Yes, Wrap, nothing makes sense, wish we knew more than we are being told about it.

I have thought since the beginning either she killed him or she has no idea who she sold him to.
This gal would sing like a canary if she could get out of jail.
Then again these gals seem to almost enjoy being in jail. They get lots of attention. Three meals a room and an account to buy treats. Perhaps that is the most they have ever had in their life. Amazing.

Nancy Grace Breaking now: Investigators reportedly planning to begin excavating a landfill in the search for possible remains of missing 8-month-old baby Gabriel! Will cops discover the body of the missing baby boy? Watch tonight for the latest breaking details!
I don't get it?? I am hearing two different stories.... ONE, they are still treating his case as a "missing Persons case" and TWO, they are going to go forward with the search of the landfill... is anyone else more then confused as to where this case is headed??

The gals that live in TX should be able to tell us based on climate since Dec 26th what are the chances he will be found if he has been in a landfill for over a month?

As far as the landfill question, it has not been hot enough. IOW, he could still be ID'd.
I am watching NG and now they have video tape that Gabriel was seen with a "mystery" couple. WTH??

World-Renowned Private Investigator , Jay J. Armes, Joins Search for Baby Gabriel
By James King in News
Mon., Feb. 1 2010 @ 3:44PM
A private investigator well-known for tracking down Marlon Brando's son in the 1970's has joined the search for the 8-month-old Tempe baby who went missing more than a month ago.
Jay J. Armes, who ironically has two metal arms after his were blown off in an explosion when he was 12 years old, is known simply as "the investigator." The dick typically charges up to a million dollars for his assistance but is offering his services to the family of missing Gabriel Johnson for free.
Armes says the inconsistencies in the story the told by the mother of the missing baby, Elizabeth Johnson, who also happens to be the last known person to see the child alive, is what prompted him to lend a hand (pun intended).
"Because of the way it happened, and the way the girl started lying from the beginning," Armes tells the San Antonio, Texas ABC affiliate WOAI. "At first, she had given it to a couple, and then she didn't know who the couple were. The harder the cases are, the more challenging they are to me."
Gabriel Johnson has been missing since before Christmas, when his mother disappeared with him after skipping a custody hearing.
Elizabeth Johnson turned up in Florida about 10 days later without the baby. She told police she had given the baby to a random couple she met in a San Antonio park but sent text-messages to the boy's father saying she had killed the child and put him in a dumpster.
San Antonio police still won't say they are investigating a homicide but have cordoned off sections of a landfill where the baby's body may be.
Anyone with information about the case is asked to call the FBI or the San Antonio or Tempe police departments.

Besides the intended pun, what a coincidence his name is "Armes", is that pronounced arms? He sounds like an investigator whose life story one day might be a basis for a TV series.

I think we're naive to believe that the area in the landfill has not been inspected in some way. We don't have the Sunshine Law in Texas and the Press certainly isn't privy to information concerning Law Enforcement's Investigations. Also ya'll can't forget about the TEXAS RANGERS. If Human Trafficking is in anyway involved then that's where the focus of the investigation is at. So much time as past the trail is probably getting frosty. And maybe LE isn't rummaging through the landfill because there is in fact a TRAIL !
It is still my belief that Elizabeth told Logan the baby was dead, just so he wouldn't search for a live Gabriel. She spoke these words thinking she was smart enough not to get caught. But in the end she is like Casey too dumb to make it happen the way they fantasized it would be!

The weather in Texas over the last month is average Winter weather for us. It has rained and been sunny, gone from the teens to the mid-eighties. They're predicting rain for the next couple of days, 50's during the day and 30's at night.

One big question I have is why would she stay in jail if she could identify the couple and find Gabriel. I do not believe the Smiths are innocent in all this, but I keep flip-flopping about what must have happened. I just don't know what to think.

Tempe police make arrest in missing baby Gabriel case
Reported by: Christopher Sign
Email: csign@abc15.com
Last Update: 11:47 am
According to Tempe Police Spokesperson Steve Carbajal, Tammi Smith was taken into custody just after 11 a.m.
The 37-year-old has been arrested for three charges including:
1. Conspiracy to Commit Custodial Interference (A class four felony)
2. Custodial Interference (A Class four felony)
3. Forgery (A Class four felony)
Smith is currently enroute to the Tempe Police Department and will later be transported and booked into the Maricopa County Jail, according to Carbajal. Smith and her husband Jack were named 'persons of interest' in the case last month. Sources confirm Jack was not arrested, but investigators say he remains of interest in the investigation. Eight-month-old Gabriel Johnson vanished from his Tempe home in late December. He was last seen on the day after Christmas when his mother, Elizabeth, reportedly took him from Tempe to San Antonio. Elizabeth was apparently fleeing from a custody dispute with the boy's father, Logan McQueary. Tempe detectives consider McQueary a victim in the case. Elizabeth was eventually arrested in Florida, but baby Gabriel was no where to be found.
"It is a very real possibility that Elizabeth killed Gabriel," said Tempe Lt. Mike Horn said. "We are holding out hope that he's alive, but we have to look at every aspect and investigate everything."
Tammi and Jack Smith last month admitted they had wanted to adopt Gabriel and were friends with Elizabeth. The Smiths have maintained their innocence since the boy went missing, but Tempe detectives have said they felt as though they were withholding information in the case. The arrest of Tammi Smith comes several weeks after the couple's north Scottsdale home was searched by detectives. Investigators will not discuss what they took from the home, but the Smiths said officers walked away with computers and paperwork. The case has garnered national attention over the last few weeks. Baby Gabriel remains missing. Check back for updates.

