, local and state law enforcement, and the public have developed an increased awareness of the CP/CSE crime problem, and more incidents of online CP/CSE are being identified for investigation than ever before. In fact, more personnel resources are currently expended towards violations worked under the IINI than any other program within the FBI's Cyber Division. Between fiscal years 1996 and 2007, there was a 2062 percent increase in the number of IINI cases opened (113 to 2443) throughout the FBI. It is anticipated that the number of cases opened and the resources utilized to address the crime problem will continue to rise.

The increase in Innocent Images investigations demonstrated the need for a mechanism to track subject transactions and to correlate the seemingly unrelated activities of thousands of subjects in a cyberspace environment. As a result, the Innocent Images case management system was developed and has proven to be an effective system to archive and retrieve the information necessary to identify and target priority subjects. All relevant data obtained during an undercover session is loaded into the Innocent Images case management system where it is updated, reviewed, and analyzed on a daily basis to identify priority subjects.

Innocent Images National Initiative Investigations

IINI undercover operations are being conducted in many FBI field offices by task forces that combine the resources of the FBI with other federal, state, and local law enforcement agencies. Each of the FBI's 56 field offices has worked investigations developed by the IINI. International investigations are coordinated through the FBI's Legal Attaché program, which coordinates investigations with the appropriate foreign law enforcement. IINI investigations are also coordinated with Internet Crimes Against Children (ICAC) Task Forces, which are funded by the Department of Justice. Furthermore, IINI training is provided to all law enforcement involved in these investigations, including federal, state, local, and foreign law enforcement agencies.

During the early stages of Innocent Images, a substantial amount of time was spent conducting investigations on commercial online service providers that provide numerous easily accessible “chat rooms” in which teenagers and pre-teens can meet and converse with each other. By using chat rooms, children can chat for hours with unknown individuals, often without the knowledge or approval of their parents. Investigation revealed that computer-sex offenders utilized the chat rooms to contact children, since children do not know whether they are chatting with a 14-year-old or a 40-year-old. Chat rooms offer the advantage of immediate communication around the world and provide the pedophile with an anonymous means of identifying and recruiting children into sexually illicit relationships.

Innocent Images has expanded to include investigations involving all areas of the Internet and online services including:

Internet websites that post child pornography
*
Internet News Groups
*
Internet Relay Chat (IRC) Channels
*
File Servers (“FServes”)
*
Online Groups and Organizations (eGroups)
*
Peer-to-Peer (P2P) file-sharing programs
*
Bulletin Board Systems (BBSs) and other online forums

FBI agents and task force officers go online undercover into predicated locations utilizing fictitious screen names and engaging in real-time chat or e-mail conversations with subjects to obtain evidence of criminal activity. Investigation of specific online locations can be initiated through:

A citizen complaint
*
A complaint by an online service provider
*
A referral from a law enforcement agency
*
The name of the online location (such as a chat room), which can suggest illicit activity

The Innocent Images International Task Force became operational on October 6, 2004 and includes law enforcement officers from the following countries: United Kingdom, Norway, Finland, Ukraine, Belarus, Australia, Thailand, the Philippines, Croatia, Latvia, Germany, the Netherlands, New Zealand, Canada, Sweden, Fiji, Cyprus, Iceland, Denmark, Panama, and Europol. To date, more than 47 international officers have traveled to the United States and have worked side-by-side with special agents of the FBI at the Innocent Images Unit. The task force allows for the real-time transfer of information from and to the FBI and between task-force members and their countries. Task Force officers stay in the United States for several months and remain an integral part of the task force once they return to their home countries. The FBI’s Innocent Images International Task Force successfully brings together law enforcement from around the world to address the global crime problem of online child exploitation.

The most common crimes investigated under the IINI are in violation of Title 18 United States Code (USC):

The FBI has taken the necessary steps to ensure that the Innocent Images National Initiative remains viable and productive through the use of new technology and sophisticated investigative techniques, coordination of the national investigative strategy, and a national liaison initiative with a significant number of commercial and independent online service providers. The Innocent Images National Initiative has been highly successful. It has proven to be a logical, efficient, and effective method to identify and investigate individuals who are using the Internet for the sole purpose of sexually exploiting children.

