ORANGE COUNTY, Fla. (WOFL FOX 35) - Casey Anthony will be back in court Friday December 11 for motion hearings and her parent's, George and Cindy Anthony, along with their attorney Brad Conway have been subpoenaed to testify.will be back in court Friday December 11 for motion hearings.
Judge Strickland will hear four motions in the State vs. Casey Anthony case beginning at 9:30 a.m.:
Motion to preclude the death penalty procedures
Motion for a protective order prohibiting Orange County Jail from videotaping attorney visits
Motion for a protective order directing Orange County Jail to destroy videos of family visits
Motion to dismiss counts 1,2, 4, 5, 7, 8 10, 11, 13 for violation of double jeopardy clause
Anthony’s lawyers filed the motions saying there isn't enough information in the murder indictment for Anthony to defend herself so they want it thrown out. They are also trying to get the check fraud case dropped too claiming double jeopardy because she faces several counts of basically the same charge.
Anthony, 23, has pleaded not guilty on charges that she killed her daughter, 2-year-old Caylee Marie , claiming a babysitter kidnapped her toddler. Caylee was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home in December.

Wasn't it close to this time last year that Caylee's remains were found? I wonder if Cindy and George will be thinking of Caylee and not Casey in the courtroom.

....ouch. a teeny tiny part of me feels bad they have to go to court on the day their granddaughter was discovered to be for sure dead near their own home.
Another part of me is glad someone is forcing them to go look at the person who took the life of that same baby, and hope to god they feel at least a tiny bit disgusted of their own child.

This is Bill Sheaffers take on the motions:
There have been endless opinions and discussions regarding the recent spate of motions filed by Casey Anthony’s defense team. These motions seek, among other things, to declare sections of Florida’s death penalty statute unconstitutional, or, attack those sections of the death penalty statute wherein the jury, during the penalty phase, is called upon to weigh aggravating circumstances versus mitigating circumstances in reaching its recommendation of either life or death. Further, there has been considerable criticism of the defense team for even filing these motions. Some are distressed with the perceived waste of judicial time and justice system resources, in having to respond to what many consider to be frivolous or pointless motions. Others are very vocal in their concern that the trial judge might declare Florida’s statute in question, or some part thereof, unconstitutional. The latter is not likely to happen.
We could address each defense motion on its merits, but for now, I believe that a general discussion of what it all means is more in order.
Once defense lawyers undertake a trial by either judge (bench trial) or by jury, the lawyers are not only concerned with the actual trial itself, but also any possible appeal which may follow, in the event of a conviction. Should Casey Anthony be convicted of first degree murder of her little girl, and, should she be sentenced to death, her appeal automatically bypasses the usual appellate route taken by non-death penalty criminal cases. Instead of an appeal of her conviction and sentence being filed with the intermediate appeals court, i.e. the Fifth District Court of Appeals, it would go instead, directly to the Florida Supreme Court, the ultimate court of appeals in the State of Florida. Should she lose the appeal in the Florida Supreme Court, her appellate lawyers would next appeal her conviction and sentence directly to the United States Supreme Court. For our international readers, that is the highest court in the U.S. But the United States Supreme Court has the discretionary ability to decide whether to hear Casey’s appeal, or to refuse to do so, without giving a reason. Should she lose in the United States Supreme Court, Casey’s lawyers would then return to the original trial court in Orlando, Orange County, Florida and file a postconviction motion for relief (also referred to as collateral relief) which would include, among other things, an attack upon the competency of her trial attorneys.
Should she lose on that motion, she would return to the Florida Supreme Court to appeal its denial. Again, should she lose that appeal, its back to the United State Supreme Court. So, if you are still with me at this point, if she is rejected by the United States Supreme Court, her lawyers would start seeking her postconviction remedies in the United States federal court system. This postconviction process would continue on until either Casey won, or, was executed. I won’t go into the particulars of the post conviction process in the federal court system. To do so would be mind numbing, even for you University of South Florida students following this blog. Suffice it to say the post conviction process can, and usually does, take years and years.
So, the eye opener for many who do not work in the criminal justice system is the fact that a guilty verdict with a sentence of death is not the end of the case by any means, but in many respects only a beginning. In discussing this case and the complex appellate process with “go to” criminal appellate lawyer, Terrance Kehoe who practices in Orlando, Florida, the defense motions under discussion here are the types of motions filed by criminal trial lawyers in most “death cases”. Although lawyers may disagree as to the merits of the various motions at this time, they are filed in order to preserve the issue (or argument) for the many appeals that follow. We are mindful that although the current status of the law may not support these motions today, the law is always evolving and changing, meaning what may seem a frivolous argument now, could, in fact, be the status of the law sometime in the future. And, should the law change in favor of the arguments advanced in these various motions, it may well be an argument put forth in one of these motions that saves Casey Anthony from lethal injection.
In view of the foregoing, I’ll leave you with an adage which I think applies to these defense motions: Throw a thousand rocks in the ocean, and you may just hit a fish.

ORLANDO, Fla. -- The case against Casey Anthony is heading back to court Friday and Casey will be there. Casey Anthony's defense team will ask that the death penalty be taken off the table.
The defense also wants the jail to stop video-taping visits between Casey and her attorneys. They are also asking that the check fraud charges against her be dropped.
Cindy and George Anthony and their attorney Brad Conway have also been subpoenaed to testify.
The hearing is happening on a crucial date in the case. Caylee's remains were found one year ago Friday.
Orange County meter reader Roy Kronk found the remains in the woods near the Anthony family home.