I believe so. I think that alone would be enough information to charge her with, but I suspect that LE is correct in their belief that she is withholding additional information and hopefully this arrest will result in her coming clean. I don't understand why they didn't do it sooner, unless they were waiting for her to make a mistake, providing more information or something. It'll be interesting to learn more as more information about the arrest is released.

Well, the extent of Tammi's wrongdoing may not go beyond this. EJ was a "loose cannon" in many ways and its possible that she killed the child. I dont really put much stock in eyewitnesses who say they saw her with a couple and a hispanic man. Remember
all the sightings of a "live" Caylee Anthony? People
think they see things all the time and 95 percent
of this type of sighting is not correct. If there is a real
underground network of people who do illegal adoptions it may be possible that Tammi does know about it. Lets hope she gives them some good info.

I think my last post got lost. Isnt this a huge amount of bail for what she is charged with? Is a class four felony more serious than a class one? Does anyone know how these classifications are defined?
1.1 million bond is more than some women get who have severely abused their children!

On NG last night, Tammi Smith said EJ called her from the jail last Thursday saying she (TS) messed up the custody deal with another couple. TS said she had no idea what she was talking about and felt that EJ was putting on an act for anyone around who would listen to her.
I will try to find the transcript.
I think LE found some controversial things on the Smith's computer and it def has to do with more than the forgery if she was arrested for three felonies.

Now this could get interesting - maybe the police are trying to set up a conflict between these two women.
By asking for such a huge bond to keep Tammi in jail
it could just possibly shake out the truth from one of them.