FBI Ten Most Wanted Fugitive

To date there have been four Innocent Images subjects placed on the FBI’s Ten Most Wanted Fugitives list:

On December 27, 2000, Eric Franklin Rosser became the first child predator to be placed on the FBI's Ten Most Wanted Fugitives List. Rosser was charged with the production, distribution, receipt, and transportation of child pornography, as well as conspiracy to do the same. His offenses included the production of a videotape in Thailand that allegedly depicts sexually explicit conduct between him and an eleven-year-old female child. In February 2000, Rosser was arrested in Thailand on various charges, including possessing child pornography. He was released on bail and disappeared. A federal grand jury in Indianapolis, Indiana, indicted Rosser in March 2000. After a tip from the public, Rosser was again arrested in Thailand on August 21, 2001. The Thai police said Rosser underwent liposuction, had cosmetic surgery to his face, and then traveled to the Netherlands, England, and France before returning to Thailand and being arrested. Rosser served a two-year sentence in Thailand and was then extradited to the United States. Rosser pled guilty and was sentenced on October 24, 2003 to more than 16 years in federal prison. Rosser's co-conspirator William Platz was sentenced in June 2000 to 11 years in prison.

On January 31, 2002, Michael Scott Bliss became the second child predator to be placed on the FBI's Ten Most Wanted Fugitives List. Bliss was being sought by the FBI for the repeated molestation of a nine-year-old female victim in Vermont. Bliss videotaped these molestations, and the videos were converted to computer files for possible placement on the Internet. Bliss has a violent criminal history towards children and served nine years in state prison for committing aggravated assault against his girlfriend's minor children. During that incident, Bliss repeatedly struck three of his girlfriend's children with an aluminum baseball bat, rendering two of them unconscious. Bliss was released from prison just two months before the alleged molestations of the nine-year-old began. Bliss was arrested in Los Angeles, California, on April 23, 2002, and was charged in the state of Vermont with 11 federal counts of various statutes related to sexual exploitation of children. Bliss pled guilty to all 11 counts on June 2, 2003 and was sentenced on February 18, 2004 to 22 years in federal prison followed by five years of supervised release.

On June 14, 2002, Richard Steve Goldberg became the third child predator to be placed on the FBI's Ten Most Wanted Fugitives List. Goldberg was being sought for engaging in lewd acts in Long Beach, California, with several girls under ten years old. He also produced and possessed child pornography images of these sex acts, which were found on his computer. Goldberg gained the trust of his victims’ parents and then befriended their children. He entertained the girls by allowing them to play with his pets, watch television, and use his computer to play games. Some of these girls also took short trips with him. In July 2001, a state arrest warrant was issued in California charging Goldberg with six counts of lewd acts upon a child and two counts of possession of child pornography. On November 25, 2002, a federal arrest warrant was issued charging Goldberg with the production of child pornography and the unlawful flight to avoid prosecution. On May 12, 2007, Goldberg was arrested in Montreal by Canadian authorities and was extradited to the United States to face federal and state charges of sexual exploitation of children, unlawful flight to avoid prosecution, lewd acts upon a child, and possession of child pornography. Goldberg (age 62) pled guilty and was sentenced on December 10, 2007 to 20 years in federal prison.

On September 7, 2007, Jon Savarino Schillaci became the fourth child predator to be placed on the FBI’s Ten Most Wanted Fugitives List. Schillaci is being sought for the alleged sexual assault of a young boy in Deefield, New Hampshire in 1999. Prior to the alleged sexual abuse, Schillaci corresponded with the boy’s family when he was in a Texas prison serving a conviction for child molestation. After his release, Schillaci moved in with the family, who offered him an opportunity at a new life the alleged sexual abuse occurred later that year. A Rockingham County Superior Court bench warrant was issued for Schillaci in late 1999, and in April 2000 a federal arrest warrant was issued charging Schillaci with unlawful flight to avoid prosecution. Schillaci is an Oklahoma native who has ties to New Hampshire, Texas, Mexico, and California. He is well educated and is believed to have earned masters degrees in humanities and literature. Schillaci is known to speak Spanish, French, and German. His current whereabouts are unknown.

National Center for Missing and Exploited Children (NCMEC)The National Center for Missing and Exploited Children (NCMEC) operates a CyberTipline at [You must be registered and logged in to see this link.] that allows parents and children to report child pornography and other incidents of sexual exploitation of children by submitting an online form. The NCMEC also maintains a 24-hour hotline of 1-800-THE-LOST and a website at [You must be registered and logged in to see this link.]