Dozens of new documents were released Wednesday in the case against Casey Anthony. They documents include pictures of Caylee Anthony, wearing a T-shirt that said "Big trouble comes in small packages," and that shirt could be the link between her life and her death.
The new photos show Caylee (see photos) wearing the same t-shirt that investigators say they found tattered with Caylee's remains and the same shirt they say Caylee was last seen wearing by her grandfather the day she disappeared.
In the photos, Caylee is next to her mother Casey, who is playing the guitar.

The saying would be cute under any other circumstances, but chillingly investigators believe she was wearing it the day she was murdered. WFTV legal analyst Bill Sheaffer says that, along with the fact that Caylee and the shirt were found around the corner from Casey's house, could be another piece of circumstantial evidence that could get Casey convicted.
“It the very least it's going to damage her credibility on the stand,” Sheaffer said. “Who was the last person seen with Caylee when she was wearing that shirt? Her mother, ergo the killer.”
The new documents also show that a study was done of the water levels in the wooded area (read study) where Caylee was found and that the lower-lying areas would have been under water during the six months she was missing, which is consistent with what Texas-based EquuSearch said about the inability to search because of water.
The study showed that the exact spot where Caylee's remains were found would not have been under water the whole time, which is consistent with why Orange County meter reader, Roy Kronk, was able to find what he believed were Caylee's remains in August in the higher-elevated areas.
The new documents also show that Casey made a little more than $20,000 in about one year and a half at the job she had at Universal Orlando (see wages) before Caylee was born.
Meanwhile, prosecutors have filed two more motions (protective order) | (witness list) in the case as well. One is to block release of an illegal recording of the defense team's interview with EquuSearch volunteer, Joe Jordan. He is the one who recorded the interview.
Prosecutors are also demanding a full witness list from the defense team and it accuses the team of withholding contact information about meter reader Roy Kronk's ex-wives.
COUNTY FILES RESPONSE TO CASEY'S DEFENSE REQUEST
Orange County, which runs the jail, says Casey Anthony should not get special treatment. The county filed court papers Monday, responding to her defense team's request that she not be videotaped without audio when she meets with her lawyers at the jail.
Also, that previous videotapes should be destroyed and that those public records are not disclosed.

The county says it has the legal right to have security video at the jail and does not have the legal right to destroy or withhold public records.

Lawyers for Casey Anthony want the death penalty off the table because they call it unconstitutional and say prosecutors don't have a legitimate reason to seek the death penalty in the case. They also say it violates Casey Anthony's constitutional rights.
WFTV legal analyst Bill Sheaffer calls it a long shot (full interview).
"I've never seen or heard of a case where a judge has gone behind the state's motives and dismissed the death penalty," Sheaffer said.
However, Sheaffer does believe another motion to keep the jail from videotaping attorney visits does have merit.
"I think it can produce a chilling effect on the attorney-client relationship to know you are constantly being monitored," he said.
But, since it's a security measure, Sheaffer says the judge would have to weigh Casey's right to effective counsel against the security procedures in place at the jail.
In a separate motion, the defense wants all recorded video visits and telephone calls with Casey's family destroyed.
The defense is also asking the judge to toss out charges in her check fraud case for double jeopardy. That motion argues Casey is being charged with multiple crimes for the same incident.
Eyewitness News learned that Casey’s death penalty lawyer, Andrea Lyon, helped file the motion likely because, if Casey is convicted in the check case, it could come up in the murder trial that she is guilty of multiple other crimes that involve deception.
In a final motion, the defense wants to keep private eye Dominic Casey from a deposition since they claim he was working for the defense and any knowledge he has of the case is privileged attorney-client information.
Casey is facing charges for stealing checks from her best friend. The fraud trial is set for January 25.
There's also a pre-trial hearing in her murder trial on January 21. She is accused of killing her daughter, Caylee Anthony.

Lawyers for Casey Anthony want the death penalty off the table because they call it unconstitutional and say prosecutors don't have a legitimate reason to seek the death penalty in the case. They also say it violates Casey Anthony's constitutional rights.
WFTV legal analyst Bill Sheaffer calls it a long shot (full interview).
"I've never seen or heard of a case where a judge has gone behind the state's motives and dismissed the death penalty," Sheaffer said.
However, Sheaffer does believe another motion to keep the jail from videotaping attorney visits does have merit.
"I think it can produce a chilling effect on the attorney-client relationship to know you are constantly being monitored," he said.
But, since it's a security measure, Sheaffer says the judge would have to weigh Casey's right to effective counsel against the security procedures in place at the jail.
In a separate motion, the defense wants all recorded video visits and telephone calls with Casey's family destroyed.
The defense is also asking the judge to toss out charges in her check fraud case for double jeopardy. That motion argues Casey is being charged with multiple crimes for the same incident.
Eyewitness News learned that Casey’s death penalty lawyer, Andrea Lyon, helped file the motion likely because, if Casey is convicted in the check case, it could come up in the murder trial that she is guilty of multiple other crimes that involve deception.
In a final motion, the defense wants to keep private eye Dominic Casey from a deposition since they claim he was working for the defense and any knowledge he has of the case is privileged attorney-client information.
Casey is facing charges for stealing checks from her best friend. The fraud trial is set for January 25.
There's also a pre-trial hearing in her murder trial on January 21. She is accused of killing her daughter, Caylee Anthony.

Lyons argument now is her speciality getting rid of or fighting a death penalty case. She seems to be making the argument that the State is being spiteful in its placement of the death penalty and in their spite wish to seat the harshest possible jury.

This is so troubling to hear her (AL) and to see CA wiping away tears...not for her dead daughter but for herself. I actually feel physically sick.