Here is the transcript from NG yesterday - snipped:
http://archives.cnn.com/TRANSCRIPTS/1002/01/ng.01.html
GRACE: And in just a few moments, joining us and taking your calls live will be Jack and Tammi Smith. Remember, they wanted desperately to adopt this little baby.
I want to go back out very quickly to Ellie Jostad. Ellie, what can you tell me about a phone call Mommy had from behind bars with the Smiths, this adoptive couple, that never got to get the baby...
JOSTAD: Right.
GRACE: ... where she blames them for hooking her up with this -- this couple in their mid-30s?
JOSTAD: Right. Well, supposedly, Tammi Smith got a phone call from Elizabeth Johnson. She`s calling from behind bars. And apparently, she then, Elizabeth Johnson, came out with his accusation or claim, you know, that, You guys, meaning the Smiths, are the ones who set this whole thing up. You`re the ones who set me up with the couple. Now, the Smiths deny this. They say they didn`t do it. So it appears that now Elizabeth Johnson is trying to throw the blame back on the Smiths.
GRACE: Or at least conjure up the fact maybe there was this couple, you know, and confuse the police.
JOSTAD: Right.
GRACE: Out to you, Marc Klaas, special guest, president and founder of Klaas Kids Foundation. Marc, what do you make of this recent development? Just as cops are set to start searching a landfall, we find out about a witness who spots Mommy with this Hispanic male, I believe three times total, and one of those times is with a couple in their mid- 30s.
MARC KLAAS, KLAAS KIDS FOUNDATION: Well, it certainly is encouraging news. I mean, it lends credence to the idea that she may, in fact, have given the child to another couple. But I`m like you. I don`t understand why, given the fact that she told the father that she had murdered the baby and thrown him in a dumpster, that they haven`t been looking in that landfill long before this.
(BEGIN VIDEO CLIP)
GRACE: Analisa, I want to go back to the Enfamil that you saw, this baby formula. Was it a can of dried Enfamil?
URIAS: Yes, it was.
GRACE: OK, how much was left in the can?
URIAS: It was full. It looked like maybe she had used it maybe once or twice, but it was completely full.
GRACE: OK. How many bottles did you see?
URIAS: He only had one bottle.
GRACE: Did you see a sterilizer to sterilize the bottles?
URIAS: No, I didn`t.
GRACE: That would have probably been set up at a sink. OK. So no sterilizer. And as far as food goes, how many jars of baby food did you see?
(END VIDEO CLIP)
(COMMERCIAL BREAK)
(BEGIN VIDEO CLIP)
LOGAN MCQUEARY, FATHER OF MISSING BABY GABRIEL: If she does go into one of her rages she won`t calm down unless she`s ready to calm down.
TAMMI PETERS SMITH, SPOKE TO ELIZABETH JOHNSON BEHIND BARS, PLANNED TO ADOPT BABY GABRIEL: I just could read it in her face that she did not want to be a mother.
ANALISA URIAS, ALLEGEDLY BABYSAT BABY GABRIEL IN SAN ANTONIO, TEXAS: She wasn`t, you know, affectionate with Gabriel on anything. It didn`t seem like she, you know, really wanted him.
MCQUEARY: Yes, I do believe she did -- she`d give him away.
T. SMITH: We want to believe that somebody has that baby.
UNIDENTIFIED REPORTER: At least one witness told authorities that Johnson was in the company of a Hispanic man on at least two occasions while staying in San Antonio. The man was in his mid to late 20s and was about 5`9".
NANCY GRACE, HOST: What was the description she gave you, as best as you can remember, verbatim of this couple, that took baby Gabriel?
T. SMITH: She said they were in their mid-30s, about -- the man was tall, not fat but kind of big. He had short, dark, really dark hair.
UNIDENTIFIED MALE: There`s two possibilities. That Gabriel is -- that she killed Gabriel or that she did not. There were and are some indications that he may be alive. I will tell you that since early on in those investigations those strong indicators that we`ve had aren`t there to the degree that they were.
GRACE: Who was it that called her on the phone and they were -- it was very contentious, they were arguing on the phone. Who was that?
URIAS: She told me it was her grandmother. I mean, I don`t know if that`s who it really was. But that`s what she told me.
GRACE: OK. Grandmother. All right, Analisa, what, to the best of your recollection, was she saying back to the grandmother?
(END VIDEO CLIP)
GRACE: We are taking your calls live. Is this just another hoax like Casey Anthony? The tot mom who says a Hispanic woman, Zenaida Gonzalez, took her baby, too, in a public park?
Doesn`t that ring eerily similar to this story? But if this story is true, it`s a whole new ball game tonight.
Tonight, apparently an eyewitness has come forward that places mommy with a couple, a couple in their mid-30s, along with a sighting of her with a Hispanic male twice. And he was with her with this couple.
Is he a baby broker?
We are taking your calls live. I want to go to Andrew J. Scott, former chief of police, Boca Raton, VP, Scotts-Roberts and associates, joining us out of Miami.
Andrew, for being with us.
ANDREW J. SCOTT, FORMER CHIEF OF POLICE, BOCA RATON, FL.; VP OR SCOTT- ROBERTS & ASSOCIATES, LLC.: My pleasure.
GRACE: If they know the spot, the spot where this diaper bag would be, why don`t they just search it? What`s the problem?
SCOTT: Well.
GRACE: Are there not enough people to look for the baby and search for the body?
SCOTT: No, I don`t think that`s the case at all. I think that`s been the $64,000 question as to why they haven`t gone to the dump as of yet until just recently, where they`re planning to go.
It`s kind of bizarre unless they have solid leads that indicate that the baby is still alive. But regardless you`d definitely want to get into that dump, get into that area, start searching it and preserve, if any evidence, that they could find.
It`s going to be a monumental task.
GRACE: Listen, Andrew Scott. If they -- even if they know where the diaper bag is, and we`re honing in on the diaper bag because now cops are saying they want to find the diaper bag.
They`re putting out the APB, all person`s alert, on this diaper bag because mommy tells daddy on the phone, as well as texting him, but tell him on the phone, I killed the baby, I put him in the diaper bag, and I threw him in the trash.
All right. It would be that diaper bag.
Here`s deal, Andrew Scott. If she did kill the baby, the longer they wait the less evidence they`re going to find. They`re all ready -- forget about cause of death. All right? We`re not going to get that now. The baby, if it is dead, is on its way to being partially skeletonized.