Complaints received by the NCMEC that indicate a violation of federal law are referred to the FBI for appropriate action. An FBI supervisory special agent and five analysts are assigned full-time at the NCMEC to assist with these complaints. The analysts review and analyze information received by the NCMEC’s CyberTipline. The analysts conduct research and analysis in order to identify individuals suspected of any of the following: possession, manufacture and/or distribution of child pornography; online enticement of children for sexual acts; child sexual tourism; and/or other sexual exploitation of children. The analysts utilize various Internet tools and Administrative Subpoenas in their efforts to identify individuals who prey on children. Once a potential suspect has been identified, they compile an investigative packet that includes the applicable CyberTipline reports, subpoena results, public records search results, the illegal images associated with the suspect, and a myriad of other information that is forwarded to the appropriate FBI field office for investigation.

Innocent Images Statistical Accomplishments

Online child pornography/child sexual exploitation investigations, which are worked under the FBI's Innocent Images National Initiative, accounted for 39 percent of all investigations worked under the FBI's Cyber Division in fiscal year 2007.
Innocent Images grew exponentially between fiscal years 1996 and 2007 with a:

Before your posts, I did not know it was such a well-organized and widespread effort. I also read with great interest the profile of the average persons accused of involvement in this crime. She goes by the name of "Amy," and the photos her uncle took of her a decade ago -- when she was 8 or 9 years old -- are among the most widely circulated series of child-pornography images in the United States.

Now her fight for damages from those who possess or distribute those photos is emerging as a big issue in federal courtrooms across the country. Including in Minnesota.

The question is: How much can one offender possessing any of the millions of images circulating on the Internet be expected to pay to any of the thousands of victims worldwide? Amy is seeking a total of more than $3.3 million.

On Monday, Judge Patrick Schiltz in U.S. District Court in St. Paul, Minn., issued an order demanding to know why restitution was not even requested by the U.S. attorney's office in the case of a Minnesota man who pleaded guilty to possession of child pornography.

"We know that when a little girl has pictures taken of her and they are disseminated around the country, it continues to harm her," Cassell said. "The question is, how much does any particular offender contribute to that harm? Is it fair to hold one offender accountable for all those images?"
In dozens of cases involving Amy and another victim over the past couple of years, some courts have awarded large sums. Some have awarded only a few hundred dollars here and there. Some have denied any restitution at all -- saying it is impossible to determine how much financial responsibility any single offender bears.

Amy, who has an attorney making restitution claims on her behalf all over the country, is a vanguard on the issue, Cassell said.

"Every day, she wakes up with another notice from another court that another offender is viewing another image of her," he said. "Imagine what that does."

Most prosecutors want to put the bad guys behind bars and move on, Cassell said. Many think it will be too time-consuming and complicated to calculate restitution in addition to prosecuting offenders, Cassell said.

But, if more of Amy's requests for restitution hold up, he said, those excuses will go away and Amy can begin to find peace.

She will also inspire more victims to step forward.

"Every day, she wakes up with another notice from another court that another offender is viewing another image of her," he said. "Imagine what that does."

Most prosecutors want to put the bad guys behind bars and move on, Cassell said. Many think it will be too time-consuming and complicated to calculate restitution in addition to prosecuting offenders, Cassell said.

But, if more of Amy's requests for restitution hold up, he said, those excuses will go away and Amy can begin to find peace.

She will also inspire more victims to step forward.

David Trotter, 43, of Parma:
Trial continues today on charges of rape, kidnapping, using a minor in nude material, pandering sexually oriented material involving a minor, possessing criminal tools and corrupting another with drugs. Trotter is accused of raping a 14-year-old girl March 26 at his home after giving her and other juveniles alcohol. Police confiscated his computer and found child pornography.