It`s out in a dump. You remember Lori Hacking? Is that name ringing a bell? Her husband killed her. It was at least six months before they found her in a dump. And what they found was some of her hair and a bone. That`s what she looked like in life.
That is the man that killed her and threw her in a dump.
So that`s what cops are looking at every day they delay. Yes/no, Andrew Scott?
SCOTT: You`re absolutely right. The more they delay the less evidentiary value there will be if there`s indeed a baby that`s found dead. So that delay is going to cause more deterioration of any physical evidence that they can find.
GRACE: Joining us right now, special guest, Tammi Peters Smith and Jack Smith. The would-be adoptive couple out of Arizona.
Both of you, for being with us. To you, Jack Smith, why is this witness just coming forward or has this witness been out there all along and we`re just hearing about it?
JACK SMITH, SPOKE TO ELIZABETH JOHNSON BEHIND BARS, PLANNED TO ADOPT BABY GABRIEL: We just heard about it this morning. We got the call about that because it was -- seems as though it was being somewhat held under wraps. But it`s our understanding that the police have known about this for quite some time. We weren`t made aware of it until this morning.
GRACE: Huh. Well, you know, another thing to you, Tammi Smith.
T. SMITH: Yes.
GRACE: I would love to know who this person is, but she did say she was with a male with dark hair, I believe she said he was Hispanic and a woman with long, blond hair. Did she not?
T. SMITH: She did. Wait, did you say the man was Hispanic?
GRACE: Yes.
T. SMITH: She -- Elizabeth didn`t say he was Hispanic. She just said he had very, dark short, very dark hair.
GRACE: OK.
T. SMITH: She didn`t say Hispanic.
GRACE: And plus there`s another male in the scenario. There`s a man and a woman, couple in their mid-30s and then there`s a Hispanic male. So I don`t know which one has dark hair. But I know one of them according to her has dark hair.
And I also know this witness looks at the man and says he`s Hispanic. Now what does that mean? I don`t know. But that`s how the witness described the male.
Now here`s the other thing. As best as you can, Tammi, in a nutshell, you get a call or you set up a call with Elizabeth, mommy, from behind bars. Whatever. You`re on a phone call with her and suddenly she says, look, it`s on you, you`re the one that set me up with this couple. Is that essentially what she says?
T. SMITH: I didn`t set up the call. I have a cell phone, and she shouldn`t even be allowed to call a cell phone. They`re not supposed to be able to do a.
GRACE: Don`t care. Don`t care. Don`t care how you got on the phone. Fast forward. OK?
T. SMITH: OK.
GRACE: What does she say about you setting up the meeting with this couple?
T. SMITH: She was just yelling at me saying this is all my fault, that I set this up, and I said, what are you talking about? I didn`t set anything up. And I asked her, how did I set this up? And she couldn`t tell me. I said, what`s their names? I don`t know. Well, then what`s their phone number? I don`t know. So she really didn`t.
GRACE: OK. Hold on. When was this conversation, Tammi?
T. SMITH: At my house, on my cell phone.
GRACE: No, when. When was this?
T. SMITH: I`m sorry, when? I think it was maybe last Thursday or something?
J. SMITH: Thursday or Friday.
T. SMITH: I think it was about a week ago.
GRACE: OK. Last Thursday. Today is Monday. So you got Sunday, Saturday, Friday, Thursday. Four days ago.
T. SMITH: I wrote it -- I wrote everything down.
GRACE: OK.
(CROSSTALK)
GRACE: Got it.
J. SMITH: 28th. I think it was the 28th.
GRACE: That was wise that you write everything down.
Unleash the lawyers. Famed attorney out of San Francisco, John Burris. Also, well known attorney out of the New York jurisdiction, Stacey Schneider.
John, all right. I don`t know that I believe anything that this woman says. If there wasn`t another witness that spotted her I wouldn`t believe it. Here she is, confronting Tammi Smith on the phone apparently for the benefit of those listening. A reporter or a lawyer, whoever, to suggest she was part of this whole thing.
John Burris, if you could work a deal right now for this woman, give me your best-case scenario if the baby`s alive, what would the deal be?
JOHN BURRIS, DEFENSE ATTORNEY: Well, what you try to work out here is that she would not be prosecuted for kidnapping. She would not be prosecuted for that.
GRACE: You know you`re making.
BURRIS: She`d plea to some minor.
GRACE: You`re giving me angina. All right? Don`t do that to me, all right?
BURRIS: I know, but.
GRACE: The twins need a mother.
(CROSSTALK)
GRACE: All right. You know what? Never mind.
BURRIS: That`s what she wants. And that`s what I want for her.
GRACE: She`s going to get prosecuted. All right?
BURRIS: No, no. I just said she gets prosecuted. Now she gets prosecuted but she doesn`t get prosecuted for, like, a major crime. She cuts a deal maybe for county jail time. She gets prosecuted. I`m just saying that she doesn`t get prosecuted for the more serious crime.
GRACE: All right. OK.
BURRIS: And that`s what I`m really telling you.
GRACE: John Burris, always a dreamer.
BURRIS: You cut the deal for her.
GRACE: Always a dreamer. Stacey Schneider, 20 seconds, what`s the best deal you can cut her?
STACEY SCHNEIDER, DEFENSE ATTORNEY: I would try to get rid of those felonies, try to get the custodial interference down to a misdemeanor charge, and possibly try to avoid jail time but she`d probably do a little bit on the misdemeanor. But certainly not as much as she`d do on felony conviction.
GRACE: OK, when we come back, the scenarios regarding if the baby is not alive.
Breaking news tonight. The search for baby Gabriel. We`re taking your calls live. As we go to break, happy birthday to Mississippi friends, tiny crime fighters, Madison and Mackenzie from Sosha, Mississippi.
Celebrating their third and first birthdays. Doctors when they were born didn`t give them much of a chance. They beat the odds. They are the beautiful daughters of parents Nick and Andrea. This past Friday they had a big birthday party with all of their family there.
Happy birthday, Madison and Mackenzie.
And happy 28th to North Carolina friend, Lori Duggar. She`s a professional animal grouper. Loves riding her horse, Spade, rodeo and most of all playing with niece, Emma. Lori`s mom, Martha, never misses the show.
Now isn`t she beautiful? Happy birthday, Lori.

(BEGIN VIDEO CLIP)
T. SMITH: She`s the last one with the baby. She had motive to get rid of the baby. She`s the one that`s fleeing. She`s the one who won`t cooperate.
UNIDENTIFIED MALE: She`s prepared to stick to her story and stay in jail as long as is necessary.
MCQUEARY: I want to believe that she did give him away so that maybe he`s safe and he`s with a -- you know, somebody that`s taking care of him right now.
UNIDENTIFIED MALE: She`s currently facing charges of kidnapping which is a class 2 felony, child abuse which is a class 4 felony, and custodial interference.
UNIDENTIFIED MALE: But is there anything you want to ask me or tell me?
ELIZABETH JOHNSON, MOTHER OF MISSING BABY GABRIEL: Ask you -- I don`t really know what to say. Everything is so false.
MCQUEARY: I do believe she`d give him away and not really care about it because she didn`t really seem like, you know, she was never really around. I kind of see how it was kind of easy for her.
UNIDENTIFIED MALE: She has definitely shown some unpredictable behavior in the past. So when she says that she killed that baby and threw him in a dumpster, is that a credible threat? Absolutely.
(END VIDEO CLIP)
GRACE: We are taking your calls live. Tonight there`s breaking news in the search for baby Gabriel. A witness has come forward stating that they observed -- he or she -- observed mommy, right there in prison orange, with a couple in their mid-30s along with a Hispanic male.
Is he a baby broker and did they take the baby?
I want to go out to Marc Klaas, president, founder of KlaasKids Foundation.
Marc, how do these baby brokers work?
MARC KLAAS, PRESIDENT AND FOUNDER, KLAASKIDS FOUNDATION: Well, I`m not sure how baby brokers work, but when you get down to it, I mean, I think you`re talking about human trafficking.
GRACE: I am.
KLAAS: If you`re not dealing within the system, if you`re dealing under the system in gray areas.
GRACE: You know what, Marc, stop. Please forgive me. You`re right. You`re right. That was a euphemism for human trafficking and I should not have called it baby broker. That`s really putting the perfume on the pig. To call it a baby broker.
This is illegal. The father wants the baby and this mom is telling people she killed the baby.
Now, explain to me with your knowledge of human trafficking, how this kind of deal works.
KLAAS: Well, basically, the way it works is -- this kid is the perfect baby to broker. He`s 8 months old. He`s malleable. He`s beautiful. He`s got a mother that`s willing to give him up.
So you put him together with people who are looking for a child for whatever reason, to raise them as their own or for more nefarious reasons, and you can make some pretty quick deals.
But obviously, we see that there`s something terribly wrong with this because whoever did this, if in fact this actually did occur, knows very well that the whole world is looking for this child and they`re not forthcoming about it. And there`s something terribly wrong and something terribly cruel about that.
GRACE: Well, John Burris, don`t you think by now if this story were true the mom would have said, OK, I met this guy online. I did a deal for the baby. That would explain where she got the money, who the Hispanic male was, who the couple was if they exist.
Or is this just more -- for lack of a better legal term, more B.S. this mom is spewing?
BURRIS: Well, it could be B.S., but on the same time, she probably -- if it is true she does have some criminal charges pending, so a lawyer would probably and should be trying to negotiate something for her. But if it`s not true then she`s probably wise to keep her mouth shut right now to see what really develops around whether this baby is found de or not.
Because that`s a very -- homicide is a very serious offense. But if the baby is alive and she has done something she should be trying to cut a deal. Her lawyer should be trying to cut one for her.
GRACE: Stacey Schneider, this sounds like the same strategy that Casey Anthony used behind bars. I didn`t do it, I didn`t do it, a Hispanic person stole the baby from me in a public park.
Same story until the body`s found. Is that what she`s waiting on?
SCHNEIDER: It seems like it, Nancy. I mean this is just -- she knows what she did. What kind of mother doesn`t cooperate with authorities in locating their child? I don`t care how angry you are at the father.
These are stories -- she`s very diabolical. She knows what she`s going to say. She puts out these phone calls and says certain things to set people up and set the stage how she wants it. She`s just covering up and it`s a terrible situation. I would not want to defend this one.
GRACE: Back to Dr. Robert C. Cartwright, his specialty, children.
Dr. Cartwright, you know in a lot of photos that emerged that she took right before the baby goes missing he`s sucking on a Tylenol bottle.
How dangerous is a Tylenol overdose for a little baby this size? I mean he`s 8 months old. He probably doesn`t weigh over, I don`t know, 10 or 11 pounds.
DR. ROBERT C. CARTWRIGHT, M.D., PEDIATRICIAN & ALLERGIST: We certainly tend to think that Tylenol is an otherwise harmless drug. But certainly in higher concentrations it is very dangerous. It is lethal.
It causes significant liver damage to the point of basically killing your liver which doesn`t bode well for him. So, you know, the idea that he`s playing with a bottle of medicine, no matter what the medicine is, is just -- is horrible. And something that just really does speak to what kind of situation he`s living in.
GRACE: To Dr. Danielle Levy, clinical psychologist joining us out of Atlanta, again for being with us.
Doctor, you have seen all the photos. You`ve studied the case file here. The mom just lies. She can`t help herself. Compulsively. Don`t you think the fact that she tried to drag the Smiths into this lie suggests the whole thing is a lie?
DANIELLE LEVY, PSY. D., CLINICAL PSYCHOLOGIST: Well, certainly she`s told lies along the way because her statements have been inconsistent. I think that the Smiths, though, were willing to take Gabriel and maybe that potentially gave her an idea that she could other people to take Gabriel off of her hands.
I think she made it clear early on that she didn`t necessarily want to raise this baby. So perhaps it`s great news that witnesses saw her with another couple.
GRACE: I`m just wondering, you know, Ellie, is this witness -- have they come forward to the police or did they go to a news outlet?
ELLIE JOSTAD, NANCY GRACE PRODUCER, COVERING STORY: Well, it`s not clear if they have spoken to police. But we know that they have spoken to one of the local affiliates there in San Antonio.
GRACE: To Jack Smith. Jack Smith, during your conversation -- you and your wife`s conversation with the mother last week, what else does she reveal, other than accusing you and Tammi of wrongdoing?
J. SMITH: Nancy, I wasn`t -- I was just on the -- hearing the back side of the -- one side of the conversation. You know, it seemed very, very strange, very scattered, very -- almost like she was scared and frightened. And she should be.
GRACE: What about it, Tammi? What else did she say?
T. SMITH: She was concerned about three people out of the country talking about this case.
GRACE: Why?
T. SMITH: I don`t know. That`s my big question to the police.
---------------------------
I bet the Police have a lot of Big questions for Tammi Smith!
http://archives.cnn.com/TRANSCRIPTS/1002/01/ng.01.html