It's been more than a decade since "Amy," as she's known in court papers, was first sexually abused by her uncle. The abuse ended long ago and he's in prison, but the pictures he made when she was 8 or 9 are among the most widely circulated child pornography images online.
Now the 20-year-old woman is taking aim at anyone who would view those images and asking for restitution in hundreds of criminal cases around the country.
Her requests and those filed by other victims of child pornography are forcing federal judges nationwide to grapple with tough legal questions: Is someone who possesses an abusive image responsible for the harm suffered by a particular child? And how much should that person have to pay?
"It is hard to describe what it feels like to know that at any moment, anywhere, someone is looking at pictures of me as a little girl being abused by my uncle and is getting some kind of sick enjoyment from it. It's like I am being abused over and over again," Amy wrote in court papers.
"I want it all erased. I want it all stopped. But I am powerless to stop it just like I was powerless to stop my uncle," she wrote.
The issue of criminal restitution in child pornography possession cases emerged last February in Connecticut when a federal judge said he would order a man convicted of possessing and distributing child pornography to pay about $200,000 to Amy. The judge said it was the first criminal case in which someone convicted of possessing illegal images — but not creating them — would be required to pay restitution. (The case settled for $130,000 before the judge issued his final order.)
Since then, requests for restitution have picked up as more victims are identified — and as a couple of victims, including Amy, have hired attorneys, said Meg Garvin, executive director of the National Crime Victim Law Institute in Portland, Ore.
Hundreds of requests have been filed nationwide, most of them by Amy's attorney, James Marsh of New York. Marsh said that as recently as five years ago, restitution would have been impossible because victims wouldn't have known when someone was caught with an image of them. The Crime Victims Rights Act of 2004 set up a system for notifying the victims. Now, Marsh gets several notices a day on behalf of Amy.
Marsh, who declined to make Amy available for an interview, is seeking restitution for Amy in 350 cases nationwide. Each request is about $3.4 million. She won't get that amount in every case. But any sum collected would go toward that total to cover Amy's counseling, medical costs, future lost earnings and lawyer fees.
Courts have been divided on how to handle the requests. At least two courts in Florida ordered restitution of more than $3.2 million, but some others ordered nominal amounts. Several others denied it.
"Everyone is really grappling with this in good faith," said Marsh. "It's all over the place."
In Minnesota last month, a federal judge ordered prosecutors to explain why they didn't ask for restitution in a case involving images of Amy.
The court "will no longer accept silence from the government," wrote U.S. District Judge Patrick Schiltz.
In a response brief, Assistant U.S. Attorney Erika Mozangue wrote that prosecutors didn't get a restitution request until after a plea deal had been worked out, and added, "The determination of restitution in possession cases is an unsettled issue."
Some defense attorneys have argued that children are not victimized by mere possession of pornography or that their client had no direct connection to the victims. Others have argued it's impossible to fairly calculate how much harm one offender caused the victim.
After a federal judge in Florida found Arthur Weston Staples III, of Manassas, Va., jointly liable for $3.5 million in restitution for having an image of Amy, Staples' attorney, Jonathan Shapiro, argued on appeal that there was no connection between the two "other than the fact that he possessed her image on his computer approximately 10 years after that image had been manufactured by her uncle ... who caused her extreme damage."
Prosecutors should have to prove that Amy was a victim of Staples' particular act, and that she would not have been harmed if Staples hadn't had the image, Shapiro argued. The appeal is pending.
A federal appeals court recently upheld a Texas judge's decision to deny restitution because prosecutors didn't show how much harm the specific defendant caused. The ruling in the 5th U.S. Circuit Court of Appeals drew a sharp dissent from Judge James Dennis.
"Her right to restitution is not barred merely because the precise amount she is owed (by this defendant) is difficult to determine," Dennis wrote.
Other defense lawyers have said restitution requests belong in civil court.
Bradford Colbert, a William Mitchell College of Law professor, agreed.
"It just isn't appropriate for criminal court to make those determinations," he said. "This is the type of thing that should be resolved in a civil lawsuit. You get convicted of a crime and you get sued by a victim, and there's a civil lawsuit where you pursue damages."
Marie Failinger, a Hamline Law School professor, said allowing restitution in criminal cases is important because many victims don't have the resources to pursue civil cases. She predicted it would take three to five years for courts to figure out a consistent way to handle requests for criminal restitution.
Meanwhile, victims' advocates see criminal restitution as one more tool for fighting child porn.
"The people who engage in this stuff need to be held accountable, even if they are not the person who is raping the child," said Ernie Allen, president of the National Center for Missing and Exploited Children. "People who are distributing this stuff, people who are downloading this stuff — when they do that, there's a victim, and there's a real harm."

OMG, BJ, Thanks for that link. I thought Dr. Bradley was filming and perhaps distributing his perverted evil. He is listed there. I am touched by the quote from the investigation participants on the right hand side. A sad thing, they can only seem to pursue but 1% of these crimes. It must be so very hard on them to view these tortured children and not be able to rescue them.

Thanks also for the post directly above-----I hope they make them pay bigtime, those who download and enjoy viewing the torture of a child should pay bigtime for their participation in the crime. Were it not for them, the crime would not have been committed----supply and demand rules when it comes to distribution of anything. They are participating in the crime by their very want and demand for the material.