I am so happy about anything new being reported regarding this case. Maybe now the truth will come out and they can find Gabriel.

That is one heck of a bond they have her on. I think they upped it to make her talk, talk, talk, chit and chatter. And, if I were Mr.Smith, I'd be packing my bags if she doesn't cause he will be next.

Smith's attorney, Michael Kimerer, said there would likely be a bond hearing this evening after she is transferred to the Tempe, Ariz., jail.

Baby Gabriel Case: Second Arrest, Still No Sign of Missing ChildTammi Smith Arrested Today for Custodial Interference, Forgery
By CHRIS CUOMO, KATE McCARTHY and ELISA ROUPENIAN
Feb. 2, 2010
It is the latest twist in the case of missing 8-month-old Gabriel Johnson: Tammi Smith was arrested this morning for forgery, custodial interference, and conspiracy to commit custodial interference, said police in Tempe, Ariz.
Elizabeth Johnson is due for arraignment in an Arizona court. Smith, 37, was arrested at 11:10 a.m. at her home in Scottsdale, Ariz., according to the police. She and her husband, Jack, said they were in talks to adopt Gabriel before he disappeared in December.
Sources told ABC News that authorities do not believe Smith knows Gabriel's whereabouts. She was arrested for her alleged involvement in a wrongful adoption. Smith's attorney, Michael Kimerer, said there would likely be a bond hearing this evening after she is transferred to the Tempe, Ariz., jail.
The Smiths were previously named as persons of interest in Gabriel's case. Police served a search warrant on their home, believing the two may be withholding information. Police took their phone records and laptop.
Kimerer said Smith has always been forthcoming in her meetings with the police.
"When Tammi went and visited the police she told them everything she knows," he said.
Gabriel's mother, Elizabeth Johnson, and the boy's biological father, Logan McQueary, were in the middle of a custody dispute when Johnson fled Arizona with Gabriel before Christmas. She allegedly sent text messages to McQueary, saying she had killed their son and left his body in a trash bin.

Was so glad to see Tammi Smith arrested, she knows a lot more than she has let on... Her attitude from the beginning has been one of "I have something over on everyone, I know more than anyone"...nanee nanee boo boo. She reminds me of an attention seeking child.

This statement in the article makes me wonder if LE has additional information indicating "a wrongful adoption" occurred or if this is just a poor choice of wording.

I am sure it is related to her listing someone else as Gabriel Father that had never met Elizabeth. Tammy's cousin or some relation to her. I think this is a very good strategic move by LE to arrest Tammy.

Lm, I am sure you are right. The wrongful adoption could definitely refer to her having admitted to naming her own cousin as the possible bio-father of Gabriel, even though she knew that was false. She was forced to admit that it was her handwriting, even though she feigned surprise at it and said "OMG", she must have forgotten that she did that.------- Gotcha! That is all they need to press charges, the admitted falsification of a legal adoption document. This was supposed to be a document filled out by EJ, the mother, according to my understanding, so all the more suspicious is that Tammi filled out any of it, and thus Tammi gets caught in her own lie and deception.

It kind of makes me wonder if this is Tammi's first rodeo when it comes to falsifying adoption documents.

Tammi has some kind of business - looks like a nice
one - this is going to cause her a lot of trouble- maybe
if she knows something she can get a plea in exchange for telling everything she knows.

Remember the bio-father that came forward to say that the same thing was done to him by Tammi?----She managed to strip him of his paternal rights to custody in order to adopt the child that I believe is the same child they are now raising?
Secondly, it was said that Tammi guided EJ to contact an "adoption expert" she knew in Tennessee (if memory serves me correctly) who was good at these kinds of adoption legalities.
And then I still do wonder why Tammi the real mom does not have custody of her own.
All this seems mighty fishy to me. I am just surprised that NG aligns herself so blindly with these and other people on her program and takes their slant on things----they come on and play her bigtime because she believes everything they say as gospel.

I had forgotten about all that, Terry Rose. I think Tammi is in big trouble.
And, I think Nancy allowed the Smith's on for the rating's..not necessarily because she buys what they are selling. Not taking up for NG, just saying..it's all about the ratings.

Yes, Wrap, but understandably she is grateful that these people are willing to be interviewed and I fully understand that. What bothers me is that her views become slanted in their direction, instead of continuing to act like a prosecutor she once was, digging for facts, like I would suppose she would have done in that capacity. Imagine how many times she would have been objected to by the defense for leading the witness or giving her own opinions or whatever they might call it in a court of law.
Just one little example of this: Tammi says EJ called her. Tammi says that EJ said that Tammi arranged it all so she ought to help her now to find the people she gave the baby to. NG immediately replies with a comment strongly indicating that EJ called her purposely to make that statement for anyone who was listening in to her phone call, be it cops, the media, etc. She comes to this conclusion immediately that EJ was a liar and staging something, playing right into Tammi's agenda. Whereas, the only person who has come forward to say that he or she actually heard this conversation was Tammi herself, trying to cover her own butt by pre-empting anybody else and making it appear that EJ was either delusional or putting on a show for her own benefit. It is equally possible that Tammi herself is putting on a show to save her own butt and using NG to do that. NG also refrains from asking sensitive questions to these same guests about their own actions in regard to the case, some things have been posted here at VH, but NG never asks them about those important issues that we read of here because it would put her guest in a different light perhaps.
I would say that NG jumps the gun and draws too many of her own conclusions, presents them as facts, and allows herself to be swayed by her guests. Don't get me wrong, I really like NG, but I just wish she would stop at digging up the facts and not be so quick to jump to conclusions or to be taken in hook, line, and sinker by the likes of the Smiths, Ron C., a few of her "experts", etc.
You sound like Sue Moss?---LOL----Do I sound like Jack Webb on Dragnet in the 1950s? "Just the facts, Maam!"

Here's a good link with an article (pretty much the same old stuff), video of Tammi being taken to PD after arrest and the arrest paperwork.
article: http://www.kpho.com/news/22412133/detail.html
video: http://www.kpho.com/download/2010/0203/22416309.pdf
arrest document: http://www.kpho.com/download/2010/0203/22416309.pdf
The arrest document has a nice summary of events (as it relates to Tammi Smith)
Summary of Tammi Smith's Involvement:
On 12/27/09, Tempe Police made contact with Tammi Smith due to an incident which occurred on 12/09/09 when Gabriel Johnson was found to be in the care of the Smith's. On 12/09/09, Elizabeth Johnson made a false report of kidnapping which allegedly occurred against Gabriel. On 12/09/09, T.P.D. Officers found Gabriel in the care of Tammi and Jack Smith. On 12/09/09, The Smith's disclosed their desire to adopt Gabriel Johnson to T.P.D. At the conclusion of the investigation on 12/09/09, Elizabeth was arrested for False Reporting to L.E. Due to this incident, on 12/27/09 Tempe Police Patrol Officers and a Detective arrived at the Smith's residence located in Scottsdale, Arizona in order to confirm that Gabriel Johnson was not in their care. Tammi Smith was interviewed at the time. A consent to search the Smith's property was granted. It was learned that Gabriel was not on their property. It is important to note, Tammi Smith withheld information from the police concerning her full communication with Elizabeth which was via text messages and phone calls. Tammi initially did not tell the police about the following text message which she sent to Logan McQueary on 12/27/09.
On 12/27/09, Tammi Smith sent the following text message to Logan: "Can we get together tomorrow morning to talk with you and your dad? I'm afraid she'll be gone forever, cause she doesn't want to go to jail for kidnapping. She doesn't trust u or ur dad. The only way she'll come back is if my attorney faxes the signed papers to her so she won't get in trouble, and Gabriel b w/us." Logan responded by typing "no" and that he wanted Gabriel returned to him. It is important to note that Tammi Smith did not disclose this information on 12/27/09 while speaking with the police.
On 12/29/09, I conducted a police interview with the Smiths. When I asked how the Smiths were going to handle the fact that Logan McQueary refused to sign over his custodial rights. Tammi Smith stated she was going to use her attorney's help to pressure Logan to pay previous child support, current child support and be responsible for visitation. Tammi stated due to the above listed pressure the hope was that Logan would release his custodial rights and the adoption could proceed. Per Logan's statements, Tammi and Jack Smith called him approximately 3 times and continued to ask him to release his custodial rights. The phone calls occurred during the month of December of 2009. Logan continued to refuse. Tammi Smith admitted to sending Logan a text regarding releasing his custodial rights. It is important to note that Logan McQueary and Elizabeth Johnson were in the process of court proceedings regarding custody of their son and child support. Their family case was assigned to the Honorable Judge Michael McVey from the Superior Court of Maricopa County. Please refer to FC2009-007470. On 12/28/09, Logan McQueary and Elizabeth Johnson had a scheduled court appearance regarding Petition to Enforce Child Custody determination. Tammi Smith was aware of the scheduled court appearance. It was later determined that Tammi Smith provided her with telephone numbers of people who could possibly assist her with legal advise regarding Elizabeth not attending the scheduled court date. This investigatigation discovered that the following information occurred while Elizabeth was in the State of Texas during the week of 12/21/09 to 12/27/09.
3899-031 IV-D-99 During the course of the investigation, I learned that Tammi researched and attempted to help Elizabeth change court jurisdiction regarding the custody hearing of Gabriel, although Tammi was aware of FC-2009-007470. Tammi stated she used her computer in order to find information on changing court jurisdiction. She then provided the information to Elizabeth. Tammi telephoned lawyers asking for legal advice regarding changing court jurisdiction. Tammi admitted to attempting to change court jurisdiction during a police interview. Tammi recalled making a telephone call to a relative in order to determine if housing was available for Elizabeth in the State of Tennessee this occurred after Elizabeth fled the State of Arizona). Tammi suggested Elizabeth enter a shelter after Elizabeth fled the State of Arizona. Tammi researched the topic of adopting an adult in hopes of adopting Elizabeth and Gabriel. On 01/04/1010, Judge McVey telephoned the .P.D. He provided me with a voice message which was left by Tammi Smith. I recognized her voice due to my previous interviewing. In the recording, Tammi Smith requests Judge McVey return her phone call. Tammi states that she believed that Elizabeth would return with the baby if she could know that Gabriel would be "safe." Tammi then suggests that Judge McVey grant the Smith's guardianship. The entire recording is approximately 2 minutes long. Tammi later stated a media reporter told her to call Judge McVey (this was her response to the message which she left). When I asked Tammi further specific questions about the reporter, Tammi could not recall if the reporter actually told her to call Judge McVey. On 01/12/09, a media source stated that the name of "Craig Cherry" (who was later found by T.P.D. and discovered to be Tammi Smith's first generation cousin) was on a court petition for paternity regarding Gabriel Johnson. I telephoned Judge McVey who stated paternity was not protested by the mother. Logan McQueary was determined to be the father. Judge McVey assisted with providing the means in which T.P.D. could have a copy of all court documents regarding Gabriel Johnson (FC-2009-007470.
On 01/14/09, I interviewed Tammi Smith while at the T.P.D. station. Tammi voluntarily provided a hand writing analysis. Tammi admitted that Elizabeth wrote down her cousin (Craig Cherry) on the paternity document. During a police interview, I presented Tammi with the court documents regarding paternity of Gabriel Johnson. Tammi then admitted to writing her cousin's (Craig Cherry) name on the court document regarding Craig as a possible father of Gabriel Johnson. Tammi read out loud the sentence which she wrote on the court document. The sentence included Craig's name. Craig Cherry was interviewed by the Tempe Police Department. It was learned through my investigation that he has never met Elizabeth Johnson. Tammi Smith also admitted to asking a friend if she could use the friend's husband's name on the paternity paperwork for Gabriel Johnson. I later identified the friend. The identified witness stated on the day in which Tammi was traveling to the court house with Elizabeth, Tammi telephoned her. Tammi asked her friend if she could use her friend's husband's name on the paternity court document for Gabriel Johnson. The witness became angry with Tammi due to her request. Tammi told the witness that if she could use her friend's husband's name then it would create a problem for the father (Logan). The friend refused to allow Tammi to use her husband's name on the court form. The above listed court document was analyzed by D.P.S. Detective Alan Kreitl. According to Criminalist Kreitl's findings the court document (item #47) contained the handwriting of Tami Smith based on her sample (item #57). For complete details, please refer to D.P.S. report #2010-701760. Tammi stated that Logan threatened her on 12/28/09 after a court hearing in Judge McVey's court room. The threat was allegedly made via telephone. Uknown to Tammi, Logan recorded the call. T.P.D. heard the call and no threat was made. Logan told Tammi to stop calling him. Logan hung up the phone line. Shortly after Jack Smith called Logan. Logan, once again disconnected the phone line. Tammi and Jack Smith have used the media to make many statements which later have been found to be inaccurate regarding their involvement in the investigation.
On 01/14/2010, after Tammi Smith participated in a police interview she was then interviewed by a reported from K.P.H.O. It is important to note that on 01/14/2010 Tammi did admit to writing her cousin's name on the paternity document concerning Gabriel Johhnson. Following the police interview, Tammi spoke to the media outside of the Tempe Police Station located at 120 E. 5th Street, Tempe. K.P.H.O. (Channel 5) released a media story on 01/15/2010 in which Tammi acknowledged the forgery by saying "I made a poor decision back when I met Elizabeth." "Yes I helped her put another name." She then told the public to pray about it. It is important to note that as of 02/02/2010 Gabriel Johnson's location remains UNKNOWN and his SAFETY CANNOT BE CONFIRMED.
This is one very manipulative (inappropriate term)! Her husband is no longer "a person of interest". Although he doesn't appear to have been involved near to the extent that Tammi was, he still had some involvement that warrants some charges. Seems like this is an opportunity for Jack's son to try to regain custody of his bio daughter. Providing proof of the current custodial interference they have been involved in will help support his claims of custodial interference.
IMO still, TS has been pulling the strings. That doesn't mean EJ didn't have a choice--she's still accountable for her actions. However, if Gabriel is not found or is found dead, I think TS is almost as much to blame as EJ (if she killed Gabriel). I do believe that TS may have been just as hellbent--maybe even more so--than EJ that Logan would not get Gabriel. I can see TS saying something like "If you aren't going to give him to me, then I'll make sure you don't get him either." JMO

Scottsdale woman in missing baby case released
The Associated Press

PHOENIX -- A Scottsdale woman who wanted to adopt an Arizona baby missing for more than a month has been released from a Phoenix jail.
Tammi Smith was interviewed at Tempe police headquarters Tuesday and later booked into Maricopa County jail on charges of custodial interference, conspiracy to commit custodial interference and forgery.
Lt. Mike Horn says the charges stem from the 37-year-old Smith's repeated and apparently desperate attempts to adopt 8-month-old Gabriel Johnson, not from the boy's Dec. 26 disappearance in San Antonio.
As she was leaving jail, Smith told reporters the Tempe Police Department is trying to create a case. Smith says it doesn't mean those charges leveled against her "are going to stick. Doesn't mean those charges are true."

How in the world did she pay a cash bail of 1.1 million dollars - or did they reduce the bail amount?

Apparently 1.1Mil was not enough to hold TS. She is out on bond.

TEMPE and SAN ANTONIO -- The Scottsdale woman who went from person of interest to suspect in the case of Baby Gabriel posted bond and walked out of jail this Wednesday morning, less than 24 hours after her arrest.
Tammi Smith, who wanted to adopt Gabriel Johnson, maintains her innocence, but the Tempe Police Department said they had probable cause to arrest her.
"All of the information we had led us to this arrest," said Sgt. Steven Carbajal of the Tempe Police Department.

A JOKE? WTH! It was a legal document!
Smith also tried to recruit male acquaintances to get them to put their name on a document seeking to have McQueary submit to a DNA test. The document required the name of a potential father, and when Smith couldn't get anyone to agree to it, she forged her cousin's name, Horn said.
Jack Smith said his wife wrote down her cousin's name on a court document for a paternity test "as a joke" and because she was rushed by a court employee.
"We didn't think it was a big deal," he said.
